Any special conditions of approval shall be made a part of the approved "Variance" and 'shall be binding
on the applicant. The procedures for County action ori Variance applications are stated in Chapter 24
of the Butte County Code,

The applicant of this project proposes to divide .85 + acnes of land into
two separate parcels, .29 acres and .55 acres in size. Two individual
residential dwellings currently exist an the subject parcel. The appli-
cant wishes to crenate a separate parcel for each residence.
The subject parcel is a pre-existing substandard size lot in an A-'5
zone. Since the parcel is not currently viable for agricultural use,
further division of the property, would riot remove agricultural, land
from production,
Two existing single family dwellings on the site have been continuously
used as separate individual 'residences for more than 20 years Bosh
houses front Lott Road andeachuses separate and individual 'drive
ways and'sept.c/leach field systems. A distance of 200 + feet
separates the two dwellings. The residences were built Gefore the parcel
was zoned A-5 (1967) or building permits issued for detached single
family dwellings (1962).
The divisitn of the existing parcel into two separate parcels would not
adversely 1-ml)act surrounding properties, nor create new uses not enjoyed
by other, property -owners within the AS zone. Traffic patterns and 1`
volume, storm drainage and septic systo:ns are pre-existing, and would j
remain unaltered, unless Tanvirunmental Health standards require modi-
fications to the septic systems or proposed parcel sizes
Although the project and site exhibit special and uniquo. circumstances 1
for a residential parcel,, described in the fcregoing.:paragraphs, the
project does not appear to meet�the standards in Butte County_Code
Section 24-49 for_granting a variance to parcel size in an A-5 zone-.
The applicant's site is riot being denied privileges or productive :use
of project property enjoyed by other parcels located in the same zone;
the ,A-5 zone r;,quires a, minimum of five aches for each parcel and allows
one residential duelling unit to exist on each parcel Further division
of the subject parcel would have the effect of slig tly irtcreasing the
diel ing` density within this county area zoned A� 5. ?ioreover, the
project site and applicrint have not demonstratod the existence, of a
tangible' hardship, attribute ale to the zone cireumscriblitt the use and
size of the existing parcel,- different from I'M tatiens imposed upon,
0ther property owners residing in the same zone. Conversely,,issuance

Ms Blairread Analysis and Recommendations from Staff Findings dated Feb
ruary 3, 1982 and added that there: was no correspondence.
The hearing was opened to the public.
Proponentst Cal Bockman; 3012 Esplande, speaking for the applicant, said
that he felt that because of the size of the parcel and because the build-
ings had been there for more than 220 years that necessary findings can be
"made fora variance. He pointed out the proposed location for a second

Commissioner Schrader said that he could support the project because there
would be no new building, nothing taken out of agriculture and no increase
in density.
Chairman Lambert agreed with the facts presented by Schrader, adding.that
it seemed; to be good common sense to approve the project; but because of
counsel's advice that not more than one substandard parcel be created by
a variance and yin the interest of voting consistency she would not be
able to vote't'o approve the project.
There was,noone to speak in opposition. T}le hearing was closed.
Commissioner Wheeler made a motion,; seconded by Commissioner Bennett, to:
A. Note that this project is categorically exempt from environmental
review; and
B. Find thdt the special; circumstances applicable to the project,
including size and surroundings -=note that we are dealing with a
p;�eexisting lot for size and for uses within the A-5 zoning and
that they (the houses) have been continuously, used as separate
individual reoidences for more than 20 years and will not create
new uses because there are other areas along that road that have
lots this small, --that the strict appl.icati,on of this Chapter de- j
prives such property of privileges enjoyed by other property in j
the vicinity, and under identical zoning classification; and
C. Approve a variance to allow the creation of two separate parcels,
