Thisject is request for a Use Permit to allow aca61net shop on
property zoned W (Unclassified). !he shop was originally establigMud in
an H-2 zone but too much noise to be allowed without the
granting - a mep~rmt pursuant to paragraph I of Butte Count
COdc
Section 24-66, The applicant made application yp, the use permit While
the property was zoned A-2 and the U zone was adoptedshortly
thereafter. Since a use permit was still required for the cabinet shop
the project description was +'/=''y=" to reflect the U zone and T' -------
� acvordingly^ The environmental analysis identified thu pRIVzal +CXr
several impactsinvolving noise, waste materials, hourn af operation,
traffic generati%onv outdoor lighting and gIare, aesthot1cs, and dust.
Staff has suggested nine mitigation measures that would help mltigate
these potential impacts' The applicant has agreed to most of the
mitigation measures' and proposed alternate wording in three" Of the
three mitigation measures suggested for change, staff rocommende6 that
no outdoor storage of waste was to be permitted" The applicant
suggested that the warding be changed to no outdoor storage of waste is
to hes permitted with the exception 0f waste container to be emptied
weekly. This proposed mitigation measure is reasonable and should be

1h: All Of Butte County is within a Moderate Earthquake Intensity
Zone VIII. The subject property is located approxIm4tely 6 miles
southwest of the Tuscan Monocllnep a fault System of unknown activity.
Construction of buildings to Uniform Building Code standards for
seltmically active areas should provide adequate protection to
Occupants in case of seismic activity.

sources objectionable to neighboring properties. It is suggested that
any such lighting be directed and shielded so thai-, nelohbor'ing

cabinet shop Is capped by a roofing material of reflective metal. It
it recommended that the building surfaces adjacent to neighboring
properties be maintained In a non -reflective conditionf either by

to say that the Planning Oepartment is going to send a 10tter
to Bechholds ordering them to cease operation as a cabinet
shop until there is a public hearing on a use permit.
I asked Lhat the Planning 00partmunt also order the construction
Of the addition to the cabinet shop to CcaSe Until after the
hearing# as the use permit may be denied.
Craig said that he would check an that and get back to me.
I am in some doubt as to the issuance OF a building permit
for a cabinet shop wi,thout even considering the problems to,
the neighbors.

I am a property owner and resident of baja Court located south
of Entler Avenue in Southgate Acres Unit 2. On Saturday, December
14, 1985 1 was asked by Mr. Roy 3echold to sign 4 petition which
I was -told would indicate my support for a negaLive declaration
on an environmental impact report regarding the continued operation
of a cabinet shop by his son. He said 'he intended to operate a
10 man shop %itbiri his existing building. X isigned the petition
after asking t, few pertinent questions to try and determine �Ir,
techold's intent,
After reading a Notice of Public Hearing and staff findings re-
garding issuance of a use permit for this shop, I have ince removed
my name from the petitiott, My reasons for removin s
followsl g my name are as
I. Mri Bechold's application for a use permit on face value appears
that he is going to start up a cabinet shop when in fact he has
been building and selling cabinets out of the sAme location for
at least 20 months to. MY knor4ledge.. During tbi,s time he had
operated on a sma,11 scale Within the existing 281 x 40' barn.
In the last 3 montljs he has completely reconstructed and re-
modeled the barn, In addition to this he has pouted a new
concrete slab behind and contiguous to the barn and constructed
a completely -new shop. The 'Barn' is now sheetracked and wired
and is actuallY an integr6l Part of the shop.
2. He -obtained an agricultural building exemption permit under the
guise of an agricultural application In order to reconstruct
tho 'Barn' On November 14,, 1985, It is apparent that thi's was
done to avoid t_ogtly buSIding permits and increased assessment
fees, is estimate for improvements is stated as $608.0o.
The a�PLUX!Mate Cost for materials alone oll a 401 x 781 sttucture
of this nature would be over �60000.00 not including any labor,
This is actually a 3,120 S.F. newly constructed commdtcial allop.
1he normal construction co-_,ts for a structure of this nature
is approximately $20,00/8-F. The normal buil,ding 'permit fees
assessed are CPProxiMately $6.80 per $1000 valuation or
$544.00. Actual fee paid was $25,00.,

3. The continued use of a shop employing up to 10 men is incon-
sistent 1,71tb the current neighborhood. Sevaral homes in tbe
immediate area are in the $150,000 - $175,000 price range and
are less than 2 years old. Southgate Acres Unit 1 & 2 and
the parcels on AlYssum Way are just now baoinning to sell.
Potential new home buildevs are constantly-'5urveying available
lots in.the neighborhood and the increase3 influx of traffic
and bus7ness activity may stifle the eventual growth of the
entire n�,ighborhood,
4. The establishment of a 10 man shop with the corresponding noise
and traffic is a hazard to the normal traffic flow, Currently
Entler Avenue has a 7 ton load liLqit. Delivery trucks may
exceed thiso depending on the voluute of work the shop may
generate. Tho. present condition does not lend itself to com-
patibl� loading and unloading of delivery vehicles without some
major improvements to Matler Ave. The -paved width of Entler
Ave, on the north side of centerline is currently 6 feet with
a 2 ft, dirt shoulder, This makes it impossible for a delivery
truck to park Outside the travelle 4s no shoul

exist due to this condit'
ion coupled with the fact that ntler is
used by many as a short cut from Highway 99 to the Midw E
