In addition, your plans are routed to other regulatory entities including but not limited to Planning, Public Works, Environmental Health, and the California Department of Forestry for their clearances and approvals. Please be informed, we see the proposed trench system as an, interim measure, and further work will be required to address free product that has migrated off-site. We will require appropriate monitoring wells immediately down -gradient of the trench system to assess the efficiency of free product removal. Operation of this equipment listed on this permit must be conducted in compliance with all data and specifications submitted with the application under which this permit is issued unless otherwise noted below. 3. This Authority to Construct shall be posted in a conspicuous location at the site and shall be presented to District personnel upon request. 4. This Authority to Construct permit shall be valid from the effective date pursuant to condition #11, until a permit to operate for the equipment for which the application was filed is granted or denied or the application is canceled. In the event a permit to operate is not issued within six (6) months from the amended date of this permit, the permit to operate shall be deemed denied. Notwithstanding, upon written request to the APCO, this Authority to Construct permit may be extended by written authorization of the APCO. 5. The Air Pollution Control Officer (APCO) shall be notified twenty-four (24) prior to the commencement of the permitted activity , to allow for an inspection to determine if the equipment has been constructed according to the design specifications submitted and approved by the APCO. Permission to operate will be granted upon demonstration that the system is in operation and in compliance with the Butte County Air- Quality Management District (District) Rules and Regulations, and has been constructed in full compliance with all conditions specified herein and all other applicable requirements. 6. Acceptance of this permit is deemed acceptance of all conditions as set forth herein. Failure to comply with any condition of this permit or the Rules and Regulations of the District or State law is grounds for revocation of this permit. 7. Any violation of any condition of this permit is a violation of District Rules and Regulations and State law. 8. This permit may be amended in writing at any time by the Air Pollution Control Officer (APCO), with or without cause, to insure compliance of this facility, or to mitigate or abate any public nuisance; such amendments may include, but are not limited to, requirements for additional operating conditions, testing, data collection, reporting or other conditions deemed necessary by the APCO to ensure compliance with District Rules and Regulations or State law. This permit is not transferable from one location to another, from one piece of equipment to another, or from one person to another without prior written consent from the APCO. A transfer of ownership shall be granted as authorized pursuant to Condition #12 of this permit. 10. If any provision or condition of this permit is found invalid, such finding shall not affect the validity or enforcement of the remaining provisions. 11. This permit is only effective upon payment of the Authority to Construct assessed in accordance with District Rule 500. Upon issuance of a permit to operate, the person to whom this permit is issued shall be responsible for payment of the annual permit renewal fees. 12. In the event the control of the subject facility is assumed by a new owner or operator, the APCO shall be notified of such transfer by the submittal of a written request for transfer of this permit by the new owner or operator within thirty (30) days of the transfer. 13. The permit holder shall comply with all applicable requirements of the Air Toxics "Hot Spots" Information and Assessment Act of 1987 (AB2588), pursuant to California Health and Safety Code Section 44300 et.seq. 14. The "Right of Entry", as delineated by the California Health & Safety Code Section 41510 of Division 26, shall apply at all times, and during any time when the equipment is in operation, and during reasonable daylight hours when the equipment is not in operation. OPERATIONAL CONDITIONS 15. The facility to which this permit is issued is strictly liable for assuring that the operating staff are advised and familiar with all conditions contained in the permit. 16. Permit requirements apply to the facility owner and/or operator(s) and any contractor or subcontractor performing any activity authorized under this permit. Any person(s), including contractor(s) and/or subcontractor(s), not in compliance with the applicable permit requirements are in violation of State and local laws and subject to appropriate civil and criminal penalties. The facility owner and/or operator, and all contractor(s) or subcontractor(s) are strictly liable for the actions and violations of their employee(s). Any violation committed by a contractor or subcontractor shall be considered a violation by the facility owner and/or operator, and the contractor and/or any subcontractor(s). 17. The physical integrity of all process and air pollution control equipment shall be maintained as necessary to insure compliance with District Regulations and emission limitations set forth in the permit. 18. Modification or alteration of the equipment or operations described in this permit, including a change in the method of operation or a change in location, may occur only when approved in writing by the APCO prior to the implementation of such modification or change. For the purposes of this condition, the term "modification" shall be defined as set forth in District Rule 430. Unless otherwise specified by the APCO in writing, any and all alterations shall require submittal and approval of an Authority to Construct permit application. 19. The APCO shall be notified immediately, and in no event later than two (2) hours from the time of discovery, of any upset or breakdown or malfunction which occurs with the equipment under permit, or emissions exceeding any of the limits established in District Rules and Regulations or the level of emissions for which a permit or variance was granted. Excess emissions shall be reported in accordance with the requirements of District Rule 275 and failure to do so constitutes a willful violation of District Rules. 20. Upon detection, an upset or breakdown condition which causes or may cause a violation of the emissions limitations as set forth in District Rules, or as a condition of this permit, shall be corrected immediately. In the event that corrective action can not remedy the emissions violation, the operation of the subject equipment shall be terminated. 21. The APCO shall be provided, upon request, with any and all emissions related data collected as a result of the permitted activity, including data collected or obtained as required by other regulatory agencies. 22. The facility shall maintain the permitted equipment in compliance with federal and State Occupational Safety and Health Administration requirements so as to insure the health and safety of District representatives performing a site inspection. Annually, within thirty (30) days after the first day of each year, the permit holder shall provide the APCO with any and all production information requested by APCO, and upon request, provide a written summary of any and all equipment malfunctions (upset or breakdown conditions) that may have resulted in an increase in air emissions during the previous calendar year. The annual operating summary shall itemize equipment upset or breakdown conditions by the date, time and duration of the upset or breakdown condition, and shall also include the estimated emission release of primary air pollutants. 24. This permit authorizes the excavation and on-site storage of not more than 100 cubic yards of petroleum affected soil as needed to replace the underground fuel storage tanks. All contaminated soils excavated must be fully covered with plastic or other suitable materials to minimize off -gassing of hydrocarbons. 25. The permit holder shall monitor the excavation process to identify any soils that are potentially contaminated with petroleum products. If contamination is found, the permit holder shall take representative composite soil samples and shall have such samples analyzed by a State -certified laboratory. The laboratory analysis shall be performed for benzene, toluene, ethyl -benzene, xylene and total petroleum hydrocarbons as gasoline and diesel. The APCO shall be provided with laboratory results of composite soil samples representing the level of contamination of the excavated soils within seven (7) days of the commencement of the soil excavation project. 26. The APCO shall be notified within 24 hours of detection of any soil contamination due to a product spill or equipment leak. Soil remediation measures may require an Authority to Construct Permit and a Permit to Operate, as determined by the APCO. 27. Measures shall be utilized to minimize fugitive dust and hydrocarbon emissions, as applicable. Such measures shall include, but not be limited to, the use of dust surfactants for the control of fugitive dust. 28. Fugitive emissions shall be controlled at all times such that a public nuisance is not created. 29. Any eductor used to remove gasoline vapors from the underground storage tanks shall have a minimum discharge point of not less than 12 feet above grade. 30. The Phase II Vapor Recovery System, including all associated underground plumbing, shall be installed, operated, and maintained in accordance with the California Air Resources Board (CARB) Executive Order G -70 -52 -AM. Section 41954(f) of the California Health and Safety Code prohibits the sale, offering of sale, or installation of any vapor control system unless the system has been certified by the state board. 31. The vapor recovery system shall operate in accordance with the manufacturer's specifications and maintained to be leak-fi-ee, vapor tight, and in good working order. 32. Hold -open latches on all gasoline dispensing nozzles shall be maintained in good working order. Operating instructions and CARB's public complaint telephone number (800-952-5588) shall be conspicuously posted. The instructions shall clearly describe how to fuel vehicles correctly. using vapor recovery nozzles. Also, the instructions shall include a warning that topping -off may result in spillage or recirculation of gasoline. 33. The District shall be notified prior to back -filling any underground vapor recovery piping so that an inspection can be conducted to ensure proper configuration pursuant to CARB Executive Orders G -70 -36 -AD. 34. The dispensing rate shall not exceed ten (10.0) gallons per minute (gpm). Compliance with this condition shall be verified with only one nozzle in operation per product supply pump. SOURCE TEST CONDTTIONS 35. The following two (2) source performance tests shall be conducted, and compliance with the applicable procedures demonstrated, prior to facility operation. For the purpose of compliance with this Condition, all tests shall be conducted after back -filling, paving, and installation of all required Phase I and Phase II components. 36. A static pressure decay test shall be conducted prior to facility operation. The static pressure decay test shall be conducted pursuant to CARB procedure TP -201.3 or source test methods approved by the Air Pollution Control Officer. 37. Dynamic Pressure Performance Test, in accordance with CARB procedure TP -201.4 or source test methods approved by the Air Pollution Control Officer. 38. When the equipment has passed the required source tests and final inspection, the District will assess the appropriate fees and, upon payment, a Permit to Operate will be issued. 41. Construction of this equipment and/or conduct of this activity must be conducted in compliance with all other applicable District, State and federal laws, statutes and requirements. Failure to do so constitutes a separate violation of this permit and may result in permit suspension, revocation, civil or criminal prosecution and fines or other assessed penalties. Comply with all other applicable State and local statutes, ordinances and regulations. 1 .114• • •1 F1 9045,e.• u-• The Butte County Air Quality Management District indicates that this site is currently under an order issued by the Regional Water Quality Control Board to clean up subsurface soil and groundwater contamination. Any excavation required to construct the proposed convenience store before this cleanup occurs may expose contaminated soil and groundwater, resulting in off -gassing of petroleum products into the air during construction. These air releases would include toxic pollutants such as benzene, a known carcinogen. The District, therefore, requires that prior to any excavation associated with this Use Permit appropriate air monitoring and emission controls shall be established. Recommended controls include the covering of stockpiled soil, immediate removal of high contaminated soils from the site 'and the use of vapor suppressant surfactant. This shall be accomplished to the satisfaction of the District prior to Use Permit issuance. (Mitigation Measure #1) 4. Measures shall be taken to control fugitive dust emissions from all construction associated with site development. Measures may include site and road watering -and/or use of other acceptable soil palliatives. Questions regarding fugitive dust control may be directed to the Butte County Air Quality Management District at phone number (530) 891-2882. Prior to recordation of building permit issuance, submit an improvement plan with respect to fugitive dust and air pollution to the Butte County Air Quality Management District for review and determination of adequacy. Said plan shall include measures to control fugitive dust emissions from all construction associated with site development. Measures determined to be acceptable by the Air Quality Management District shall be implemented during all development activities on the site. A copy of the approved plan shall be submitted to the Public Works Department prior to site development. The applicant shall ensure that the driveway and any area disturbed as a result of operations is watered or treated with a soil palliative to control fugitive dust. (Mitigation Measure #2) 5 Prior to any site disturbance, construction or building permit issuance associated with this Use Permit, the applicant shall comply with the Central Valley Regional Water Quality Control Board's Clean-up and Abatement Order No. 99-709, including submittal and implementation of the Corrective Action Plan (CAP) to the satisfaction of the RWQCB and shall provide re-evaluation of potential future exposure risks to mini -mart employees to the RWQCB. (Mitigation Measure #4) 6 Prior to any site disturbance, construction or building permit issuance associated with this Use Permit, the applicant shall have prepared a Health and Safety Plan prepared by a certified industrial hygienist. Verification shall be provided to the Butte County Environmental Health Department indicating that construction workers will not be adversely affected by potential health and safety risks posed by petroleum products present in the soil. (Mitigation Measure #5) 7. In order to insure that the mini -mart is supplied with an adequate level of water quality and supply, the proposed mini -mart facility shall connect to a public water supply (Cal -Water). In order to establish that an on-site septic system can be adequately developed for the proposed use the following shall be provided to the satisfaction of the Butte County Environmental Health Department: A. Verify that adequate area is present to install a properly sized and designed sewage disposal system for the proposed mini -mart. B. Meet sewage disposal requirements promulgated by the Nitrate Action Plan Tank Prohibition Order. C. Apply for a County permit to install a sewage disposal system, and if needed an on- site storm drainage permit. (Mitigation Measure #7) 9. Butte County Fire Department/California Department of Forestry indicates that the proposed commercial use must be provided with water supply in sufficient amounts for fire protection. This is to be accomplished by either providing a pressurized community water system, or by submitting information indicating the presence of a fire hydrant within 300 feet of the project, with a 6 -inch coupling and residual fire flow of 2000 gallons per minute. All plans shall be submitted to the Fire Department for review and approval prior to construction of facilities. (Mitigation Measure #8) 10. Storm drainage generated by the mini -mart shall be contained on site via seepage trenches and/or a detention pond to the satisfaction of the Butte County Department of Public Works. Construction of any seepage trenches or detention pond will be coordinated with Central Valley Regional Water Quality Control Board's Clean-up and Abatement Order No. 99-709, and Corrective Action Plan (CAP). All designs and plans shall be approved by the Public Works and Environmental Health Departments. (Mitigation Measure #9) 11. Prior to Building Permit approval, submit design information on the size and location of driveways entering the Midway to the City of Chico, and obtain an encroachment permit from the City of Chico. 12. Prior to Building Permit approval, construct street frontage improvements along the Midway in accordance with standard City of Chico improvement standards. 13. In order to protect development from the effects of expansive soils, all foundations shall be designed by a "registered Civil Engineer or licensed architect, prior to site development.
