5. The "Application for Administrative Permit" is 8ubject to review by County Staff
and approval by the Planning Director. Any special conditions of approval shall
be made a part of the approved "Administrative Permit" and shall be binding on
the applicant. The procedures for County action on Administrative permit
applications are stated in Chapter 24 of the Butte County Code.

The following conditions shall be applicable to all Senior Citizen Dwelling Units as defined In section 24-202 of the
Butte CoUhty Code and located within the unincorporated area oi Butte County.(

(1) The lot or parcel.,on Which the senior citizen dwelling unit Is proposed contains an existing single-family dwelling
unit.
(2) The "living area", meaning the interior habitable floor space area of a dwelling unit Including basements and
attics, but hot Including a garage or any accessory structure, shall hot exceed 1,200 square feet for a detached
senior citizen dwelling unit, The "living area" of an attached dwelling unit shall not exceed 640 square feet or
30% of the existing single-family dwelling unit living area, whichever Is greater.
The senior citizen dwelling unit is Intended for the sole occupancy of one (1) adult 62 years of age or over or
two (2) adult persons, one of Whom is 62 years of age or over. An affidavit- of compliance with the age
requirements of this section shall be recorded In the �-ffice of the Recorder prior to Issuance of building permits.
Said affidavit shall include the legal description of the lot or parcel and shall constitute a covenant running with
the land, binding Upon the original owners and their heirs, successors and assigns, limiting the occupancy of
the senior citizen dwelling unit to the conditions described in this section.
(4) The senior citizen dwelling unit shall hot be sold ai a separate unit unless a parcel containing the Unit 19 created
In compliance with the existing zoning and subdivision ordinances and the resulting ddh�lty it In conformance
with the General Plan. .

Pursuant to the provisions of the Zoning Ordinance of the County of outte and the special

2. Unless otherwise provided for in a condition to an Administrative Permit, all
conditions must be completed by the permittee within 12 months of the delivery
of the countersigned permit ;to the permittee.
3. If any uso. for which an Administrative Permit has been granted is not established
within one year of the date of receipt of the countersigned permit by the

you must do so in writing with the appeal fee of $290.00, to the Planning Department,

period, your Administrative Permit will be issued after November 10, 1992.
Recently enacted legislation (AB 3158, Chapter 1706, Statutes Of 1990� effective January
1, 1991) requires that the Department of Fish and Game impose. and collect filing fees
as specified to defray the cost of managing and protecting fish and wildlife trust
resources. These filing fees are collected during the environmental review process and
are to be paid at the time the County files a "Notice of Exemption" with the County
Clerk pursuant to Section 21152 of the Public Resources Code. '
To increase administrative efficiency, the statute delegated the collect'
ion of filing fees
