Minor changes may be approved administratively by the .Directors of Development Services, Environmental Health,. or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Minor Use Permit has been granted is not established within one year of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: Planning Division If outdoor lighting is proposed, submit a lighting plan to the Department of Development Services prior to issuance of the Minor Use Permit. Lighting fixtures shall be shielded and located so that direct lighting is confined to the property and does not affect adjoining residential uses. (Mitigation Measure) MUP 03-07 — Page 1 of 4 — October 9, 2003 Plan Requirements: Submit to the Department of Development Services the type of exterior lighting fixtures to be used and lighting locations prior to the issuance of the Minor Use Permit. Timing: At the time of issuance of the Minor Use Pen -nit. Prior to the issuance of building permits a plan for a permanent solution for drainage shall be submitted to and approved by the Department of. Public Works. The drainage plans shall specify how drainage waters shall be detained on-site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak flow runoff to said channel or facility. The required improvements must be installed and completed prior to final building permit inspection and before conducting the use on-site. Aside from the existing buildings, the applicant states that he intends' to construct only one new structure with the dimension of 24 feet by 24 feet for the purpose of wine tasting and retail sales. If any additional new structures are built or the dimensions of the new structure the applicant intends to build exceeds 24 feet by 24 feet, such shall be to the reasonable satisfaction of the County Fire Marshall. Provide an all-weather access that is at least 10 feet wide with a vertical clearance of 15 feet that will accommodate a 40,000 pound fire apparatus. 18. Although this minor use .permit is consistent with holding special events, an additional minor use permit must be applied for and be granted as set for in Butte County Code sub- section 24-263(F)(2)(d) before any such events may be held on the property. Such'events include, but are not limited to, weddings, assemblies, and craft airs. Even though such events may have been held previously on this property, they can not be held once this minor use permit is granted until the separate minor use permit for special events is granted.
