Please provide written clarification of referenced "penalties." The two structures in question were built under approved Ag Permit Exemptions, and appropriately utilized following initial completion. After appropriate ag. use, we made the decision to convert one of the buildings to an office, and the other to a garage. This decision followed my wife's decision to sell her 80 acres of rice land, which is still in escrow with Bidwell Title Co. (she has owned and farmed this land with her brother since 1974). Nowhere on our Ag Permit does it indicate that the changes we have made required a new permit. An Ordinance amending Chapter 26 of the Building code in this regard (Ordinance No. 30 10) was not even advertised until late May of 1992 (see attached copy of Chico Enterprise Record, dated Thursday, May 28, 1992), long after the conversion in question was completed. The Amended Building Code involved adding a Paragraph 12, which states, in part: "If, in the future, any change in use or occupancy of the agricultural building is made, building permits and approval of the Building Official shall be required." We believe that our conversion, which meets or exceeds all County Code requirements for such buildings (including being above the flood level elevation), requires issuance of a Permit only by the County. We therefore believe that your reference to "penalties" or potential penalties is inappropriate. Please clarify the reference to "Penalties" in your July 1st letter, and respond in writing. At the very least, we would expect that any future "penalties" which you might decide to levy upon us have been consistently levied upon all others in this County who have been found to have made similar conversions of mg -permitted structures. Alternatively, one could only conclude that any such action by the County was arbitrary and capricious. In this same regard, your earlier letter of May 27, 1992, clearly states that we were to obtain a permit, seek inspections and approvals from this office for conversion of an agricultural building to residential. Your specific words were: "...please contact this office within ten (10) days of the date of this letter, submit three complete sets of plans, apply for the required permits, and pay the appropriate fees. All work must stop until these permits are issued and you are authorized by our field inspector to proceed. This field authorization cannot be made until the existing work is inspected and approved. If voluntary compliance is not obtained, enforcement will be pursued through the issuance of citations, fines, and the recording of a Notice of Violation." We did precisely what your office requested. We stopped all work on the structures, which were already essentially complete, and then requested a reasonable time extension due to out-of-state work commitments on my part. When I returned from out-of-state, we then requested the Special Inspection of June 29th. Why are you now referencing penalties? Has new information been developed since your earlier letter of May 27th? Are these new "penalties" being considered in relation to the actual building itself, or in relation to purported use of the structure? 3. General Question re. Item 1: You state in Item (1) of your letter that we have to "Obtain Planning Department approval for an office in an A-10 zone." Two issues are raised. First, we purchased this house in November 1989, moved in on January 1, 1990, and up until several months ago believed that this area was zoned "SR -1 -ac". This "SR -1 -ac" zoning was noted by the County on both permits which the County issued for the two buildings constructed on the premises. I would like a written statement from your office re. the accuracy of the statement in your July 1st letter concerning our current Zoning. Are we A-10, as you say, or SR -1, as your Department indicated on our earlier permits? If a change in zoning has occurred, when did it occur? Is there a difference between A-10 and SR -1 so far as the issue of a personal office is concerned? If there are differences in requirements re. personal office construction, what are they? The federal jury acquitted seven other Nation of Yahweh members of conspiracy and deadlocked on two others. Yahweh wore his white robes and turban and often quoted the Bible during the five-month trial. Yahweh, whose name is Hebrew for "God, the son of God," hugged his lawyer and was kissed by followers after the verdict.
