McELROY Deputy Director June 20, 1985 RE: Special Inspection #18-85 AP #40-20-22 With reference to the above subject and°your request for inspection of the Liston Warehouse Building at 9370 Midway in Durham to determine if the use or occupancy of the building has been changed, the requested inspection was made on June 18, 1985. The inspection revealed the building is used for farm equipment and supplies, which is essentially the same use or occupancy; however, the following items must be done or resolved for safety reasons: (1) The wooden front loading docks and stairs must be reconstructed to meet code requirements. (2) Provide three 30 exit doors (including exterior landing and stairs) in the building. One to be located at the fron.t..entrance area, one at the East side at sliding doors and the other on the South side of the warehouse. (3) The building electrical system should be checked for safety and some C lighting should be provided in the warehouse areas. S -Y- (4) The sliding door on the East side of the building must be provided with a stairway or ramp. (5) The front sliding door on the South side of the building must be provided with a landing. Association shall discharge monitoring and maintenance requirements with appropriately qualified personnel (wastewater treatment certificates or registered sanitarian) by contract or its own employees. k. Association shall provide for short and long-term reliability of treatment systems by: i. including reserve leachfield areas. ii. including easements for sewers. iii. including immediate reserve funds for operations until sufficient income is generated by homeowners. iv. contracting for maintenance and monitoring until its own staff is available and qualified. V. constructing required monitoring wells before discharge begins. J. COMMUNITY SEWER SPECIAL NITRATE AREA ❑ 1. Prior to recordation of the final map, in accordance with the Chico Area Nitrate Compliance Plan, provide for a connection to the public sewer, if practical and feasible. The following is an analysis of that review. Project: Divide the existing 1.96 acres into 4 parcels for light industrial use Location: Durham -Dayton Hwy and Midway, Durham Applicant: Bill Kelso Engineer: Robert Feeney Report of Findings: The parcels are located in an M-1 (light industrial) zone, in the Durham - Dayton Urban Area. There is an existing business on parcel 1; parcel 2 is vacant; parcel 3 has an existing concrete pad, which is to be removed; and parcel 4 currently has part of an existing building and part of 2 silos that also occupy space on an adjacent parcel to the west, APN 040- 200-001. Domestic water is to be provided by Durham Irrigation District and there are no existing wells on the parcels. The grade is mostly flat (0-10% slope) and the soil profiles indicated a depth of soil in excess of 7 feet. No indication of ground water was noted within the soil profile holes such that ground water monitoring will not be required. Soil percolation testing was conducted and found to range from 16-29 mpi, with an average rate of 24 mpi. Per Appendix VII of the Improvement Standards, the required minimum usable area for sewage disposal is 10,000 square feet per parcel. Comments: We have no record of the existing septic systems serving the businesses as described above. To assure that the respective tanks and leach lines are at least 5 feet from the A proposed property lines, they must be located, marked for on site confirmation, and indicated on the map. Additionally, per our records, it appears that the leach line for the mobile home referenced above crosses over the proposed property line into parcel 4. Adjustments to the map or relocation of the system(s) may be necessary. The mobile home to the west of parcel 4 touches the proposed property line, and the silos and a shop building to the west of parcel 4 overlap into parcel 4. These issues will need to be resolved with the Planning Division. It appears that parcel 4 may not be large enough to meet the required usable sewage disposal area, per Appendix VII. Adjusting the proposed property line or combining parcel 4 with parcel 3 may be necessary. Your engineer should address this issue and indicate necessary changes to the map, and state and illustrate on the map where each parcel meets the Appendix VII requirements. Conditions: If you were to submit a map with the above comments resolved, you could expect this Department's support with the following conditions: 1. Place a note on an additional map sheet that states all parcels will be provided water by the Durham Irrigation district. 2. Provide a will serve letter from the Durham Irrigation District that they are willing and able to provide domestic water to all parcels. 3. Place a note on the additional sheet that all parcels will be served by septic systems, under permit issued by BCEH, for the disposal of liquid wastes. This review should not be construed as a blanket approval of your project since participation in the County Parcel Map process may change the project due to other agency requirements. Any claim, which arises out of the transaction vesting in the insured the estate or interest insured by their policy or the transaction creating the interest of the insured lender, by reason of the operation of federal bankruptcy, state insolvency or similar creditors' rights laws. 2. Invalidity or unenforceability of the lien of the insured mortgage, or claim thereof, which arises out of the transaction evidenced by the insured mortgage and is based upon usury or any consumer credit protection or truth in lending law. 6. Any statutory lien for services, labor or materials (or the claim of priority of any statutory lien for services, labor or materials over the lien of the insured mortgage) arising from an improvement or work related to the land which is contracted for and commenced subsequent to Date of Policy and is not financed in whole or in part by proceeds of the indebtedness secured by the insured mortgage which at Date of Policy the insured has advanced or is obligated to advance. 7. Any claim, which arises out of the transaction creating the interest of the mortgagee insured by this policy, by reason of the operation of federal bankruptcy, state insolvency, or similar creditors' rights laws, that is based on: (i) the transaction creating the interest of the insured mortgagee being deemed a fraudulent conveyance or fraudulent transfer; or (ii) the subordination of the interest of the insured mortgagee as a result of the application of the doctrine of equitable subordination; or (iii) the transaction creating the interest of the insured mortgagee being deemed a preferential transfer except where the preferential transfer results from the failure: (a) to timely record the instrument of transfer; or (b) of such recordation to impart notice to a purchaser for value or a judgment or lien creditor. 7. The failure of Your existing structures, or any part of them, to be constructed in accordance with applicable building codes. This Exclusion does not apply to violations of building codes if notice of the violation appears in the Public Records at the Policy Date. 3. The right to take the Land by condemning it, unless: a. a notice of exercising the right appears in the Public Records at the Policy Date; or b. the taking happened before the Policy Date and is binding on You if You bought the Land without Knowing of the taking. 4. (a) Any law, ordinance or governmental regulation (including but not limited to building and zoning laws, ordinances, or regulations) restricting, regulating, prohibiting or relating to (i) the occupancy, use, or enjoyment of the Land; (ii) the character, dimensions or location of any improvement now or hereafter erected on the Land; (iii) a separation in ownership or a change in the dimensions or area of the Land or any parcel of which the Land is or was a part; or (iv) environmental protection, or the effect of any violation of these laws, ordinances or governmental regulations, except to the extent that a notice of the enforcement thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the Land has. been recorded in the Public Records at Date of Policy. This exclusion does not limit the coverage provided under Covered Risks 12, 13, 14 and 16 of this policy. (b) Any governmental police power not excluded by (a) above, except to the extent that a notice of the exercise thereof or a notice of a defect, lien or encumbrance resulting from a violation or alleged violation affecting the land has been recorded in the Public Records at Date of Policy. Unenforceability of the lien of the Insured Mortgage because of the inability or failure of the Insured at Date of Policy, or the inability or failure of any subsequent owner of the indebtedness, to comply with applicable doing business laws of the state in which the Land is situated. 5. Invalidity or unenforceability of the lien of the Insured Mortgage, or claim thereof, which arises out of the transaction evidenced by the Insured Mortgage and is based upon usury, except as provided in Covered Risk 27, or any consumer credit protection or truth in lending law. 6. Real property taxes or assessments of any governmental authority which become a lien on the Land subsequent to Date of Policy. This exclusion does not limit the coverage provided under Covered Risks 7, 8 (e) and 26. 7. Any claim of invalidity, unenforceability or lack of priority of the lien of the Insured Mortgage as to advances or modifications made after the Insured has Knowledge that the vestee shown in Schedule A is no longer the owner of the estate or interest covered by this policy. This exclusion does not limit the coverage provided in Covered Risk 8. 8: Lack of priority of the lien of the Insured Mortgage as to each and every advance made after Date of Policy, and all interest charged thereon, over liens, encumbrances and other matters affecting title, the existence of which are Known to the Insured at: (a) The time of the advance; or (b) The time a modification is made to the terms of the Insured Mortgage which changes the rate of interest charged, if the rate of interest is greater as a result of the modification than it would have been before the modification. This exclusion does not limit the coverage provided in Covered Risk 8. 9. The failure of the residential structure, or any portion thereof to have been constructed before, on or after Date of Policy in accordance with applicable building codes. This exclusion does not apply to violations of building codes if notice of the violation appears in the Public Records at Date of Policy.
