This is a proposal to create two 4.&S acre re parcels in an A-5 zone. The
tentative subdivision map was approved by the Advisory Agency on August
at 1984, but the final map has not yet been filed.
The reason for the variance is that while preparing the fin4L* lap, with
the cahtoptiah that the subject property contained 10.46 acres, it was
discovered that the Central Pacific Railroad had deeded thE. esteely So
feet of the Harris property to Butte County in September o4! Igis
removing 0.79 acres from said parcel leaving an area of 9.66 acres to be

divided.
The Department of Public Works is requiring that there be 40 feet of
right-of-way fram the centarline Of the Midway deeded to the County4
therefore, makirilg the Proposed parcels even smaller. The final acreage
of the proposed Parcels will be -446S acres +or lot 1 and 4.70 acres for
lot 2.
The department feels that, even though this oversight Could have and
should have been detected by the applicant, Mr. Harris felt he had 10.45
acres to work with and Was in conformance with the zone. ApOroval is
recommended.
A Negative Declaration regarding environmental impact is recommended
based an the initial study prepared far the tentative subdivision map on
the subject Property dated May 221 1984.
RECOMMENDATION. -
,A. Find that the requirements Of CEGA have been completed and
conseeed in maUing this decision and adopt a Negative

Section 24-49 due to special circumstances Applicable to the

This is a request for a Variance to allow two 4.82 acre parcels
.n an A-5 (Agricultural, S acre parcels) zone 'Located on the
west side of the Midway approximately � mile south of Roble
Road in the Durham area. This project was also the subject
property of a Tentative Subdivision Map which was approved by
the Advisory Agency on August 8, 1984. The attached initial
environmental study that was prepared fo-c that Tentative
Subdivision Map can be utilized for this project. A Negative
Declaration is recommended. �,
SUPPLEMENTAL INFORINIATION:
1.., The Tentative Subdivision Map was approved by the
Advisory Agency based on having 10.45 acres available.
The tentative map was conditioned to require 5 acre
minimum size parcels because of the A-5 'gone. Infor-
mation gathered during preparation of the final map for
recording revealed that the original parcel was only
9.66 acres, making two parcels of 5 acres impossible.

I am a landowner and resident in the effected area
of DUrhami My wife and I reside at 9662 McAftarlin Avenue
(AP No. 39-23-93)i Although the requested variance may on
its face seem insi5nificant, when considered in the context
of a developing trend in the effected area, the proposal
ind',Adually and cumulatively pcses a potential for a
significant environmental impact. For this reasont I urqe
that a negative declaration not issue and that the variance
request be considered only after full and complete environmenttl
review.
The effected area is at this time predominantly
agricultural, with an A-5 zoning classification. There are,
however, indications of trend toward subdivision and. develop-
ment of this agricultura3 land into one (1) acre parcels.
The applicant has at least contributed to this trend. After
four-parcolinq a twenty (20) acre parcelt the applicant
granted one (1) five (5) acre parcel to his daughter and
8on-in-lawj Mr. and Mrs. R. Miles Allen, who have in turn
sought a General Plan amendment consistent with a zoning

followed by a request by subsequent owners to further
develop on the 'basis of economic infensibility.
irrespective of one's view as to whether the
particular area should be developed, it would seem beyond
question that development should proceed only after due
con,sideration of the environment. it would also seem beyond
dispute that the time to consider and evaluate environmental
impacts is before not after taking action. In the light of
the close nexus of the Harris variance request to the devolop-
ment trends alluded to above, as a prerequisite to granting
such, environmental review of its potential individual and
cumulative effect should be undertaken.

Prior to submittal, it was determined that Mrei Harris owned
10+ acres,- therebyo the two proposed Parcels would meet the current

The Harrists Acquired the Property in April or 1956,by Grant
Deed, recorded In Book 823 Of Official Records of Butte ounty,
at Page 405, (a COPY is enclosed for your information), This deed
refers to Lot 14 of the M6Anarlin Tract, recorded In 18954 except-
ilig the West 660 feet. This OXCeption amounts to 10 acres. The
Official Map Of the McAnarlin Tract shows Lot 14 to have an area
Of 80-45 acres# thereby, leaving the Harriats with an area of 10.45
acres,

thereby, necessitating this application for variance.

This i s a request for a Variance to allow two 4.82 acre parcels
in an A-5 (Agrlicultural3 .5 acre paTcel,$) zone, located on the
west side of the Midway approximately Ih mile south of Roble
I Road in the Durham area. This project was also the subject
PI-Operty of a Tentative Subdivision Map which was approved by
the Advisory Agency on August 8, 1984. The atta(',,,,,d initial
environmental study that was prepared for that Tc—cative
Subdivision Map can be utilized for this project. A Negative
Declaration is recommended.
SUPPLEMENTAL INFORMATION-'
1. The Tentative Subdivision MaP was approved by the
Advisory Agency based on having 10.45 acres available.
The tentative map Was conditioned to require 5 acre
