Erika Alm, Trustee of the Estate of Gilbert Alm ("Grantor"), does hereby grant to Durham Mutual Water
Company ("Grantee"), a California mutual benefit water company, a perpetual, inclusive, right of entry, and
easement over that certain parcel of land described in Exhibit "A," attached 'hereto and by this reference
incorporated.
Grantor does hereby grant to Durham Mutual Water Company, the right to enter upon the. premises
described in Exhibit "A" with workers and equipment in order to install, maintain and operate a fish screen facility
within and adjacent to Butte Creek along with a utility pole or poles to provide power service thereto. Grantor also
grants to Grantee a temporary right, during construction, to stockpile materials and supplies necessary for the
construction of a canal intake, fish screen, return line and associated facilities as required by Durham Mutual Water
Company for the installation of fish screen and fish ladder at the diversion dam of Grantee. Grantee shall return
the area used for such temporary area of use to its pre -project condition upon completion of construction.
Included within the rights granted herewith is the right to enter upon said premises, at all times, in order
to repair, replace, maintain, construct and reconstruct as required, facilities located upon the demised premises.
This easement is granted without'warranty of title or fitness for use. This right of entry and grant of easement shall
be binding upon the heirs, successors and assigns of Grantor and Grantee.
