The hearing was opened to the public.
James Dalke said he grows barley and walnuts on his property. He said he has lived
there for 25 years. He said he hlF�s a back problem and Nvould like his son and daughter
in-law to live on the farm to help him.
The hearing was closed.
It was moved by Commissioner Lambert, seconded by Commissioner Lynch and
unanimously carried for approval as follows:
A. Find that this project is Categorically Exempt form environmental review; and
B. Find that the proposed use of the property will not impair the integrity and
character of the zone in which the land lies and that the use would not be
unreasonably incompatible with, or mijurious to surrounding I properties or
detrimental to the health and general welfare of the persons residing or working
in the neighborhood or to the general health, welfare, and safety of the County
because it meets the regulations of the zone and is appropriate in the A-20 zone;
and
C. Approve the Use Permit to allow a temporary mobile home as a second dwelling
on AP 039-140-023 (James C. Dalke) subject to the following conditions,
1. Occupancy of the mobile home is limited to Gregory Blankenship and
family.
2. No rent i's to be charged to the occupant of the mobile home.
3. Meet the requirements of the I Butte County Environmental Health
I Department for domestic water supply and sewage disposal.
4. The mobile home is to be a temporary use on the property pursuant to the
requirements of Section 24-304 of the Butte County Code6

5. The Use Permit shall expire two years from the date of issuance of the Use
Permit. Upon application, the Planning Commission may grant ail extension
of the Use Permit not exceeding one year.
6. In the event that the applicant who is residing within the mobile home or
the conventional residence, for any reason, moves to another location or is
deceased, then 'in that event, the Use Permit granted herein shall
automatically expire and the mobile home shall be removed within one
hundred twenty (120) days. In the event the mobile home is not removed
within one hundred twenty (120) days pursuant to the terms of the Use
Permit, the County shall remove the mobile home and store it at the
owner's expense.
7. The applicant is to pay a deposit or post a bond to cover the cost of
removal in the amount of $1,500 for a single -wide mobile or $2,000 for a
double -wide mobile.

PG&E - PG&E requests no mobile homes under existing power lines and that the applicant
contact Underground Service Alert (USA) 1-800-642-2444 to locate existing gas service, if any,
to ensure that mobile home is not located placed over existing gas line.
ANALYSIS:
This is a Use Permitrequest to allow the placement of a mobile home as a temporary second
dwelling pursuant to Butte County Code Sections 24-303 and 304, The applicant proposes to
place a double wide mobile home that will be occupied by his daughter, son-in-law, and two
grand children. The mobile will be placed amongst the existing orchard, approximately 136'south
of the house on. site. The proposal appears to meet all of the requirements for a temporary
second dwelling.
Butte County Code Section 24-304 provIdes for removal of the mobile home within 120 days of
the time that it is -no longer being occupied pursuant to the code section. The Code also makes
provision for the County requiring a bond or deposit at the time of application of sufficient size
to cover the removal expense of the mobile home. This is to insure that the taxpayers at large
(via the General Fund) are not charged those expenses should the County be forced to remove
the mobile home pursuant to the code. Of course, if the applicant removes this mobile bome
voluntarily, then the bond or deposit would be returned. Similarly, if the County removes the
mobile home, then only charges actually incurred would be reimbursed from the bond or deposit
with the remainder being returned to the applicant. A survey of several mobile home dealerships
in Butte County has indicated a rather wide range of estimated costs of removal. Cost, of course,
would vary due to installation of landscaping, decks, awnings, and physical site characteristics.
Taking the median figures and adding a small amount for administrative costs and storage costs,
it appears that a reasonable deposit would be $1,500 per single -wide and $2,000 for a double -
wide mobile home. These amounts seem reasonable to ensure that the mobile home i's removed
at no cost to the County or the taxpayers. The applicant proposes to place a double wide mobile
home on the property.

At the regular meeting of the Butte County Planning Commission held August 13, 1992,

On property zoned A-20 located on the east side of Alberton Avenue, Chico, was
approved subject to the following conditions,
1. Occupancy of the mobile home is limited to Gregory Blankenship and family.
2, No rent is to be charged to the occupant of the mobile home.
3. Meet the requirements of the Butte County Environmental Health Department for
domestic water supply and sewage disposal,
4, Themobile home is to be a temporary use on the property pursuant to the
requirements of Section 24-304 of the Butte County Code.

Permit, Upon application, -the Planning Cominission may grant an extension of

6. In the event that the applicant who i's residing within the mobile home or the
conventional residence, for any reason, moves to another location or is d6ceaSed,

the amount of $1,500 for a single -'wide mobile or $2,000 for a double -wide mobile.
8. Meet the requirements of the Building Division of the Department of
Development Services.
9. Contact PG&E's "Underground Service Alert - 1-800-�A2-2444" prior to placement
of the mobile home to ensure that the mobile is not placed over a gas line.
10. Applicant must also comply with all other applicable State and local statutes,
ordinances, and regulations.
Should you desire to appeal any of the conditions imposed by the Planning Commission,
you must do so in writing with the appeal fee of $516.00, to the Clerk of the Board of

Supervisors, 25 County Center Drive, Oroville, California, prior to 5:00 p.m., Friday,
August 21, 1992. If you do not appeal and if there are no other appeal within the 8 -
day appeal period, your use permit will be issued after August 21, 1992.
Recently enacted legislation (AB 3158, Chapter �706, Statutes of 1990, eff-ective January
1, 1991) requires that the. Department of Fish a,,,d Game impose and collect Ming fees
as specified to defray the cost of managing and protecting fish --md wildlifa trust
resources. These filing fees axe collected during the environmental review process and
are to be paid at the time the County files a "Notice of Exemption" with the County
Clerk pursuant to Section 21152 of the Public Resources Code. ,
To increase administrative efficiency, the statute delegated the collection of filing fees
to the County Clerk and provided the County authority to collect a $25.00 documentary
handling fee. The fee due for your pr 'ect is $25.00. A checks made payable to the

Butte County Treasurer should be submitted to this departiftent by August 25, 19�2.
Project applicants should be award Section 21089(b) of the Public Resources Code,
provides that any project approved under CEQA is not operatiVe, vested, or final until
the filing fees required tinder Section 711.4 of the Fish and Game Code are paid.
