ANALYSIS:
This is a Use Permit -nplication to alloW the expansion of a
restaurant located at the irtheast corner of DlarhaM-Dayton Road and
Dayton Roaa. The restaurant and a small grocery store we're

established as an allowed use when the zoning was A-2.
A-20 zone was adopted on June 17, 1975. This applicatior is being
made pursuant to Butte County Code Section 24-37.4 which addrosses
changes or expansions in nonconforming uses.
The project involves removing an interior wall that separates the
restaurant from the store area and converting the store space to
restaurant use. The area to be converted is approximately 820 square
feeti The applicant is also proposing to add two bathrooms to the
existing structure. This project does not represent a significant
change in land use not will it conflict with any sutrounaing land
useso
in a phone conversation, the applicant stated the existing sealting
capacity is 48 people and after the remodeling is completed it will
be approximately 68 people4 The Butte Countyparking requirements
are 1 space per 3 seats, but in no case le.ss than 1 space per 200
square feet of gross floor area. The applicant's site plan shows 37
spaces which exceeds the requirements by 14 spacesi The existing
parking area along Durham -Dayton Highway is an open paved area that

Mr, Glanders and Mr. Pritchard from the Butte County Public Wor)�s
Departmentwere present and reviewed the evidence of the violation.
It is my understanding that at the present time you have an applica-
tion on,file with the Planning Commission for a Use Permit to con-
duct a lumber business on your premises. As I have explained,to you,
we are requesting your immediate ccxtipliance with the existaLng law
