For the reasons stated below, structural calculations need not be provided to Butte County. The following information should clarify how PG&E interacts with local permitting agencies when installing antennas on transmission towers. I am hopeful that this letter meets your needs. Because PG&E is a public utility, the design and construction of utility structures such as electric transmission towers and poles come under the jurisdiction of the CPUC rather than under local jurisdictions. We are responsible to the CPUC to ensure that we use sound engineering principles in the design and construction of our towers. Local jurisdictions are 'preempted' by State Law under the Public Utilities Code and cannot require a public utility to submit to their permitting processes when doing work on utility structures. PG&E has established the following procedures in order to comply with CPUC regulations and standards. Before mounting PCS or cellular antennas to any transmission tower, our structural engineers thoroughly review the structural integrity of the tower and the proposed mounting arrangement and determine whether modifications to the tower are required and that the mounting arrangements are suitable. In most cases, the additional loading due to the antennas and associated cables (both wind and weight) are so insignificant compared to the strength of the tower that neither actual structural calculations nor modifications to the tower are necessary. In some cases, however, structural modifications to the tower or mounting arrangement are required and must be done before any antenna may be attached. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 12 months of the date of approval. 3. Minor changes may be approved administratively by the Directors, of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as c:onditi.onally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or state regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. ?; 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a permit. Conditions of Approval: Planning Division: 1. The new antennas shall be painted to match the color of the existing lattice transmission tower. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that the 100 -foot tall transmission tower will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 9. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 2 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 12. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. If the Director of Development Services determines that the Facility is abandoned, the applicant may be required to remove all equipment belonging to the applicant from the premises and return the site to its original condition within thirty (30) calendar days of receipt of notice to abate. If such Facility is not removed and the site returned to its original condition within thirty (30) days, the County may remove the Facility at the applicant's and/or land owner's joint and several expense. 13. The equipment shed shall be screened from view with a minimum six-foot tall wooden fence surrounding the equipment pad. All screening treatments, including landscaping, shall be maintained as approved for the life of the Facility. 14. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 15. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to 3 reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 16. The Facility shall be secured at all times to prevent access by the public. 17. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Exhibit D" and date-stamped October 25, 2001, and is incorporated herein by this reference. 18. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. 19. Applicant must also comply with all other applicable State and local statutes, ordinances, and regulations. Building Division 20. Building permits are required for the antennae and equipment shed. Engineer design calculations are required to verify adequacy of existing tower structure and footings when additional antennas are installed. Environmental Health Department 21. Prior to issuance of building permits, submit a Hazardous Materials Release Response Plan to Butte County Environmental Health as required by Chapter 6.95 of the California Health and Safety Code. (PG&E account number BFB 97 42201) On Tuesday December 18, our Electric Department Representative made a visual inspection of our facilities and noted that only a mobile home was being served from this transformer. He also rioted that a mobile home should not be using as much electricity as has been recorded. He then made arrangements with a Customer Service. Representative, to assist him in determining the cause of such high usage.„ On the morning of Wednesday December 19, 1984 both men visited the premises and spoke with your tenants, Mr. and Mrs. Flint. The overloaded transformer condition was explained to them. They asked them if th.ey had noticed any unusual events that could have caused extremely high usage, particularly during the past summer. The following conditions and events were discussed: 1. The air conditioner would not shut off until the breaker switch to the unit open.ed., . (shI t off).,-which— happened f.f).,_whish—happened repeatedly. 2. An individual electrician or appliance serviceman was called. He reported to them the following during his visit: a. the compressor motor was designed to handle a 50,000 BTU condensing coil; a 30,000 BTU con- densing coil is installed. b. the wiring to the air conditioning breaker switch was burned and the wires were bare. He made temporary fepairs. (the undersized condensing coil will cause the compressor motor to be over -- loaded and wiring to overheat and burn the .insu- lation off the wiring. In addition, the over- heating and overloading will cause'the breaker witch to oppia ( shut off). .ar. k - 2 - In addition to the above matters discussed with the Flints, it - was observed that the air conditioning unit is not properly mounted on a concrete pad. It was also noted that in the immediate vicinity of the unit there is a bog. All of the conditions noted above are potentially dangerous to life and,property and are unsafe, Enclosed is a copy of PG&E Rule No. 11, Discontinuance and Restoration of Service. Your attention is called to Section A, 4a on the third page. In order to avoid disconnection of service we are allowing twenty (20) days from the date of this letter for you to do either of the following: A. Make the following corrections: 1. place a concrete pad according to Butte County Building code specifications under the air. conditioning unit; 2. replace the condensing coils to the proper size for the unit; -and 3. replace all charred wiring from the unit breaker switch to the unit to meet current Butte County codes, or B. Remove the unit by 1. completely disconnect the air conditioning unit, 2. move it out of the vicinity of the mobile home, 3. disconnect the wiring at both the unit and breaker switch and cap off the wire ends with wire nuts or wrap with electricians -tape. In either option, it will be necessary for us to field verify that you have completed the work.
