This is a warning letter to notify you that you are in violation
of the Butte County Code, as follows, at the above -referenced
location:
You are in violation of the A-20•(Agricultural 20 Acre) Zone
by operating a competitive water skiing events. You are also
using a building as a ski equipment storage facility in
violation of the Building Codes.
You are directed to cease the use of the lake for water ski
tournaments and apply for the required building permits and
inspections prior to occupancy. facility.
You should be aware that Butte County has entered into a Code
Enforcement program that seeks voluntary compliance with the
Butte County Code, but provides an affective means of enforcement
if compliance is not obtained. If voluntary compliance is not
abtained, enforcement will be pursued through the issuance of
citations, fines, and recording Notices of Violation.
You have 10 days to voluntarily comply with the above directions.

'(B) TANK INSULATION. Storage type water heaters and storage and
backup tanks for solar systems shall be externally wrapped with
R-12 insulation or greater.
(C) PIPE INSULATION. The five feet of pipe closest to the water
heater and outside conditioned space shall be insulated with a
minimum of R-3. Steam and steam conditioned space shall be
insulated witha minimum of R-3. Steam and steam condensation
return piping and recirculating hot water piping outside the
building envelope shall be insulated in accordance with
T20 -1408(d).

Goal 3
Support the management of agricultural lands in an efficient, economical manner, with
minimal conflict from non-agricuttural uses.
Policies
3.1 Apply the County's Right to f=arm Ordinance to all non-agricultural land use
approvals, including building permits, within or adjacent to designated agricultural
areas.
r3.2 In order to preserve the maximum amount of land for co rcial agricultural
production and to avoid conflicts, restrict non -a ricultur use in the Zoning
Ordinance, including, but not limited to, water ski lakes nding stables, golf
courses, residential subdivisions; and industrial and commercial uses not directly
related to agriculture on agricultural lands. Public uses, including but not limited
to, sewer treatment plants, drainage facilities, and energy generating facilities shall

as not to unduly interfere with existing or planned agricultural activities.
3.3 Discontinue Agricultural Segregations for homesites (life estates serve the same
purpose).
3.4 Continue Agricultural Segregations for agricultural processing while requiring an
agricultural conservation easement on the remaining land, a vegetation buffer of
6 to 8 feet at full growth around the processing use, and a 200 -foot setback from
the agricultural area.
3.5 The primary purpose of the Orchard and Field Crop and Grazing and Open Lands
land use categories shall be for agricultural production, related processing, and
services in support of agriculture. Residential uses, such as the farmer's home,
in these categories are secondary uses and are permitted on a limited basis to
assist and support agriculture.
3.6 Carefully locate residential lands where limited agricultural uses and farm animals
are allowed, to avoid conflicts with agricultural operations. This includes, but is not
limited to, commercial stables, and the raising of exotic animals.

RE: Meeting Regarding Water Skiing Tournaments and Related Activities
Dear Mr. Garrett:
Thank you for meeting with me on March 17, 2004 concerning the above referenced
activities and the associated letter that I sent Mr. Don Scott on July 2, 2002.
During this meeting you provided the following information regarding these operations:
1. Water skiing tournaments held twice a year/Chico State waterskiing team also
holds practice sessions. .
2. Approximately 6-8 days of waterskiing activities per year.
3. Includes about 85 invited skiers and their guests, which can reach a maximum of
300 people occupying property and surrounding common areas at one time.
4. Invited guests and skiers allowed to camp on the property.
5. 32 motor homes have camped on the property at one time.
6. A $35.00 to $40.00fee is collected for skiing tournament.
7. Food sales are provided.
8. Three portable restrooms are provided for events.
9. Events are published in a water skiing guide.
I have reviewed this activity with Planning Division staff and I have concluded that the
level of activity associated with your waterskiing tournaments is not considered a use that
is allowed by right within the applicable A-20 zone as discussed in the July 2, 2002 letter
to Mr. Scott.
This level of activity is not considered a personal recreational pursuit. This is evidenced
by the collected fee, the holding of an event that is published in a water skiing guide, the
need for portable toilets, overnight camping, and the level of disturbance to adjacent
property owners. Restroom facilities and food sales at these events are also regulated by
the Butte County Environmental Health Division. A Use Permit is considered necessary
for the uses you describe taking place at the property at this time.
I must inform you that to continue holding these tournaments is a violation of Butte
County Code. You may wish to consider applying for a Use Permit for this use. Use
Permits are considered discretionary applications that are reviewed by staff. The authority
to approve or deny a Use Permit rests with the Planning Commission.

24-90 A-5 through A-160 (Agricultural) Zones. I�
The following permitted uses, uses requiring a use permit, and uses requiring an administrative
permit shall apply to all zones A-5 through A-160. Uses that are unique to a particular zone and
site requirements for each zone will be listed separately.
(a) Uses permitted:
(1) One (1) single-family dwelling or modular home per parcel.

(2) Agricultural uses, including the keeping of animals, subject to the animal maintenance
requirements of sections 24-255 through 24-255.15, inclusive, of this Code, the growing and
harvesting of forestry products, and aquaculture.
(3) Mining, quarrying, and commercial excavation which is exempt from a mining permit and
reclamation plan pursuant to chapter 13 of the Butte County Code. Oil and gas wells including
reinjection wells for natural gas.
(4) The erection, construction, alteration or maintenance of gas, electric, water or communication
transmission facilities.
(5) Housing facilities (including mobile homes) to accommodate up to twelve (12) agricultural
workers and their families employed by the owner or operator of the premises or owners or
operators of other agricultural lands pursuant to section 17021.6 of the California Health and
Safety Code and subject to state permits.
(6) The use of a single-family residence as a small family day care home, licensed family care
home, foster home, or group home for mentally disordered or otherwise handicapped persons or
neglected children. Said homes shall serve six (6) or fewer persons and shall be subject to all
applicable state regulations and limitations.
(b) Accessory uses:
(1) Those uses normally associated with a single-family residence use and are in conjunction
with or incidental to the residential use, including but not limited to a garage, workshop, shed,
garden, private swimming pool, private tennis court, gazebo, spa, etc.
(2) A guest house as defined by section 24-305.175.
(3) Buildings and uses accessory to the permitted uses, including agricultural processing plants,
airstrips used for crop dusting or seeding, barns and other storage or shop buildings, seasonal
hunting and fishing camps, including those which accommodate recreational vehicles and travel
trailers, providing that said recreational vehicles and travel trailers shall not be used for year-
round occupancy, recreational uses not requiring permanent improvements and not interfering
materially with agricultural operations, including hunting, fishing, camping, hiking, riding and
similar uses, the processing and sale of firewood and wood products grown on site.
(c) Uses requiring use permits. The following uses are permitted subject to a use permit:
(1) Public or quasi -public uses.
(2) Public tasting rooms in conjunction with a winery, provided that such tasting room be
considered accessory to the on-site winery.
(3) Kennels, feed stores, public or riding stables, and academies.
(4) Outdoor commercial recreational facilities on sites not less than five (5) acres.
(5) Wood lots and wood processing plants selling and processing wood not grown on site. Mining
and commercial excavation requiring a mining permit and reclamation plan pursuant to chapter
13 of the Butte County Code.
(6) Private airports or air strips that are not accessory to an agricultural use

processing site pursuant to section 24-290.
(d) Uses requiring a minor use permit. The following uses may be permitted pursuant to the
requirements of section 24-41:
(1) Large family day care facilities subject to the requirements of section 24-265.
(2) Bed and breakfast home.
(e) Uses requiring an administrative permit. The following uses may be permitted subject to the
requirements of section 24-40:
(1) Home occupations pursuant to section 24-270.
2) Temporary uses as listed imsection 24-300:--
(3) A temporary mobile home subject to the requirements of sections 24-295 and 24-295.10.

Regarding the waterskiing tournament to be held this Saturday, September 30, on the lake in the vicinity
of 10494 Chayote Drive, south of Chico, the property owner and apparent sponsor was informed in a
March 24, 2004 letter from Dan Breedon, Principal Planner, that in the A-20 zone such tournaments
require a Use Permit according to Section 24-90(c)(4) of the Butte County Code:

(c) Uses requiring use permits. The following uses are permitted subject to a use permit:
(4) Outdoor commercial recreational facilities on sites not less than five (5) acres.
As fees are apparently collected for the tournament, a large number of people are allowed to camp on the
property, and food sales and portable rest rooms are provided, the activity, although temporary, is
construed as an outdoor commercial recreational facility that occurs on a site greater than five acres in
size. Accordingly, the tournament host is in violation of Section 24-90(c)(4) in sponsoring the event

The current use of the lake is in violation of the.A-20
zoning. Violations are misdemeanors under the law and
