For the structure to be removed from the Special Flood Hazard Area (SFHA) in areas of sheetflow flooding (Zone AO), the elevation of the lowest adjacent grade to the structure (the lowest ground elevation touching the structure) must be above the highest surrounding grade by an amount equal to or greater than the depth shown on the effective National Flood Insurance Program (NFIP) map. In addition, adequate drainage paths are required to guide floodwaters around and away from the structure; therefore the structure should be on an elevated pad within the sheetflow flooding area. Amendment (LOMAs) and Letters of Map Revision based on the placement of fill (LOMR-Fs), the Federal Emergency Management Agency (FEMA) bases its determination on the flood hazard information available at the time of the determination. Requesters should be aware flood conditions may change or new information may be generated that would supersede FEMA's detennination. When necessary, FEMA will inform the community about superseded determinations by letter. Requesters also should be aware that FEMA's denial of a request to remove a property (parcel of land or structure) from the Special Flood Hazard Area (SFHA) means FEMA has determined the property is subject to inundation by the flood having a 1 -percent chance of being equaled or exceeded in any given year (base flood). As mentioned earlier, this determination is based on the flood hazard information available at the time. If more detailed property or flood hazard information becomes available, and the requester believes the information will support removing the property from the SFHA, the requester may submit the information to FEMA at any time and request that FEMA reconsider its determination. In areas where base flood elevations (BFEs) shown on the effective National Flood Insurance Program (NFIP) map were used for the original determination, new BFEs cannot be used until they have been proposed and finalized through the community appeal process. The appeal process is described in detail in Part 67 of the NFIP regulations. If FEMA denies a request for a LOMA because the elevation of the lowest adjacent grade (the lowest ground touching a structure) is below the BFE and that elevation is raised to or above the BFE by the placement of fill material, the requester may submit the appropriate supporting data and request a LOMR-F in accordance with Paragraph 65.5(a)(4) of the NFIP regulations. In this circumstance, if both the elevation of the lowest ground touching the structure and the elevation of the lowest floor (including basement/crawl space) are at or above the BFE, FEMA will issue a LOMR-F to remove the structure from the SFHA. If fill material is used to elevate the lowest ground touching the structure and the lowest floor (including basement/crawl space) to or above the BFE, the requester also must submit a completed copy of Form 4, "Community Acknowledgment of Requests Involving Fill," from the MT -1 application/certification forms package that must be used for all LOMR-F requests. The application/certification forms package maybe downloaded directly from our website at http://www/fema.pov/mit/tsd/HM mpch .htm, or copies maybe obtained by calling our Map Assistance Center, toll free, at 1 -877 -FEMA MAP (1-877-336-2627). Effective October 1, 1996, FEMA revised the fee schedule for reviewing and processing requests for conditional and final modifications to published flood information and maps, thereby establishing flat review and processing fees for most types of request. Effective June 1, 2000, FEMA modified that fee schedule. All new requests will be processed under the current fee schedule. COMAENC-2 06/26/00 There is no review and processing fee for a LOMA request. The review and processing fees for requests for LOMR-Fs are shown below. We are located at Chico and Crouch Avenues and are in a flood zone. Mr. Herger, we have been here in this location since 1960 and have yet to see any water on our ground, even in heavy rains there is no collection of water. There is a creek quite a distance from us and the water has never reached the top or flood danger stage. F.E.M.A. claims that this is for the "100 year flood." I believe that happened in the late 1990's and we did not have any excess water. If one should have a loan or sell the property and the buyers have a loan you must have flood insurance to satisfy the lending institution and this is a very costly expenditure. I would like to know if there is some way these flood zones/maps can be reviewed. I have gone to the expense to have the property surveyed for an elevation certificate and have all the maps, etc. In reality, any property in the valley, here or elsewhere, could be termed as "flood zone." Management Agency (FEMA) on behalf of your constituent, Tommie Colmerauer of Chico, California. In a letter dated July 10, 2007, Ms. Colmerauer stated the area of her property at 3376 Chico Avenue is designated by FEMA as a zone subject to inundation by the 100 -year (1 -percent -annual -chance) flood. She noted her property has not flooded since she has lived there. Ms. Colmerauer also stated flood insurance is a costly expenditure, and her expenses for a survey of her property were unsuccessful in removing her house from the flood zone. Ms. Colmerauer requested your assistance in learning whether these flood maps could be reviewed and revised. FEMA and its mapping partners are in the process of preparing a Digital Flood Insurance Rate Map (DFIRM) for Butte County. A preliminary version of this map will be available for communities within the county to review by Fall 2008. However, not all floodplains in the county will be restudied. If Ms. Colmerauer would like to speak with local floodplain management officials about this mapping update, she can contact her local map repository, an office that stores the community flood maps for public reference and use. Ms. Colmerauer's property is currently shown on Pane1.06007C0485 C of the effective Flood Insurance Rate Map (FIRM) for Butte County, California and Incorporated Areas, dated June 8, 1998. The closest flooding source. to her property is Little Chico Creek, and the area of her property is designated Zone AO. Zone AO is the flood insurance rate zone for areas of shallow flooding during the base (1 -percent -annual -chance) flood, with depths between 1 and 3 feet. An average flood depth of 1 foot, derived from detailed hydraulic analyses, is shown for the area of Ms. Colmerauer's property. The Federal flood insurance requirement applies to structures located in Special Flood Hazard Areas (SFHAs), areas subject to inundation by the base flood, which carry a mortgage backed by a federally regulated lender or servicer. When Ms. Colmerauer applied for a Letter of Map Amendment (LOMA) in 2006, a FEMA review confirmed that the Lowest Adjacent Grade to her structure (the lowest ground touching the structure, including any attached decks or garage) is 2 feet below the level of the base flood. www.feina.gov Representative Wally Herger October 11,2007 Page 2 Ms. Colmerauer raised a concern about how her property could be considered floodprone. Due to the sporadic occurrence of flood events and relatively short history of the NFIP, it is not possible to base the delineation of flood zones on the lack of flooding occurrences in a particular location, flooding occurrences in recent memory, or flooding that has occurred since the inception of the National Flood Insurance Program. Rather, FEMA engineering studies are intended to develop the long-term projection of flood risk. The flood risk information presented on FIRMS is based on historic, meteorologic, hydrologic, and hydraulic data; open -space conditions; flood -control works; and development. FEMA estimates that structures in designated SFHAs have a one -in -four chance of incurring flood damage during the term of a 30 -year mortgage.
