The .1.23 acre site presently contains a single family dwelling and an agricultural building' that has been converted into a dwelling. The owner was notified by the Building Division in May 1993 to stop workon the conversion, for lack of necessary permits. The property is zoned A-R,`This designation allows duplex dwellings subject to approval of a Use Permit. A Board of Supervisors interpretation, 83-445 (Section 24-33 of the Butte County Code), states that a duplex is considered to be two dwellings, regardless of whether they are structurally tied. Both the General Plan Land TJse designation, Low Density Residential, and the A R zone state that one single family dwelling is allowed per parcel, However, the. General Plan does allow. other residential uses limited to a, maximum density of 6 dwelling unif"S per acre. This proposal would result in a density of 1 dwelling unit per 1.61 acres. Parcel sizes in the vicinity of this project range from 1/2 acre to 15 acres, with many 1 acre parcels fronting Mt. Ida Road. Section 24-47 requires that findings be made ;that the proposed use wild not impair the integrity and character of the zone mi whichthe property is located. (LPW) The Commission waived the reading of the Staff Findings. Staff gave a brief summary of the project. Staff said this i's a large parcel and the applicant is wishing to make a nearly completed dwelling legal: The hearing was opened to the public. Doug Southerland, Ron Graves BSc Associates, said this is an agricultural building being converted to a residence. He said the dwelling will be connected to water and sewer. He said the applicant has a problem with the condition from the Feather River Parks and Recreation District. He said the ,need for this fee has not been identified. He said , the tee has not been set out in an ordinance, nor has it been approved by the Board of Supervisors. He was requesting that Condition 3 be deleted. He did not feel the a applicant should be asked to sign an agreement without knowing the fee. Scott Lawrence, Feather River Parks and Recreation, said they staed the process two o years ago to collect these mitigation fees He said there is no wayto set a developer fee except by ordinance and they are working on that: He said the fee is $942 a unit established by Resolution a8-91 in 1991 by his district. He said the district is atteriipting to establish an ordinance through the Board as soon as possible. He said the -applicant would know the amount up front. Doug Southerland said Mr. Lawrence did 'riot address the fact that a study needed to be done shoyAng there is a need for the mitigation fee. Staff said in the case of tentative parcel maps, the applicants have. agreed to this rriitigatron fee because they are not he ones building the homes.
