STATEMENT OF HARDSHIP
1 am requesting this Condominium Subdivision be approved
on a financia", hardship basis. This duplex'wa;o acquired
by exchanging our small, farm in Corning when we were
forced to move to Chico because of our daughter's health.
She has serious respiratory difficulties and we were
advised to move her nearby a major medical facility as
soon as Possibleo Therefore, we mored and traded the
ranch for the duplex.
The duplex does not

it a good investment for a family in our situation.. We
are starting a new career and have large debts to pay with
the proceeds from the sale of this property, jt, is for

common area would then be accomplished by the recordation
')f the condominium plan which would be attached to the Declaration
of trherevisanossidenl.otiset--backsproblemns. Ift create this fashion,
d. This method
of establishing the condominium is in accordance with the
provisions of the subdivision Map Act (Gove;rnment Code §66427)
Which provides that the map of a condominium project need not
show the manner in which the buildings or the airspace are
to be divided, l have reviewed the Butte County Subdivision
ordinance and find nothing in it dealing specitically with.
condominiums. Therefore, it seems clear that the one lot
subdivision approach is permissible under the law;
The proposed change is one only of the ownership of the buildings:
There will be no additional construction. Civil Code Section 1:370
provides that local zoning ordinances shall be construed to
treat like structures in like manner regardless of whether the
ownership is divided by sale of condominiums rather than by lease
of apartments. 'Thus; obviously there are no problems with the
zoning of the property which would prohibit the conversion of
the ownership to condominium ownership,
I would aPPrceiIte your reviewing this letter with the Planning
Department and, if you are convinced of the logic of this position,
informing them that they should proceed with the .Application for
a one lot Subdivision in an expeditious fashion: I would assume
that a negative Declaration would be forthcoming as to environmental
significance since the only effect of the p opo'sed thane would

Recently the question has arisen whether or not Mr. Granville
Knox''s cluelexes can be converted into condominiums even though the
zoning was not a PA -C zone, The buildings to lie converted meet
the set -back requirements of the present zoning In reviewing this
problem-, §1370 of the civil Code indicates that unless a contrary
intent clearly expressed, condominiums are to be treated no
differently 'than other like structures. That would mean that if the
zoning allowed for multiple dwelling units, these could be converted
to condominiums without violating any zoning requirements.
In view of this, Mr, Knox's proposal to convert the duplexes
into condominiums would not impose any problems in regards to tlae
present zoning in the area since the buildings as presently situated
meet all, of the sot -back requiremenst of the zoning; "
