The Commission waived, the reading of the Staff Findings. Staff noted that this application was as a result of the Commission's recommendation to the applicant that the segregation be for ag. processing rather than a homesite segregation. The hearing was open to the public. Kenneth Griger was there to answer questions. The hearing was closed. Commissioner Lynch asked if there was a condition covering the reque."t by Public Works for a deed of right-of-way. Staff said this was covered in Condition 1. It was moved by Commissioner Lynch, seconded by Commissioner Ostrowski, and unanimously tarried for approval as follows - A. The proposed segregation parcel contains various agricultural buildings including equipment storage buildings and rice storage silos, In addition, there are two residential dwellings on the proposed parcel. The proposed segregation parcel contains a house, a mobile home and, various agricultural buildings. The purpose and Intent of the homesite segregation ordinance Is to allow the segregation of one existing home In an agricultural zone subject to certain criteria. The Ordinance does not make any 0roVJsIon for Including a second dwelling, agricultural worker housing or agricultural building on the segregated parcel. From this standpoint the project does not meet the Intention of Butte County Code Section 24-64. The applicant Is also requesting a variance to the 2 acre maximum parcel size. The only apparent reason this request Is necessary Is to accommodate the additional dwelling and structures. The project will result in the creation of a 3.5 acre parcel. containing 2 homes, a barn, grain storage structures and, accessory agricultural buildings. The remaining 857 +/- acre parcel is cultivated in rice and will remain in agricultural production. The Variance is needed to consider a parcel. of 3.5 acres as the Ordinance restricts the homesite to a 2 acre maximum. Ig,4d: The parcel being segregated is not under cultivation. The parcel contains 2 homes,, a barn, grain storage bins, and accessory agricultural buildings. Segregation of this homesite parcel will not affect agricultural uses on the remaining land of the applicant, 1h: All of Butte County is within an Earthquake intensity Zone VIII. The parcel being created is already developed and no new development will be allowed on the remaining Lands. 3j: The parcel is located in a Zone A Flood Boundary as shown on the latest FEMA maps'. Since no new construction will occur, no mitigation will be required. 5d: Riparian vegetation occurs along the natural drainage that runs along the western parcel boundary. This provides a wetlands habitat for a variety of species. Due to the declining amount of wetland in California_, this type of habitat should be preserved. The riparian vegetation should be mapped and designated as a no -development zone which would not allow any new structures, cultivation, vegetation removal or filling in of the wetlands.
