Due to the zl7e of the subjett property, any Increase should not be significant. 1h: All Of Butte County is within a Moderate Earthquake Intensity Zone VIII. The subject property is located approxIm4tely 6 miles southwest of the Tuscan Monocllnep a fault System of unknown activity. Construction of buildings to Uniform Building Code standards for seltmically active areas should provide adequate protection to Occupants in case of seismic activity. 2a)b*. The project could result In the croation Of sawdust, which could escape Into the air along with fumes from flnlzhes solvents, etc. Measures should,be taken to assure that air quality standards are maintained. 3f: If sawdust and other wasteT associated with the cabinet shop are stored outside., care should be taken so that tannins, solvents, or other cKomicals do not leach out Into the soil or Into surface water on the propertyd 4d 4 Add I t I on of thtit bU I I d I ng 9 park I ng areas storage areas, etc. , may reuce tile area of ihe orchard on site. Since the orchard Is within a designated urban areao any loss of orchard land should not- be significant. I 6: Establishment Of a cabinet shop on site will Increase noise levels In the neighborhood and expose existing resident- to that noise. Step-- should be taken to reduce noise levels emanating from the project to those levels suggested by the Butte County General Plan Noise Element. Suggested noise levels are that outside noise levels shall not.exteed 60 dB (Ldn) on adjacent residential properties$ nor exceed, indoor levels of 45 dB (Ldn) on those same parcels. 7: Tine addition of yard or parking lot lighting could create light sources objectionable to neighboring properties. It is suggested that any such lighting be directed and shielded so thai-, nelohbor'ing properties are not affected. Th4 parapet wall construated on the cabinet shop Is capped by a roofing material of reflective metal. It it recommended that the building surfaces adjacent to neighboring properties be maintained In a non -reflective conditionf either by painting or choice of non -reflective materials. 8' Thit project will represent the introduction of an In dustrial use Into a nelohborhood that; Is planned for, agricwItural and residential U!eso and Is developing as; a rural residential area. 10a*- Any solvents, Paints or,other chamlcal,- LISed In production of the cabinets should, be stored and handled In such a manner as to reduce potential for fire or upset. i2l.' See Item 8, The cabinet ishop was constructed In close pr-OXI'mity _6 AOL 'to a neighboring home. Any potential Impacts associated with this projett would likely affect other homes In the Preap particularly the neighboring home immediately to the west. 13apcod,f: Establishment of an industrial Use In this residential neighborhood will Introduce heavier truck traffic Into the areao and could create traffic hazards due to +,rwck turning Motions and loading and unloading activit! es. No curb, Gutter,or sidewalks exist an the north side of Entlet" Avenueo and Pedestrian and blcyale hazards could be increased. 14! Though not signIficantp this PrOJect Will razpresonj an Incremental Increase In the demand for public services. 16e: When the building permit for the new shop building was Issued, the applicant entered Into an agreement with the Public Works Department to delay off-site Improvements such as curb, gwtter sidewalk and storm drainage facilities Until such time as other buildlogs In the area on this side of the street required similar Improvements. 17: Emission Of dust or fumes from the operation could create health hazardso as could rat or Other disease vectors associated with Any Waste or scrap piles established on the property. It Is recommend -,,id that no wastes associated with the operation be stored outside. Items 2 and 3f. January 16, 1986 Butte County Planning Commission ATTN4v Betty Kircher Director Of Planning #7 County Center Drive Oroville , California 95965 Dear Planning Commissioners! MY name is Daniel Palmer and I am speaking as a representative of 35 property owners who signed the letter addressed to YOU on January 10, 1986. These 35 people own homes on Alyssum Way, Ettler Av,inue and in Southgate Acres I & 2. We as a group are Opposed - to the issuance of a use Permit to Mr. Bechhold for the purpose of operating a cabinet shop On Entler Avenue -t. This is an'industrial use- in an otherwise agricult and residential neighborboo' ural d. It is in conflict with the General plan use designation Of -1-R, AG - pesidential ultimate zon3'ng. We agree with the staff finding ,s of December 15, 1985 which stated that "'the closest industrial uses are 1/4 mile to the eas Entler Avenue. t on Establishment of an extensive commercial use such as this would appear to compromise the integrity of the neighborhood and represent an I 4ntrtlsion Of commercial uses into a residential area". 1 The existence of a facility of this matnitudo will adversely affect the Property value of the surrounding neighborhood. After con - I ducting 8, Poll on estimated Property values, It was determined that there exists a Vested ' I Interest in excess of 2k million dollars in residential Property within this 'mmediate neighborhood, A compromise of only 5% Could devalue this Property by $1250000, far Of Mr. Bethhold's existing investment 'estimated to be $ in excess construction costs. 55i000 in now Butte County Planning Commission ATTN: Betty Kirqher January 16, 1986 Page 2 SbOuld this use permit be issued, a Possible slow -down in lot sales o, ; ,4ie adjacent streets could stifle the growth of the neighborlc;;od indefinitely, which would further reduce of all Oxisting h the value omes. We are also concOrned that an industrial operation Will degenerate the I quality of life in Lhis Otherwise quiet neighborhood. Increased noise from saws and jointers, dust, and a much. more frequent Occurence of large trucks double - Parked over -the centerline of Entler Ave. loading and unloading materials are all serious health and safety concern$ of the neighborhood. However, the pr- imary concern of eve ry resident Opposed to this facility is that it can establish a precedent for future industrial expansion of the remaining large parcels on the north side Of Entler Avenue. No One has any objections to the current AG, usage or of future residential development as the General Plan dictated, The foremost fear of all is the eventual rezoning Of all or part of Mr, Bechhold's property to industrial us 1 1 e and the specter of a manufacturing fac'l'tY looming up in our front yards, .Lf the use permit is granted, we feel that noise and traffic safety should be addressed, Operating hours hould be restricted to 8 hours a day, 5 days a weeki Adequate s dust collection systems with filters should be installed and monitored, Oft street parking4should be provided for employees and delivery vehicles and the north side of Entler Ave, should be improved to at least the requirements imposed On the south side of the street. It 18 not out desire to prohibit Mr. Bechhold from Operating shop) but Merely to a cabinet persuade him into operating in a Mote appropri- ately zoned locale compatible with other such facilities, Thank you, 0 i 1 0 3"ttQ County Planning CommimajoA ATTN: Betty Kircher Director of Planning 07 County Centar Drive OrOvIlIO, Californta , 95965 Dear Commissioners: PlannIng Q:zam. On Saturday, December 14, 1985 1 was asked by Mr. Roy 3echold to sign 4 petition which I was -told would indicate my support for a negaLive declaration on an environmental impact report regarding the continued operation of a cabinet shop by his son. He said 'he intended to operate a 10 man shop %itbiri his existing building. X isigned the petition after asking t, few pertinent questions to try and determine Ir, techold's intent, After reading a Notice of Public Hearing and staff findings re- garding issuance of a use permit for this shop, I have ince removed my name from the petitiott, My reasons for removin s followsl g my name are as I. Mri Bechold's application for a use permit on face value appears that he is going to start up a cabinet shop when in fact he has been building and selling cabinets out of the sAme location for at least 20 months to. MY knor4ledge.. During tbi,s time he had operated on a sma,11 scale Within the existing 281 x 40' barn. In the last 3 montljs he has completely reconstructed and re- modeled the barn, In addition to this he has pouted a new concrete slab behind and contiguous to the barn and constructed a completely -new shop. The 'Barn' is now sheetracked and wired and is actuallY an integr6l Part of the shop. 2. He -obtained an agricultural building exemption permit under the guise of an agricultural application In order to reconstruct tho 'Barn' On November 14,, 1985, It is apparent that thi's was done to avoid t_ogtly buSIding permits and increased assessment fees, is estimate for improvements is stated as $608.0o. The aPLUX!Mate Cost for materials alone oll a 401 x 781 sttucture of this nature would be over 60000.00 not including any labor, This is actually a 3,120 S.F. newly constructed commdtcial allop. 1he normal construction co-_,ts for a structure of this nature is approximately $20,00/8-F. The normal buil, ding 'permit fees assessed are CPProxiMately $6.80 per $1000 valuation or $544.00. Actual fee paid was $25,00., A152 Butte County ATTN: Betty December 17, Page 2 F"01 LAI, Planning Commission Kircher 1985 11 3. The continued use of a shop employing up to 10 men is incon- sistent 1,71tb the current neighborhood. Sevaral homes in tbe immediate area are in the $150,000 - $175,000 price range and are less than 2 years old. Southgate Acres Unit 1 & 2 and the parcels on AlYssum Way are just now baoinning to sell. Potential new home buildevs are constantly-'5urveying available lots in.the neighborhood and the increase3 influx of traffic and bus7ness activity may stifle the eventual growth of the entire n,ighborhood, 4. The establishment of a 10 man shop with the corresponding noise and traffic is a hazard to the normal traffic flow, Currently Entler Avenue has a 7 ton load liLqit. Delivery trucks may exceed thiso depending on the voluute of work the shop may generate. Tho. present condition does not lend itself to com- patibl loading and unloading of delivery vehicles without some major improvements to Matler Ave. The -paved width of Entler Ave, on the north side of centerline is currently 6 feet with a 2 ft, dirt shoulder, This makes it impossible for a delivery truck to park Outside the travelle 4s no shoul d way at there I der or, an auxillary parking area. Current traffic problems already exist due to this condit' ion coupled with the fact that ntler is used by many as a short cut from Highway 99 to the Midw E ay. People who work at Southgate industrial Par!,, Rexnord and P.G.&E, all have the game working hours and the commuter traffic at 8:00 A -M, and 4:30 P.Mj is a steady flout for up to 20 minutes. If a use permit i's granted for tbis I I Shop 't will establish a precedent for all property on the north side of 8ntler Ave, currently zoned U - Unclassified, The potential opportunity fOt rezoning this parcel to Light industrial is a ver concern of the majority of the neighborhood, y serious Southgate Acres a! well as the parcels on Alyssum Way could be jeopardized in terms Of resale value of all of the recently constructed homes. 6i In talking with several homeowners in, chese two developments, it has been expressed by at least five (5) people that Mr, Bechold misre-pre8ented his cause when he hand-cartied.his petl'- tioh seeking approvalOf his cqbinet Shop,. He bad said to many that it was merely a formality to allow him to continue to Operate and that whether one signed it or hoto he intended to remain in business at the pre—nt location. lie said -nothing about being granted a use Permit to OperaLe. This ties not brought to anyone's attention until Carot Carlson came around Butte County Planning Commission ATTN, Betty Kircher December 17, 1985 Page 3 and distributed copies of the Notice of Public Hearing which included staff findings and analysis on Sunday, December 15, 1985.
