This project is similar to others you have reviewed in the Dayton
Subdivision. The parcel and proposed development appear to comply
with sewage disposal and water supply requirements of the "Old
Subdivision Ordinances".
The parcel does not comply with the current zoning area
requirement. Mrs. Cartwright requests approval based upon
determination of a "Vested Interest" and has supplied the attached)
documentation.
Please note:
1. This parcel is part of an essentially built -out subdivision.
2. Mrs Cartwright and her family have owned this parcel for many
years with the intent to ultimately sell it for use as a
single family homesite.
3. The questionable value of the property for agricultural use.
4. Mrs. Cartwright's written statement.
This department will not object to a determination of a Ves'.ted
Interest by County Counsel.

lot when the rest of the lots in Dayton were established.
It is one'of the about 15 remaining undeveloped lots in Day-
ton of the approximte 120 original lots which were established=
at that time. Property taxes have been paid on this lot as
single family parcel since then,
My parents purchased lot ff22 in 1957• In 1979 my sister
Marguerite G. Compton of Seattle, Tush., and I became owners*
It has always been our intent to sell lot #22 as a single
family homesite. It is surrounded by other lots and homes and
the street. It is too small to be used for income producing
agricultural land,

This memo is in response to your memo of February 10, 1992.
Upon review of the question presented, we have concluded that
the provisions of Butte County Code Section 26-7 should not be
applied in this instance to prevent the issuance of residential
building permits even though the parcels in question are smaller
than the minimum parcel size specified in the applicable zoning
(SR -1) .
In reaching this conclusion we have considered the fact that
substantially more than 50% of the lots in this subdivision have
already been developed, that the parcels are now zoned for
residential use, and that a denial of residential building permits
for these parcels would make the parcels essentially unusable.
