The property is approximately eight (8) acres in size and was subdivided into twenty-eight (28) lots by a map recorded on April 11, 1907, in Book 6 of Maps at page 45. In 1991, Mr. Bernedo sought permits to develop individual lots within the old subdivision. The permits were denied because development would . have been contrary to Chico Greenline policies, the zoning, and the Nitrate Action Plan. Litigation was threatened, and a long series of negotiations began. On December 17, 1996, the Board of Supervisors approved a settlement resolving the controversy. The settlement provided for the voluntary merger of the existing 28 lots, resulting in nine (9) buildable lots. Development of these resulting lots will meet building, drainage and health standards. The resulting lots range from approximately 0.80 acres to 1.26 acres in size, which is consistent with the developed lots in the Stanley Park Area. The mergers were published in a local newspaper in accordance with County Code and you should have received a' notice of the merger of 22 lots into 7 lots in August 1997. Under the terms of the Settlement Agreement, Mr. Bernedo is not required to construct the road and drainage improvements necessary for service to all the lots until he applies for the fifth residential building permit. Mr. Bernedo's Engineer, MER Consulting, has submitted plans for the construction of the required improvements. These plans propose the use of storm drainage leach trenches to dispose of the surface drainage. The County has not approved the plans, nor has Mr. Bernedo informed the County that he is ready to construct or install these improvements. The County has not approved and will not approve of Mr. Bernedo's use of Crouch Ditch to convey storm drainage unless his engineer, MER Consulting, shows there is John Drzal —10/2/98 Patrick Bernedo Development Page 2 sufficient capacity for the increased drainage or provides improvement , plans demonstrating how he would increase the capacity of Crouch Ditch: Your concerns with respect to the use of Crouch Ditch have been conveyed to MER. The County does not have specific regulations prohibiting an individual from diverting the natural flow of drainage waters onto a neighboring property; this is usually regarded as a matter involving private property rights to be .resolved :by the propertyowners personally or through the Courts,` if necessary.
