to purchase this property from the Midway Boarding Kennel. She said the Humane Society is a

Cwl Leverenz, -representing Mr. & Mrs. Becholdtj questioned this being a suitable location for a
]kennel. He said noise and traffic are a problem in this location. fie said there is no information
foilell the Commission how many cars will be generated with this use. He said the zoning and the
p�,-pposed use are not compatible. He discussed the traffic problems on Midway, He did not think
t?ie Commission had enough information to make an Environmental determination. I said this
was not the proper location for this type of use. He asked that the Use permit be denied.

We ate opposed tO moving the Butte County Humane Society to
-'-the present location, of the Midway Kennel in Durham.
The Midway location is surroil--jefl Ly 'I. residentia2 area where
families live and sleep. People should -not be subjected to
constant noise, odor and unwanted animals that a --e- dropped
off after closing hours. The Durham School Draperty is also
in close proximity -
The finances of the Humane Society are limited- Without
access to significant sums of money, how can improvements be
made to accommodate the large number of animals expected to
use the facility7 The Midway Kennel has 35 open rQs which
we feel will nt�� e..-�erve the needs of a growing Butte County.
Sev
eral animals per run is inevitable.
Durham residents were not aware of this impending move while
residents in other Butte County communities had accesa to
petitions that encouraged the move to Durham. People who are
directly affected by this relocation should be involved in
the process and not kept "in the dark."
It is our understanding that being an independently operated
nOrl-Profit organization, the Humane Society is not subject to
county control. Without regulation, future conflicts are
guaranteed.
Let's put ourselves in the place of the many people who live
by the proposed site and ask ourselves if we would want to
listen to constant barking day and night. The Kumans Society
should be located in an area where people's lives won't be
disrupted and the facility can remain for the long term
without conflict from disgruntled neighbors.

a function that is vital to the sell -being of the community

We are writing to voice our opposition to the 3utte County
Humane Society use permit to have a :animal shelter on five
acres (zoned A-5) on the midway north of Durham.
The reasons for opposition are many. One reason is
that the kennel that is there now is very irritating. We
can not have the Windows open in the evenings because of the
:constant barking. 'Many nights are filled with interubted
sleep because of the kennel le live directly behind -the
kennel, but neighbours at both ends of 'McAnarlin Ave. have
complained of the noise. One barking dog is irritating, try.
putting up with twenty. it had to be a mistake, or
oversight, when the kennel was approved in the first place.
We certainly can not see how A.-5 zoning 1,►ould allow this to
happen.
Weer&'sure the dumping of stray animals will increase
since the shelter will be in the countryy and the chance of
being seen will be less.
It will probably also encourage ,people to seek other
commercial use of this so called agriculture land.
Since this area has been zoned A-50 many new houses
have been built or are being built. This is no place for
the Butte County Humane Society., Actually the dog kennel in
existence should have its use permit revoked for noise and'
nuisance and neglect of their 0- acres,. Now io ,.,the perfect
time to correct an obvious mistake.

The below signed citizens residing at the Casa de Flores :Robile
Home Community at 701 E. Lassen Ave., Chico want to state that
we deplore the unconscionable action of the Butte County
Planning Commission in rejecting a usepermit extension to the
Butte County Humane Society.
We believe that such an action is amoral when used on a public -
ally supported organization whose only aims are to help animals
who have been abandoned and/or treated cruelly. The $].,005 re-
quired for a new use permit comes from the pockets of kind-
hearted, tax paying residents of Butte County!!!!!
Ve hope the Board lvill see fit to again review the Society's
application for an extension of the Midway property's commer-
cial boarding use, and approve it.
As well, we believe that all mz On.ies charged to the Society
should be refunded so that they can be used for the purposes
:dor which we donated them.

Three years ago, the Butte County Humane Society- entered into a contract with the
City of Chico. in, exchange for the use of the CiVs property and pe . a
I Mussion to
build the SocieVs animal shelter on the property (paid for solely by donations), the
,Butte County Humane Society agreed to house and tare for the CiVs quarantined
and stray animals.
Sadly, the stray Population is growing at such a staggering rate that our shelter is
nolonger adequate to house both our animals and the CiVs animals. For this and
otherreasons, the Humane Society chose to accept the CiVs offer to purchase our
shelter and to relocate its shelter operations.
We knew that relocating an animal shelter was no easy task, and finding suitable
property was even harder. Fortunately, 'last spring we discovered thata, five -acre
parcel on the Midway, known as the Midway Kennels, was for sale and we
purchased the, property. We are extremely fortunate, the, property already contains
.a. "working" ken"nel - a private residence, a commercial dog kennel' and an
unfinished office. However We 8611 have a tTernendous amount off work ahead
before we can offer the to ' III
