AN)MYSIS The applicant is requesting approval of a tse Permit to segregate a 1.65 acre homesite from a 20, acre parcel, There are currently two buildings on the property occupied as residential dwellings. The A�20 zone only allows for one (1) dwelling unitper lot. On September 240 1,980, the applicant provided a letter agreeing to convert the existing residence to an office and work area, for the farm if he would be allowed to build his new home. Based upon the applicants assurance of the intended 'use as an office the building permits were issued for the neur residence. According to the applicant, the older house, upon completion of new home, was used as an office for several years. He then. converted the office back into A dwelling unit for an agricultural employee. Therefore, the applicant has requested a Vaniance to allow a dwelling unit on each parcel should the segregation be approved. The two residential. urflits on the 20 acre parcel represent a violation of the zoruing code. Should the request be approved Nvith a dwelling unit on each parcel, the Planning Commission would be establishing a precedent that is not consistent with the purpose of homesite segregation. The County Code is clear in that the property, , at remains as the agriculture po�rcel, will not be allowed to have a dwelling unit on it until st time t I hat the zone permits. We strongly feel that special circumstances do apply to this property, and that the strict application of the zoning ordinance deprives this property of privileges enjoyed by other smaller properties'in the vicinity and under identical zoning classifications.
