Swimming Pool Requirements
Drowning, Prevention Safety Features
Based upon California Health and Safety Code Section 115920-115929, known as the Swimming Pool Safety Act
The County of Butte requires either a listed, approved safety pool cover' meeting ASTM Standard F1346-91,
OR a complying enclosure* which isolates the pool from the dwelling and remaining yard,
OR a complying enclosure* which surrounds the perimeter of the pool and dwelling, with door alarms and self-closing,
self -latching devices on all doors leading into the enclosure.
*Enclosures
• Minimum height of 60 inches
• Access gales shall open away from pool and have self-closing, self -latching device no lower than 60 inches above the
ground.
• Maximum vertical clearance of 2 inches from the ground to the bottom of enclosure
• No openings greater than %? inch within 18 inches of the release mechanism when closed.
• Gaps or voids shall not allow the passage of a 4 inch sphere.
• Outside surface shall be free of cavities or protrusions that would serve as a foothold or handhold that could enable a child
of less than 5 years of age to climb over.
• Maximum mesh size for chain link shall be a 2.25 inch square unless the fence is provided with slats fastened at the top or
bottom which reduce the openings to no more than 1.75 inches

• Shalt be correctly installed per the manufacturer's Instructions to prevent the access of children under five years of age to
the water.
• Shall be properly constructed to meet ASTM specifications and be labeled accordingly.
• All ties, anchors or attachment points and controls for automatic covers must be installed in a way to prevent operating or
uncovering the poll by children less than five years of age.
• The pool cover shall possess a listing that insures the original design or performance of the cover meets'.or exceeds testing
as prescribed by ASTM Standard 173346-91, Section 9 Test Methods for Safety Covers.

It is my understanding that a retrofit anchor bolt is required at a PHD2 holdown at a 6'
shearwall at the garage at the above referenced single-family residence. Per this letter it
is okay to install a new 5/8" diameter all -thread anchor bolt with 11" embedment into
existing concrete in a3/4" diameter hole. The bolt shall be installed with Simpson "Set"
Epoxy. The epoxy installation requires special inspection to be done Applied Testing of
Chico and shall be done in accordance with manufacturer's recommendations.

An application for a building permit has been submitted in your name listing yourself as the builder of the property
improvements specified.
For your protection you should be aware that as "owner -builder" you are the responsible party of record on such a
permit. Building permits are not required to be signed by property owners unless they are personally performing their own
work. If your work is being performed by someone other than yourself, you may protect yourself from possible liability if
that person applies for the proper permit in his or her name.
Contractors are required by law to be licensed and bonded by the State of California and to have a business license
from the city or county. They are also required by law to put their license number on all permits for which they apply.
If you plan to do your own work, with the exception of various trades that your plan to subcontract, you should be
aware of the following information for your benefit and protection:
o If you employ or otherwise engage any persons other than your immediate family, and the work (including materials
and other costs) is $200 or more for the entire project and such persons are not licensed as contractors or
subcontractors, then you may be an employer.
o If you are an employer, you must register with the state and federal government as an employer and you are subject
to several obligations including state and federal income tax withholding, federal social security taxes, workers'
compensation insurance, disability insurance costs, and unemployment compensation contributions.
o There may be financial risks for you if you do -not carry out these obligations, and these risks are especially serious
with respect to workers' compensation insurance.
o For more specific information about your obligations under federal law, contact the Internal Revenue Service (and,
if you wish, the U.S. Small Business Administration). For more specific information about your obligations under
state law, contact the Department of Benefit Payments and the Division of Industrial Accidents.
If the structure is intended for sale, property owners who are not licensed contractors are allowed to perform their
work personally or through their own employees, without a licensed contractor or subcontractor, only under limited

A frequent practice of unlicensed persons professing to be contractors is to secure an "owner -builder" building
permit, erroneously implying that the property owner is providing his or her own labor and material personally. Building

Dear Mr. Messina,
The Butte County Department of Development Services, Planning Department, has reviewed the
Environmental Health application for the proposed septic, well, and new house. Since your
property is surrounding by Orchard and Field Crops, it requires an agricultural buffer of 300' on
all sides of the property. At this time, the Agricultural Commissioner needs to review your site
plan and consider a request for unusual circumstances (see attached form). In order to do so, this
unusual circumstances form must be taken to the Agricultural Commissioner's office and they
currently charge a $65/hour fee. Unfortunately, the Department of Development Services does
not have the capability at this time to accept this fee and therefore, we are asking that applicants
make their payment directly to the Agricultural Commissioner, along with your site plan and
unusual circumstances request. Their office is located at 316 Nelson Ave. in Oroville, or can be
contacted at 538-7381.
Until I receive the approval, from the Agricultural Department, this Environmental Health
application cannot be approved. Should you have any questions please feel free to call Lana
