The hearing was opened to the public. Sam Freer stated that he knows lie was wrong, but he can not afford to have the garage monad. Staff stated that this was tagged as a building violation. Mr. Freer stated 'that the garage was 2 1/2 feet back instead of the required 5 feet. The hearing was closed: Commissioner Lynch stated that the Commission has had the policy that they do not grant variances for this purpose, where buildings were done without permits; Commissioner Lambert stated that it would be difficult to make the findings. Commissioner Lynch felt that the Commission's hands were tied,, that they had' to follow the, law. It was moved by COMMissioner Lynch, seconded by Commissioner Walter, and, unanimously carried to deny the project as follows A. Find that the project is categorically exempt from environmental review; and B, Find that it does not comply with Section 24-33 at this time and would not cd�stitute a hardship under Section 24-40.
