INSTRUCTIONS TO ADMINISTRATIVE PERMIT APPLICANTS

Application shall be considered void if not signed by the owner or legal agent.
All items on application shall be filled in as completely as possible. If an item is riot
applicable, please indicate by the term "N/k.
It is important that the applicant supply an accurate description of the location of
the proposed project, including the following:
a. Assessor's parcel number(s) (from the tax, bills or Assessor's maps).

"Application for Administrative Use Permit. The plot plan should be no larger than
11 x 17", be folded to 8 1/2" x 11 ", and shall include.the following �lnfbrmatlon'

the property, including buildings, driveways, parking areas, wells, septic
tanks and leach fields.

5. The "Application for Administrative Permit" is subjent to review by County Staff
and approval by the Planning Director. Any speciai ,onditions of approval shall
be made a part of the approved "Administrative Permit" and shall be binding on
the applicant. The prceedures for County action on Administrative permit
applications are stated 'in Chapter 24 of the Butte County Code.
8. In approving an Administrative Permit, the Planning Director may include such
conditions as are deemed reasonable and necessary under the circumstances to
preserve the integrity and character of the zone and to secure the general
purposes of the Butte County General Plan and Chapter 24, of the Butte County
Code. In general, said conditions will be listed as standards in Chapter 24 for
each, use. In uniquO,situations additional conditions may td,,added, sib long as

�REGULA I 1UNS FOR SENIOR CITIZEN DWELLING UNITS
BUTTIE C011N.TY PLANNING DEPARTMENT
The following conditions shall be applicable to all Senior Citizen Dwelling Units as defined In section 24-202 of the
Butte County Code and located within the Unincorporated area of Butte County. it is the applicants responsibility
to Insure that these conditions have been or can be mot prior to the application for an Administrative Permit. The
applicant shall be responsible for providing, as requested by the County� Information or proof of compliance With
the conditions.
(1) The lot or parcel on which t I he senior citizen dwelling Unit is proposed contains an existing single-family dwelling
unit.
(2) The "living area", meaning the Interior habitable floor space area of a dwelling Unit including basements and
attics, but not including a garage or any accessory structure, shall not exceed 1,200 square feet for a detached
senior citizen dwelling unit. The I'living area" of �n attached dwelling unit shall not exceed 640 square feet or
30% of the existing single-family dwelling unit living area, whichever is greater.
(3) The senior citizen dwelling unit Is Intended for the sole occupancy of one (1) adult 62 years of age or over or
two (2) adult persons, one of whom is 62 years of age or over. An affidavit of compliance with the age
requirements of this section shall be recorded in the office of the Recorder prior to Issuance of building permits.
Said affidavit shall Include the legal description, of the lot or parcel and shall constitute a covenant running with
the land, binding upon the original owners and their heirs, successors and assigns, limiting the occupancy of
the senior citizen dwelling unit to the conditions described In this section,
(4) The senior citizen dwelling unit shall not be sold as a. separate Unit. Unless a parcel containing the unit Is created
In compliance with the existing zoning and subdivision ordinances and the resulting density Is In conformance
with the General Plan. .
(6) Two off-street parking spaces shall be provided for the senior citizen dwelling unit In addition to the parking
spaces required for the primary dwelling unit.
(6) Adequate sewer and Water facilities shall be provided subject to the approval of the Environmental Health
Department,
(7) All site development standards as required by the zoning district In which the Unit is located shall be met,
(8) The Senior Citizen bweillng unit shall be a conventionally constructed building or a Mobile home that complies
with the National Manufactured Housing, Construction and Safety Standards Act of 1974, except that In the 'k,
"FR", and '7M" series of zoi ies a Mobile home, as defined in Section 24-21Mj may be used, Travel trailers and
recreational vehicles shall not be all -)wed as a Senior Citizen Dwelling unit,
(9) The approval of this permit constitutes approval only to the extent. that the project compiles with the Butte
'County Code and all other applicable regulations,
(io) An proposed grading which will create buts of flils in excess of 18" foe roads, driveways, building sites,
dra �nage ways or ditches on parcels shall be shown on the map Included with the application and shall be
reviewed and approved by the Department of Public Works,

This is a request for an Administrative Permit to allow a detached Senior Citizen Dwelling
Unit on a 9.2 acre parcel located at 2372 Blossom Lane, Durham. The parcel is zoned A-
20. The applicant has converted a portion of an existing agricultural building to a 1200
square foot second dwelling init. The remainder of the structure Will be used as an
agricultural storage buiiding, This application is being made to recti I fy a code violation.
The structure meets all setback requirements for the zone. The project appears to meet
all of the conditions required for a Senior Citizen Dwelling Unit as listed in section 24-
202 of the Butte County Code. Approval is recommended subject to the following
conditions'.
