RATIONALE FOR VARIANCE: "Sec. 24-49. Standards and conditions ;or grant of variance.
Variances from the terms of this chapter shall be granted
only whenj because of special circumstances applicable to the
property, including size, shape, topography, location or sur-
roundings, the strict application of this chapter deprives such
property of privileges enj oyed by other property in the vicin-
ity and under identical toninPn classification.01
ADDITIONAL RATIONALE FOR VARIANCE: (1) This parcel is essentially unused ground and
Would make a beautiful homesite without upsetting the residential -agricultural nature
of the area. (2) Although Parcel 40-29-60 is less than 5 acres, Lot 109, from which it
would be toparated, Would remain 5+ acres. (3) Although the area is z6hed A-5, far
fewer than half of the homesites on Sycamore Lane are 5 acres or more (please see
accompanying Assessor's Map). Additionally, some Of the parcels shown on the Absessor's
Map contain more than just one residence (please see Accompanying Assessor's map with
home locations on Sycamore Lane).
.Due to the narrow width of parcel 40-29-60, it is further proposed to make an Easterly
boundary line change from a width of 16.2 ft. to 150 ft. This change would Allow for
a much more uniform sized parcel, while still leaving Lot 109 (Parcels 40-29-47 and
40-29-17) with a total area of 5+ acres. (Please see attached Partel 'I -tap showing

1. Type of Project: To obtain a variance Irom the Minimum parcel
size in an A-5 Agricultural zone, to develop a small liomesite,

two parcels of + 1.4 acres and + Sil acres in size.
3. Location. The proje—ct site is locat"Ed. + 1-5 Miles south of the
Durham-oroville Highway off StanfoFd 'Road, and extends north
and east of the terminus of Sycamore Lane to Butte Creek.
4. Access and Nearest Public Road: Sycamore Lane off Stanford Road.

several if additional variance requests were granted using
the same rationale submitted by the present applicanti

The hearing was opened.
Proponents: Mr. Personett stated that he desired to build a home on
one parcel and sell the other, and that he, would be agreeable to what-
ever would solve his problem.
Opponents: No one. The hearing was closed..
Commissioner Wheeler expressed concern about possible access alongside
the adjaining small parcel -which is, already developed. He thenmade a
motion to:
