2. Brief.Description: To divide a 7.3 acre agricultural parcel
into two parcels of 1.0 acres and 6.3 acres in size�

to Butte Creek, approximately one mile south of the Dayton -
Durham Highway

Ms. Blair read Analysis and Recommendations. There was no correspondence.
The hearing was opened to the public.
Proponents: Gordon Shields, 9787 Esquon Road, expressed concern that.
his client had not been told of all the ramifications, particularly iees,
in connection with the filing of the required parcel map. He also
,questioned the legality of the wording and intent of the Open Area Agree-
mont and , the -right the County has to make such an imposition of the
parcel split.
Ms. Blair explained that the Commission is not empowered to parcel, 1
property. The Commission agreed that the Open Area Agreement was written
as they had envisioned it would be when the ordinance was being considered.
Mike Wacker, in response to a question from one of the commissioners,
said that a divorce proceeding was in process --thus necessitating the
sogregaiion.
Opponents: No one.
Motion was made by Commissioner Wheeler, seconded by Commissioner Bennett,
to:
A. Find that the provisions of the California Environmental
Quality Act have been complied with, and that the proposed
project will nat have a significant effect on the environ-
mont, and adopt a Negative Declaration; and
B. ApproVe the W1"armit for AP 40-29-41 and AP 49-29 35, for
the segregation of a 1 acre homo8ite from a 7.3 acre
subject to the following conditions and in doing so make the
required findings pursuant to Section 24-47 and Section
24-54 of the Butte County Zoning Ordiy%nco.
