Since permits and inspections are required for the above work, please submit three (3) complete sets of plans, apply for the required permits, and pay the appropriate fees. All work must stop until these permits are issued and you are authorized by our field inspector to proceed. The field authorization cannot be made until the existing work is inspected and approved. It is the County's goal to obtain voluntary compliance with the Butte County Code. However, you should be advised that Butte County has an active Code Enforcement Program which provides an effective means of enforcement if voluntary compliance is not obtained. Enforcement may be pursued through the issuance of citations, fines and the recording 'of a Notice of Violation including a description of the action necessary to abate the violation. You have thirty (30) days to voluntarily comply with the above directions or to present an acceptable plan for abatement or corrective actions to be taken by you. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the. special conditions set forth below: Stephen Gale is hereby granted a Minor Use Permit in accordance with application filed: Minor Use Permit to allow a Winery — Large Commercial Facility on a 5.43 acre parcel zoned A-5. 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-41. 2. Unless otherwise provided for in a special condition to this Minor Use Permit, all conditions must be completed prior to or ,concurrently with the establishment of the granted.use. The use granted by this permit must be established within 12 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the .Directors of Development Services, Environmental Health,. or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division If outdoor lighting is proposed, submit a lighting plan to the Department of Development Services prior to issuance of the Minor Use Permit. Lighting fixtures shall be shielded and located so that direct lighting is confined to the property and does not affect adjoining residential uses. (Mitigation Measure) MUP 03-07 — Page 1 of 4 — October 9, 2003 Plan Requirements: Submit to the Department of Development Services the type of exterior lighting fixtures to be used and lighting locations prior to the issuance of the Minor Use Permit. Timing: At the time of issuance of the Minor Use Pen -nit. Monitoring: Lighting fixtures will be reviewed prior to the issuance of the Minor Use Permit. 2 Should any archaeological artifacts be discovered during construction or excavation, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site and submitted his or her findings to the Planning Division, and recommended clearance to continue. State Law requires the reporting of any human remains or artifacts. 3. The processing of wine on the site is limited to the amount of grapes grown on the property. Ensure that site distance for vehicles leaving the property is not impaired by vegetation growing in the right-of-way by removing existing vegetation that causes an obstruction and maintaining a clear site distance. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of. Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. The required improvements must be installed and completed prior to final building permit inspection and before conducting the use on-site. (Mitigation Measure) Timing: Concurrent with site development: Monitoring: Department of Public Works shall check plans prior to approval and shall spot check in the field. Building identification and/or addresses shall be installed in conformance with Public Resources Code 4290 and shall be posted at the beginning of building construction and maintained continuously thereafter. 15. Fire hydrant identification, reflector or post reflectors shall be installed in a manner acceptable to the County Fire Warden. 16. Aside from the existing buildings, the applicant states that he intends' to construct only one new structure with the dimension of 24 feet by 24 feet for the purpose of wine tasting and retail sales. If any additional new structures are built or the dimensions of the new structure the applicant intends to build exceeds 24 feet by 24 feet, such shall be to the reasonable satisfaction of the County Fire Marshall. Applicant shall submit plans to the Fire Department for review and approval. MUP 03-07 — Page 3 of 4 — October 9, 2003 17. Provide an all-weather access that is at least 10 feet wide with a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus. 18. Although this minor use .permit is consistent with holding special events, an additional minor use permit must be applied for and be granted as set for in Butte County Code sub- section 24-263(F)(2)(d) before any such events may be held on the property. Such'events include, but are not limited to, weddings, assemblies, and craft airs. Even though such events may have been held previously on this property, they can not be held once this minor use permit is granted until the separate minor use permit for special events is granted.
