SUPERVISOR WS.EWL R PRESENT AT 'r'HIS TIME Mr. Tuttle stated there is another structure behind the property line, which was viOable across to the new structure BOARD OF 8UPI1-TtV1SORS MINUTF,S =,.. October , y 1981 • Supervisor Dolan stated there were a couple comments from property owners in the area. rf this was approved, that easement would still be there and there would be access, legally it has not changed. Del Siemsen, acting county counsel,, stated the only problems was whether this is a transfer with the use of the easement. If it is inside of the easement, there is no e-ffect. Since it sets on the line and will be five feet set back there is no problem. It is whether to allow it within the set back, of the property 'line,. Ms. Blair stated to allow it would require the variance for the garage and to the two points of structure for the garage and shade. The structure has been built along the side of the garage, carport for shade, This whole issue resulted when Public Works notedthe structure withcc;xt the proper permits. The Zoning Investigator was involved There are two issues to be addressed. Mr4 Tuttle responded to Supervisor Sar.aceni there was no concrete under this shade structure. It will be attached to a pre-existing fence. They are both two feet higher than the existing fence.. There is no solid structure between the property line and fence. It will only be for shade. Hearing closed to the public and confined to the Board, On motion of Supervisor Dolan,, seconded by Supervisor Saraceni and unanimously carried, to allow the variance for two structures to be located two feet from the side property line on property zoned "s -R" (suburban - residential), AP 39-38-30, property located on the east: side of Dayton Road, approximately 350 feet south of Marian Road, Chico area for Bob C.
