SPECIAL CONDITIONS: 1. Meet the usable sewage disposal area requirements of the Butte County Subdivision Ordinance. 2. Relocate existing septic systems as necessary so that they do not cross or come within 5 ft. of new property lines. 3. Provide an approved water supply for parcels. 4. Create the parcels in accordance with the requirements of Chapter 20 of the Butte County Code and the State Subdivision Map Act. r 5. Provide access to Parcel 1 in accordance with 20-13A of the Butte County Code. 6. Prior to the division being effective, the owner or owners of the property included in the approved development plan shall execute and cause to be recorded in the office of the Recorder of Butte County, in a form approved by County Counsel, a restriction binding upon the original owners and their heirs, successors and assigns, which disallows additional dwellings from being located on the property until either of the following conditions occur: a. The property is rezoned to a designation that permits the density. b. At least ten (10) years has elapsed from date of recordation, and the Commission finds circumstances regarding said property and other properties in the area have changed sufficiently to reconsider the restriction (Ordinance #2167 Section 6, 11/25/80). C. No further residential permits shall be allowed on either parcel that is established by the Variance (93-01), either the homesite segregated parcel or remaining parcel. That there be no permit for a 62-1200 (Granny Housing) or Temporary Mobile Home (Aunt Minnie) on either of these parcels. 7. The home that is being allowed by the Variance (93-01) on the remaining 18.35 acres must meet building codes, Health Department regulations, and must pay school fees and sheriff fees as a new residence. Obtain the necessary building permits to convert the old dwelling into a residence. 8. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations.
