Policies 3.1 Apply the County's Right to f=arm Ordinance to all non-agricultural land use approvals, including building permits, within or adjacent to designated agricultural areas. r3.2 In order to preserve the maximum amount of land for co rcial agricultural production and to avoid conflicts, restrict non -a ricultur use in the Zoning Ordinance, including, but not limited to, water ski lakes nding stables, golf courses, residential subdivisions; and industrial and commercial uses not directly related to agriculture on agricultural lands. Public uses, including but not limited to, sewer treatment plants, drainage facilities, and energy generating facilities shall e-permu-del =Wbjec oUse-P_e=it--Suchfacil'dies_shallbe-caraf Uy--Io=ed=:so= as not to unduly interfere with existing or planned agricultural activities. 3.3 Discontinue Agricultural Segregations for homesites (life estates serve the same purpose). 3.4 Continue Agricultural Segregations for agricultural processing while requiring an agricultural conservation easement on the remaining land, a vegetation buffer of 6 to 8 feet at full growth around the processing use, and a 200 -foot setback from the agricultural area. 3.5 The primary purpose of the Orchard and Field Crop and Grazing and Open Lands land use categories shall be for agricultural production, related processing, and services in support of agriculture. Residential uses, such as the farmer's home, in these categories are secondary uses and are permitted on a limited basis to assist and support agriculture. 3.6 Carefully locate residential lands where limited agricultural uses and farm animals are allowed, to avoid conflicts with agricultural operations. This includes, but is not limited to, commercial stables, and the raising of exotic animals. i BU= C /Uw i CCv`'iPREH dGWY Pi.dVC is EWISMA - O'WdgVeSd May .9, 1995 ®1: - 1.14 y f, L Q MGA i .u.11L••i L..uc.l v. olVWveuu L. 92 _ A-20 19.7 acres jcc3- 4.9 ` 19.9 19.8 acres acres acres } RV Parking Area Q. 10/02/2006 Butte County Page Case Activity History Department of Development Services Case Number Case Name Type Subtype Status Description: CE06-0058 Ski Tournaments held without use permits ZONING VIOLATION Citation Issued Site Address Cita' 10494 CHAYOTE DR CHICO Owner GARRETT A KENT & JANICE L Address P O BOX 128 DURHAM CA 95938 Opened 09/28/2006 RHW Closed Last Action 10/19/2006 R14W Follow Up 10/19/2006 RHW State Zip Site APN CA 040-020-150 Resident Action Date Action Type Action By Action Description 10/19/2006 Court Roy Wallis TBA 09/30/2006 Citation Issued Roy Wallis Review of site showed Ski Tourney, taking place., Counted5-motbr hom /travel traileis & 4.tents, " Contact made with -event sponsor (A. Box 128 Durham, CA 95938 RE: Meeting Regarding Water Skiing Tournaments and Related Activities Dear Mr. Garrett: Thank you for meeting with me on March 17, 2004 concerning the above referenced activities and the associated letter that I sent Mr. Don Scott on July 2, 2002. During this meeting you provided the following information regarding these operations: 1. Water skiing tournaments held twice a year/Chico State waterskiing team also holds practice sessions. . 2. Approximately 6-8 days of waterskiing activities per year. 3. Includes about 85 invited skiers and their guests, which can reach a maximum of 300 people occupying property and surrounding common areas at one time. 4. Invited guests and skiers allowed to camp on the property. 5. 32 motor homes have camped on the property at one time. 6. A $35.00 to $40.00fee is collected for skiing tournament. 7. Food sales are provided. 8. Three portable restrooms are provided for events. 9. Events are published in a water skiing guide. I have reviewed this activity with Planning Division staff and I have concluded that the level of activity associated with your waterskiing tournaments is not considered a use that is allowed by right within the applicable A-20 zone as discussed in the July 2, 2002 letter to Mr. Scott. This level of activity is not considered a personal recreational pursuit. This is evidenced by the collected fee, the holding of an event that is published in a water skiing guide, the need for portable toilets, overnight camping, and the level of disturbance to adjacent property owners. Restroom facilities and food sales at these events are also regulated by the Butte County Environmental Health Division. A Use Permit is considered necessary for the uses you describe taking place at the property at this time. I must inform you that to continue holding these tournaments is a violation of Butte County Code. You may wish to consider applying for a Use Permit for this use. Use Permits are considered discretionary applications that are reviewed by staff. The authority to approve or deny a Use Permit rests with the Planning Commission. Should you wish to discuss the Use Permit process in more detail, or have any questions upon receiving this letter, please contact me at this office. Sincerely, Dan Breedon Principal Planner Cc: Joe Baker, Planning Manager 4'14-90 A-5 through A-160 (Agricultural) Zones. Chapter 24 ZONING* Article III. A-5 through A-160 (Agricultural) Zones (c) Uses requiring use permits. The following uses are permitted subject to a use permit: (4) Outdoor commercial recreational facilities on sites not less than five (5) acres. As fees are apparently collected for the tournament, a large number of people are allowed to camp on the property, and food sales and portable rest rooms are provided, the activity, although temporary, is construed as an outdoor commercial recreational facility that occurs on a site greater than five acres in size. Accordingly, the tournament host is in violation of Section 24-90(c)(4) in sponsoring the event without a Use Permit.
