Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions
set forth below: Kenneth and Lynda Piercy are hereby granted a Use Permit in accordance with
application filed: Use Permit to allow an indoor dog training facility.
Failure to comply with the conditions specified herein as the basis for approval of application
and issuance of Permit, constitutes cause for the revocation of said permit in accordance with
the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code
Sec. 24-45.65.
2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must
be completed prior to, or concurrently with, the establishment of the granted use. The use
granted by this permit must be 'established within 24 months of the delivery .of the
countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within two years of the
date of receipt of the countersigned permit by the Permittee, the permit shall become null and
void and reapplication and a new permit shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding upon and
be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee.
5. Minor changes may be approved administratively by the Directors of Development Services,
Environmental Health, or Public Works upon receipt of a substantiated written request by
the applicant, or their respective designee, Prior to such approval, verification shall be made
by each Department or Division that the modification is consistent with the application; fees
paid and environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
Conditions of Approval:
1. Dog excrement shall be disposed of in a manner approved by the Butte County Department
of Environmental Health.
2. Boarding of dogs shall not be permitted except those owned by the property owners up to
5 dogs.
3. Classes shall be limited to no more than twenty-five (25) dogs, with no more than two (2)
classes per day.
4. Applicant shall provide at least thirty (30) parking spaces meeting the requirements of
Section 24-240 of the Butte County Code. No parking shall be permitted on Goodspeed
Street.
5. Training of dogs shall be conducted inside an enclosed building and no dogs shall be allowed
to run unleashed outside the building.
6. All outside lighting shall be fully shielded and contained within property boundaries
7. All classes to be held between 9:00 a.m. and 8:00 p.m., Monday through Friday only.
8.. Obtain building permits for the proposed building. The building will not be considered an
agricultural use.
9. Prior to the issuance of building permits obtain encroachment permit for all new or existing
driveway approaches and construct them to County standards, as specified. in County
Improvement Standards.
10. Prior to the issuance of building permits a plan for a permanent solution for drainage shall
be submitted to and approved by the Department of Public Works. The drainage plans shall
specify how drainage waters shall be detained on-site and or conveyed to the nearest natural
or publicly maintained drainage channel or facility, and shall provide that there shall be no
increase in the peak flow runoff to said channel or facility.
11. Meet Butte County Health Department requirements for on-site sewage disposal
12. Obtain County permit for proposed septic system.
13. Comply with Public Health Department requirements for the provision of domestic water to
the public.
14. Applicant must also comply with all other applicable State and local statutes, ordinances and
regulations.
15. Provide an all weather access Wall structures. The access shall have a minimum 10 foot
width and 15 -foot vertical clearance, and be able to accommodate a 40,000 pound fire
apparatus.
I hereby declare under penalty of perjury that I have read the foregoing conditions, that they
are in fact the conditions which were imposed upon the granting of this use permit, and that I agree
to abide fully by said conditions.

Department permits -before starting construction, nor does it waive any other requirements.
