SETTLEMENT AGREEMENT This Settlement Agreement (hereinafter the "Agreement") is entered into by and between THE COUNTY OF BUTTE (hereinafter "County") and PATRICK S. BERNEDO (hereinafter "Bernedo") with respect to the following agreed facts: A. Bernedo is the owner of certain real property located in Butte County, California, known as Lots 1 through 28, inclusive, as shown on that certain Map entitled "Glendale Addition To Chico No. 1", which Map was filed in the Office of the Recorder of the County of Butte, State of California, on April 11, 1907, in Book 6 of Maps, at page 45; said property is commonly known as Butte County Assessor's Parcel Numbers 039-410-040 through 039-410-067, inclusive, and is hereinafter referred to as the "Property". B. The boundaries and dimensions of the Property are described in a Record of Survey recorded with the County Recorder of the County of Butte on March 27, 1992 in Book 124 of Maps at pages 77-78.,. as Recorder's Serial Number 92-13239 (hereinafter the "Survey"). C. A Certificate Of Compliance was recorded with the County Recorder of the County of Butte on August 28, 1995 as Recorder's Serial Number 95-029252 for Lot 24 of the Property (hereinafter the "Certificate") . D. Bernedo has applied for twelve (12) septic permits and one (1) building permit. for the Property. County has not issued the septic and building permits, on the asserted grounds that Bernedo is not entitled to septic and building permits. Bernedo 1 has threatened to initiate litigation against County to compel issuance of the permits and/or recover damages for County's refusal to issue the permits. County and Bernedo,' and their legal counsel, have engaged in lengthy negotiations as a means of avoiding litigation regarding the Property. E. County and Bernedo, as a result of their negotiations and without admission of liability by County, hereby -agree to the terms of this Agreement as a means of resolving their disputes and avoiding litigation. ,NOW THEREFORE, IN CONSIDERATION FOR THE COVENANTS OF THE PARTIES CONTAINED IN THIS AGREEMENT, IT IS AGREED AS FOLLOWS: 1. County agrees that there will be no fee charged to Bernedo for the merger process, including issuance of the Certificates Of Merger. 3. County agrees to issue septic permits, for a minimum of a three (3) bedroom house and for installation of a sewage disposal system and replacement area in accordance with the Butte County Code, for each of the New Lots upon submittal by Bernedo of a "Revised/Amended Application For Permit To Construct A Sewage 3 Disposal System" for each of the nine (9) New Lots, for which no additional -payment of fees by Bernedo will be required. Attached hereto as Exhibit "B" and hereby incorporated by reference is a sample of the Revised/Amended Application For Permit To Construct A Sewage Disposal System, to be completed by Bernedo. County, upon execution of this Agreement, shall refund to Bernedo the sum of Three Hundred Forty -Two Dollars ($342.00) for excess septic application fees previously paid by Bernedo. 4. Bernedo will, upon execution of this Agreement, initiate proceedings to abandon the two "Public. Alleys" which, as shown on the Survey., are: a. To the north of and adjacent to New Lots'l through 4, inclusive; and b. To the south of and adjacent to New Lots 5 through 9, inclusive. County further agrees, and specifically finds, that: a. The New Lots will comply with the Butte County General Plan; b. The New Lots will comply with' all applicable provisions of the Butte County Zoning Code; c. The New Lots will comply with the Chico Area Land Use Plan; d. The New Lots will - as developed pursuant to the provisions of paragraph 6 below - satisfy all legal requirements for health and safety including, * but not limited to, all provisions related to water and sewage disposal; and - e. There is no reason why all permits necessary for the construction of a single family residence, on each of the New Lots, will not be issued by County. 6. County and Bernedo, with respect to the development of the New Lots, also agree as follows: a. That portion of the merged parcel consisting of Lots 25-28 would be separated by Oak Street from the remaining portion of the merged parcel. County staff does not agree that this development proposal is the most desirable configuration for development. Although the reduction in the total number of parcels does move in the direction of compliance with the existing zoning and general plan provisions, twelve of the lots remain as currently depicted (8580 square feet each), which is much smaller than envisioned by the General Plan and Zoning and also much smaller than the developed lots in the 4 John Schwarz April 30, 1996 Page 2 adjacent Stanley Park area. The thirteenth parcel resulting from the merger is also much smaller than envisioned by the General Plan and Zoning and _too small to be effectively utilized for agricultural purposes. No other open space purpose has been specified for the merged parcel. From a staff perspective it would be more desirable for each contiguous pair of lots to be merged into one resulting parcel. For instance, Lots 11 and 12 would merge into one new resulting parcel, and this pattern would be repeated for all those lots which are west of Oak Street. This would create 12 new resulting parcels. Lots 25-28 would be combined and merged into one new resulting parcel east of Oak Street. I realize that Mr. Bernedo had hoped to develop existing lots only (with the exception of the one new merged parcel) because you thought that route would be less subject to potential challenge and also less likely- to set a precedent for development in apparent conflict with the Greenline. However, since the settlement would be in the context of settlement of threatened or actual litigation, and since a partial merger is included in your proposal, it would seem that there is little practical difference in this respect between the two alternatives. 3. The merger you have proposed would be effective without fee to Bernedo. This requires clarification. The normal merger fees are as follows: PUbT c pporks $280 plus $20 for each res— il':ing Darcel $110 - _- ......... _._ - _-r.. ..._..._. Environmental Health $80. We assume that it is these fees which you seek to have waived. In addition, there are recording fees of $6.00 for the first sheet and $3.00 for each additional sheet, for each resulting merged parcel. There are usually three sheets per resulting parcel so that the recording fee is normally $12.00 per resulting parcel. We assume that you are not requesting waiver of the recording fees. We note that if the alternative configuration discussed above were done there would be more resulting merged parcels, and the recording fees would accordingly be higher. 4. Lot 12 is not buildable in its present configuration due to the PG&E easement which crosses it. A new merged parcel resulting from combining Lots 11 and 12 would be developable. It is noted that the building "envelopes" will be tight on Lots 7-11 John Schwarz April 30, 1996 Page 3 and 19-24. 5. Septic permits could be issued as proposed based on the original applications; however, it will be necessary to obtain the approval of the Regional Water Quality Control Board. It is anticipated that such approval can be informally sought and readily - obtained from RWQCB staff. It will also be necessary to abandon the old well on Lot 56. 6. The Building Division does not wish 'to issue a permit based on the original application made in .1990, since different building standards are now in effect. Instead, it is proposed that the permit be issued on all the lots to be developed in accordance with the current State Building Code, as specified in Title 24 of the California Code of Regulations. Staff is uncertain what you meant by your words "...without any adverse conditions or actions by County." However, issuance of the building permits in accordance with existing standards, treating each of the parcels to be developed as legal parcels for this purpose, should resolve the matter. All current, standard conditions and fees would apply. 7. .From a staff perspective, it would be preferable to simply specify the setback distances in the settlement agreement (or in Merger certificates, if the alternative configuration is pursued). 1_i� t a�,�c ..d stances in the •A-20 zo-e. as. comp -follows: - r, .:2 U SR -1 Side 25 -'Feet 10 Feet Front 20 Peet 20 Feet Rear '25 Feet 10 Feet It would appear, however, that the provisions of Butte County Code Section.24-35.40 (copy enclosed) would indicate a side set- back of 10 feet for the existing non -conforming lots. It is noted that the provisions of Butte County Code Section 26-7 and 20-180.2(k) (copies enclosed) would have to be waived by the County in order to allow development of.the existing lots as now depicted. If the alternative development plan discussed above were followed, set -back requirements could be more easily met and the John Schwarz April 30, 1996 Page 4 Building "envelopes" would be larger It is noted that the paving width proposed (20-22 feet) is less than the standard 24 foot width. If the alternative development design suggested above were followed, the length of the road to be improved would obviously be greater, and it might then be less expensive to provide entrance off MacIntosh and Oak Street ratherTthan off Diamond. 9. The preference of County staff is 'that a permanent solution for drainage be provided. There is. concern that development could cause run-off towards .the old Crouch Ditch and Edgar Slough. This is more likely to occur if the lots as now depicted are developed than it would if the alternative development ---- proposal with larger lots is pursued. A less desirable approach would be for Mr. Bernedo to hold the County harmless from any claims for damage caused by drainage from the site. 10 and 11. Additional utilities such as phone and cable TV may be desirable. It could simply be specified that obtaining all utilities for the lots will be the responsibility of Bernedo. , I would like to receive`your response to the above comments before I meet with the full Board of Supervisors to discuss the . matter.
