A video of the site was shown. Staff said this property is 1 acre in size zoned A-40. The hearing was opener] to the public. John Shields said he was the representative for Mr. Hall. He said Mr. Hall agrees with the conditions. He said the problem with this parcel was created by a lot split. He said the garage was built, without building permits, before the lot split and the lot split placed the garage 5 ft. from the property line. He said Mr. Hall wants to sell the property and needs to make the building legal to do so. Commissioner Lambert said this request is not for a small variance, but for a 20 ft. variance which is substantial. Commissioner Lynch said he could not grant a variance on this property when the building was built illegally. He said when someone builds a garage they know they need a building permit. Mr. Shields said they are trying to educate the public. He said there are hundreds of illegal buildings in the County. He said if the Variance is not approved, there will be a foreclosure and delinquent taxes on the property instead of a legal sale. Commissioner Nelson said if the Variance is approved, Mr. Hall will make a profit off an illegal act. He was against the Variance. Commissioner Lynch said he agreed with Commissioner Nelson. Commissioner Lambert said the County or the Commission should not encourage and- condone ndcondone what has been done without permits. She said she could not make the findings to approve this Variance, Commissioner Lynch said he could not justify granting a Variance when it was a self- imposed problem. He said possibly the Beard could make the findings, but he colAd not. FINIDINGS OF FACT SUBMITTED BY T14E APPLICANT: See attached Exhibit "A" for applicants response: ANALYSIS 'Phis is a request to allow construction of a garage structure to encroach 20' into the required 25' side yard setback in effect allowing a 5' setback. The one acre parcel was created before the A-40 zoning was established, The side yard for which the variance is requested abuts a large agricultural parcel containing approximately 268 acres which would not impact another structure or view on the adjoining property. The A-40 zoning regulations were designed for Ir +rorty plus acre tracts of land intended for agricultural land use. Application of the 25' requirements of the A-40 zone on a one acre parcel creates an undue hardship; S' zed parcels to the east zoned SR -1 are allowed the 5' side yard setbacks. Granting variance would allow a residential setback standard to be applied rather than an agricultural setback standard. When considering a Variance request, the Planning Commission must determine whether strict application of the zoning code deprives the property of privileges enjoyed by surrounding properties in the vicinity and under identical zoning classification. Variances from the terms of the zoning ordinance should be granted only when, because of special circumstances applicable to the property including size, shape, topography, location, or surroundings, the property is discriminated against by a given requirement of the ordinance. The following exceptional or extraordinary circumstances or conditions apply to the land, building or use in question which do not apply generally to other Land, buildings or uses in the same district." This parcel was created in 1986 as a residential use, when the zoning was "U" which currently calls for 5 foot side and rear setbacks. Other residential uses on the adjacent streets Cessna and Skyway ate zoned SR -1 which also calls for 5 -foot side and rear setbacks. (See attached Assessor's Parcel. Map 39-44 which includes the streets Cessna and. Skyway, and which is adjacent to the 4 -lot parcel in which the subject property is located). In 1988 for some reason the subject property was included in a down -zoning to A-40 which effectively impacted the utility and efficiency of land use on the subject 1 -acne residential lot by requiring a 25 -foot side setback. "2. The fact that the granting of the variance is necessary for the preservation and enjoyment of substantial property rights is supported by the fallowing:" As can be seen from the accompanying plot plan, the home & shop d are appropriately placed around a circular drive on the 1 -acre parcel., (the parcel is largely in almonds). Placement of a garage between the house and the sloop, 25 feet from the west side property line is an unnecessarily inconvenient, unreasonable restriction which results from the technicality of the "after -the -fact" A-40 zoning.
