(LPW) The Commission waived the reading of the Staff Finding. A video of the sight was shown. Staff gave a brief description of the project. Vice Chairman Lambert noted a letter received today from the applicant's son, Mr. Lee. CopIeQ- were made available to the audierice. Commissioner Nelson asked if the two esilsting dwellings are legal? Staff said yes. Staff said there is a home on the property and an agricultural worker's home. Staff said the ag. worker's home does not i1gure into the density. Commissioner Ferguson questioned if this appeal was made in a timely manner? Staff said the appeal period Was extended because the approval letter was not signed on September 1, as originally scheduled by the Develo�ment Services Director and thus the appeal was filed on time. Commissioner Ferguscn asked if there was a nitrate problem in this area? Staff said the site is outside the Chico Nitrate Plan area. Commissioner Ferguson asked if the mobile home was to be removed at the time the two story home was built? Staff said no. Staff said the agricultural employee housing i's hot required to be removed. Staff said the State law states the 62-1200 housing for senior citizens shall be allowed if they meet the criteria of the 'administrative code. Staff said it was the decision of the Development Review Committee and the Development Services Director to approve this permit. Staff recommended that the permit be approved and, if necessary, the Commissloh,coUld add conditions. Commissioner Nelson asked staff to go over the differences between an "Aunt Minnins' and "'Granny Housing'. Vice Chairman Lambert asked if the Commission has the option to condition this permit for a certain period of time even if the Commission does not have the option to deny the permit request? Staff said this is correct. Commissioner Nelson said that given the density on the lot at this time, he would feel better with a temporary permit. The hearing was opened to the public. Larry Martin said if this permit is granted there will not be any additional people living on the property, just an additional dwelling. Mr. Ka Lee said none of the neighbors have been to his property and no one has talked to him. He said he wants to be a good friend to the neighbors. He said he has been on the property for five years. He said because of religious beliefs he needed to move his mother out of the main house and into a house of her own. He said both he and his wife work. He said the property is not noisy W day long. He said there are time when friends come to visit. He said his mother is 79 years old and needs her own house. He said in his opinion the appeal was filed late. Vice Chairman Lambert said the appeal period was moved forward due to the permit not being signed on time and the appeal was legal. Mr. Kou Lee said there are no chemicals being used on their crops. He said there are only five neighbors near the property. He did not understand why so many people signed the petition. jog Mi said his property is on the west side of this parcel and he was born and gUe raised in this area. He wanted to assura the Leesthat there IS no prejudice on his s de because they are Asian. He said he admires the way they farm, He said be sprays and uses fertilizer on his own property only. He said he does everything within the guidelines of the agricultural commissioner. He said there is already two dwellings on the 4.9 acre parcel and he felt 3 dwellings would be excessive, He said he hat been on the property and has tried to talk to Mr. Lee. Larry Mendonca said he was opposed to a third dwelling on the property. He s6ld the regulations for a sei-ilor dwelling State it Will be the second d walling. He said in this case It will be the third dwelling. He said there is a high nitrate problem in the area and he is against a third dwellihg. H9 said Mr. Lee's letter states he has 4 children. Mr. Brown said he has seen 8 children getting on and off tile school bus. He was concerned a third dwelling would impact the neighborhood. He also stated he was not prejudiced. Nancy Corbett said she lives on the street and sells real estate. She said she has lived in this area for 20 years. She said she was concerned with the nitrate levels and with property values. She said the dwelling would be right on the road as is the ag. worker's dwelling. She was concerned with a third septic on the property. Steve Mendonca said he lives 3/4 mile from the site. He said he was against a third dwelling. He said this is a rural area. Harlan Wright said this would circumvent the Greenline regulations. Fie was against the project. He said it would add to the traffic problems. Mr. Ka Lee said more than once, at three in the morning, he has opened his bedroom window and had pesticides in the room from the neighbors spraying. He said more than once the County has walked into his house without notice. He said he wants people to come to him with complaints and not go to the County. He said he did not think he did anything wrong on this property. He said he has allowed other Asian people to c, -.,Me onto his property and pick the end of a crop. He said Mrs. Corbett has only lived there a little over a year. He said some of the children seen getting off the bus belong to the ag. worker. He agreed not to have a vegetable stand on the street if it was a traffic hazard. Mr. Miguel said this is an agricultural area and h9 has no problems with the Lee's farming. He was concerned with the third dwelling. He said the County requires him to spray at night. He said he triato to spray between 8 and 9 pill., hot three in the morning. Commissioner Nelson asked if Mr. Miguel would be opposed to the request being for a temporary dwelling to ba used by Mr, Lee's mother only, then removed? Mr. Miguel said ho would still be opposed to another dwelling being placed on this property, Commissioner Nelson said the intent of the 1w , to deal with Senior citizen housing. Vice Ch3irmah Lambert said Mr. Lee presented a property tax bill Indicating according to the msessor's; Office, the property is 5.4 acres and hot 4.9. Vii I ce Chairman Lambert said the Commission, by law, can not deny this request, but the Commission can put a condition on the permit for it to be a temporary use. Mr. McCabe said essentially she was correct. He said if all the criteria is met, the Ordinance states tha permit shall be granted. He said the Commission can condition this permit for a ceitain length of time. Commissioner Nelson said he agrees with the neighbors as far as the densibi goes. He said on the other hand, Mr. Lee has complied with the law and ordinance and the intent is for a senior Citizen dwelling unit. Vice Chairman Lambert asked if an Administrative Permit had to have the same findings made as a Use Permit in order to be approved, regarding the integrity and character of the zone in which it lies and not be detrimental to the health, welfare, and safety of the County, etc.? Mr. McCabe said some of the standard findings have already been made in the Ordinance. He said the Commission might want to consider future amendments to this Ordinance. He said the Commission has to go by the rules that are In place today on this request. He said he hoped the neighbors would communicate with Mr Lee. He said the Commission can put a time limit on the permit and tie it to the individual that is intended to live there. Vice Chairman Lambwl did not feel this use was appropriate in an agricultural area. Commissioner Ferguson said the dwelling will not decrease the land being used for farming. Commissioner Nelson said the conditions for this permit should be the same as the conditions for a temporary second dwelling unit. It was moved by Commissioner Nelson, seconded by Commissioner Ferguson, and unaiiimously carried for approval as follows: A. Find that the project is categorically exempt from environmental review; and B. Find that the Administrative Permit, as donsidered, meets the standards idehfi"ou, d in Chapter 24 of the Butte County Codei and C. Find that the proposed use of the property will not impair the integrity fAhd character of the zone in Which the land lies and that the use Would hot be Unreasonably incompatible With, or injurious to surrounding pt000tles or detrimental to the health and general welfare of the persons residing or working in the heighborhood or to the general healthi welfarej and safety cofthe County, and 14� lv53' 9 Permit to a D. No rent is to be charged to the occupant of the mobile home. 34 Meet the requirements of the Butte County Environmental Health Department for domestic water supply and sewage disposal. 4. The mobile home is to be a temporary use on the property pursuant to the requirements of Section 24-304 of the Butte County Code. 5. The temporary mobile home must be placed a minimum of 30 feet away from the existing structures. 6. The Use Permit shall expire two years from the date of issuance of the Use Permit. Upon application, "the Planning Commission may grant an extension of the Use Permit not exceeding one year. 7. In the event that the applicant who is residing within the mobile home or the conventional residence, for any reason, moves to another location or is deceased, then in that event, the Use Permit granted herein shall automatically expire and the mobile home shall be removed within one hundred twenty (120) days. The "living area" of an attached dwelling unit shall not exceed 640 square feet or 30% of the existing single-family dwelling unit living area, whichever Is greater. The parcel is zoned A-10. The applicant proposes to place a mobile home on the property. The site meets all setback requirements for the zone. The project appears to meet all of the conditions required for a. 'Senior Citizen Dwelling Unit as listed in section 24-202 of the Butte County Code. The following conditions are recommended: (1) The "living area", meaning the interior habitable floor space area of a dwelling, unit including basements and attics, but not including a garage or any accessory structure, shall not exceed 1,200 sque.re feet. (2) The senior citizen dwelling unit is intended for the sole occupancy of one (1) adult 62 years of age or over or two (2) adult persons, one of whom is 62 years of age or over. An affidavit of compliance with the age requirements of this section shall be recorded in the office of the Recorder prior to issuance of building permits. Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running with the land; binding upon the original owners and their heirs, successors and assigns, limiting the occupancy of the senior citizen dwelling unit to the conditions described in this section. (3) The senior, citizen dwelling unit shall not be sold as a separate unit unless a parcel containing the unit is created in compliance with the existing zoning anc; subdivision ordinances and the resulting density is in conformance with the General Plan, . (4) Two off-street parking spaces shall be provided for the senior citizen dwelling unit in addition to the parking spaces required for the primary dwelling unit. (5) Adequate sewer and water facilities shall be provided subject to the approval of the Environmental Health Department. (6) All site development standards as required by the zoningdistrict in which the unit is 'located shall be met, (7) The Senior Citizen Dwelling unit shall be a conventionally constructed, building or a mobile home that complies with the National Manufactured Housing Construction and Safety :Standards Act of 1974, except that in the -'W',. "FR", and "'I'M" series of zones a mobile homy as defined in Section 24-21.28, may be used. yJ Travel trailers and recreational vehicles shall not be allowed as a Senior Citizen Dwelling unit. (E) Provide an all, weather access for a 40,000 lb, fire apparatus to alt dwellings. (9) The approval of this permit constitutes approval only to the extent that the project complies with the Butte County Code and all other ,applicable regulations. (10) The requirements of all concerned governmental agencies having jurisdiction by law, including but not limited to the issuance of appropriate permits, shall be mete (11) Minor changes may be approved administratively by the Director of Developments Services upon receipt of a substantiate,E': written ,request by the applicant, Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved.
