The Building Division places its highest priority on processing building permits as quickly as possible and each day that passes without a complete application adds to processing time. A permit may be renewed (for a fee) prior to expiration an indefinite number of times, provided construction progress has been documented by the Building Division during each year during scheduled inspections. EXPIRATION OF PERMIT APPLICATION AND REFUND POLICY Application for which a permit has not been issued will expire one year after date of application. Refunds may only be made upon written request by the person who originally paid the fees. We have determined several options but flood hazard zone regulations do not necessarily follow common sense and I see no way to circumvent these requirements in this instance. FYI - Our flood ordinance and fema regs. apply to all buildings, residential and non-residential. 1. After review of your letter and the plans, the project as a whole is a "substantial improvement" as defined in Butte County Code and FEMA regs. A substantial improvement is required to be elevated. Your only option to try to avoid this is to get a professional appraisal and have the carport and existing utility room appraised as is, and also have the proposed project appraised off the plans. If the difference is less than 50%, it would not be a substantial improvement. Let us know if you are going to pursue this avenue so that we can let you know exactly what the appraisal must show. 2. You could attach the garage or utility/studio with a breezeway roof, and the garage could be considered "attached". You would then be allowed to have a finish floor elevation in the garage only below the BFE and be wet floodproofed, vents no more than 12" above grade, etc. The studio would still be required to be elevated. I can see no other options at this time. The homeowners state that the structure was built at the time that the old garage was converted to a family room. All construction was done under permit (they verified this prior to purchase). In the original submitted plans we proposed to remove the carport, leaving its attached utility building. The homeowner ultimately wished to use this area as an art studio which is how we designated it on the plans. (Subsequently we have determined that we probably will not be able to put in the sink due to the long distance from the septic system). - The carport area would become an enclosed garage. The existing blacktop would be /1 -V 1�7" replaced by a concrete slab. The flat tar & gravel roof would be removed for a new trussed roof with a pitch that is more in keeping with the style of the house and neighborhood. Upon application Nancy Springer explained to us that since the property was in the flood zone (AE) it would require Flood Elevation Certificates. These were obtained by the . Homeowner and added to the application. (They may have been somewhat misleading; however, in the description of the project due to misunderstanding with the engineer.) Since then (early September) the application has been stalled due to insistence by the DDS than the structure must be elevated three feet to comply with Butte County's Flood Ordinance (Section 26). This is a completely impractical solution for many reasons. The Homeowners are justifyingly upset that they appear to be the only people in their neighborhood who are not allowed to have an enclosed garage. Many of the neighbors' structures are at street level or grade and not elevated into the air in some manner. Our reading of the FEMA regulations (Technical Bulletin 1-93) is that parking and storage structures are an allowed use below the BFE as long as they are designed using FEMA's "wet floodproofing" techniques and the proper materials. In this case that would mean installing the required venting and using pressure -treated framing and siding materials (this would be an extra cost to the Homeowners, but not an onerous one). Further, since we were remodelling an existing parking area attached to an existing, permitted structure, it seemed that "flow-through" techniques were the solution. We were preparing new drawings reflecting this for resubmission when the County's engineer returned from vacation & informed us that Butte County would only allow the elevation or "dry floodproofing." Once again, our reading of the Butte County ordinance says the exact opposite. The Ordinance refers only to "residential' structures, and this is not residential. This would be "Group S" or "Group U" under IBC definitions. Granted that the regulations are complex and require parsing of sentence structure to understand intent, but I still think that somehow there must be a simple solution for this relatively simple project.
