Classification of the building is the critical first step in the effective use of the Uniform Building Code. To an even greater degree, the proper determination of occupancy and type of construction is the basis for all other code determinations. Provide a complete code analysis for the entire building and include the mixed occupancy ratio. This analysis must include the exit access, the exit, and the exit discharge. 2. Indicate the location and types of occupancy separations on the building plans. 3. Occupant loads shall be determined in accordance with the requirements of Uniform Building Code Chapter 10. In determining the occupant load, all portions of a building shall be presumed to occupied at the same time (Uniform Building Code section 1003.2.2.2.1). 4. Minimum Plumbing Facilities: The total occupant load shall be determined by minimum exiting requirements. The minimum number of fixtures shall be calculated at fifty (50) percent male and fifty (50) percent female based on the total occupant load (Uniform Plumbing Code Table 4-1). 5. Full access to the disabled must be provided for the specific area of remodel, repair or addition. Additionally, 20% of the cost of the project must be invested in access features for the existing area of the building. Provide verification of how this will be accomplished. 6. The number of parking spaces will be determined by the Butte County Planning Division and the number of disabled parking spaces are based upon the amount of parking spaces. Disabled parking spaces must be located at the main'entrance. Obtain Butte County Planning Division approval for use and parking requirements. 1 of 2 w 7. Acutely hazardous materials registration form: filing; contents: amendments; submis- sion of certified risk management and prevention program; implementation (a) On or before September 1, 1987, the Office of Emergency Services shall develop an acutely hazardous materials registration form to be completed by the owner or operator of each business in the state which, at any time, handles any acutely hazardous material. Except as provided in Section 25536, on or before January 1, 1988, any business which handles acutely hazardous materials in the amounts specified in busdivision (a) of Section 25536 shall file the registration form with the administering agency. The Office of Emergency Services may adopt appropriate regulations to implement the requirements of this section. (b) The acutely hazardous materials registration form shall include, but is not limited to, all of the following information: (1) The information included in the business plan prepared pursuant to Section 25504. (2) A general description of the processes and principal equipment involved in the handling of the acutely hazardous materials. (c) Within 30 days of any one of the following events, any business subject to this section shall submit to the administering agency an amendment to the registration form: (1) Any handling of an acutely hazardous material which was not mentioned on the registration form. (2) Any material or substantial alterations or additions to the business or activity which require changes in the risk management program that are different from, or absent in, the present program. (3) Change of business address. ) (4) Change of business ownership. (5) Change of business name. (d) Any business which submits a certified risk management and prevention program pursuant to Section 25534 shall implement the approved risk management and prevention program. (b) In addition to any requirements imposed pursuant to subdivision (a), an owner or operator of a new or modified facility which will be used for the handling of acutely hazardous materials and which will commence operations on or after January 1. 1988, in the case of a new facility, or commence the operations which will be modified on or atter January 1. 1988, in the case of an existing facility, shall prepare an RMPP. (c) The RMPP shall include all of the following elements: (1) A description of each accident involving acutely hazardous materials which has occurred at the business or facility within three years from the date of the request made pursuant to subdivision (a), together with a description of the underlying causes of the accident and the measures taken, if any, to avoid a recurrence of a similar accident. (2) A report specifying the nature, age, and condition of the equipment used to handle acutely hazardous materials at the business or facility and any schedules for testing and maintenance. (3) Design, operating, and maintenance controls which minimize the risk of an accident involving acutely hazardous materials. (4) Detection, monitoring, or automatic control systems to minimize potential acutely hazardous materials accident risks. (5) A schedule for implementing additional steps to be taken by the business, in response to the findings of the assessment performed pursuant to subdivision (d), to reduce the risk of an accident involving acutely hazardous materials. These actions may include any of the following: (A) Installation of alarm, detection, monitoring, or automatic control devices. (B) Equipment modifications, repairs, or additions. (C) Changes in the operations, procedures, maintenance schedules, or facility design. (6) Auditing and inspection programs designed to allow the handler to confirm that the RMPP is effectively carried out. (7) Recordkeeping procedures for the RMPP. (d) The RMPP shall be based upon an assessment of the processes, operations, and procedures of the business, and shall consider all of the following: (1) The results of a hazard and operability study which identifies the hazards associated with the ",handling of an acutely hazardous material due to operating error, equipment failure, and external events, which may present an acutely hazardous materials accident risk. (2) For the hazards identified in the hazard and operability studies, an offsite consequence analysis which, for the most likely hazards, assumes pessimistic air dispersion and other adverse environmen. tal conditions. (e) The business shall submit to the administering agency any additional supporting technical information deemed necessary by the administering agency to clarify information submitted pursu- ant to subdivision (c). (f) A handler siall maintain all records concerning an RMPP for a period of at least five years. (g) The R11PP shall identify, by title, al! personnel at the business who are responsible for carrying out the specific elements of the Rh1PP, and their respective responsibilities• and the RMPP shall include a detailed training program to ensure that those persons are able to implement the RMPP. (h) The handler shall review the RNIPP, and shall make necessary revisions to the RMPP at least every three years, but, in any event, within 60 days following a modification which would materially affect the handling of an acutely hazardous material. (i) Any person who handles acutely hazardous materials and who owns or operates two or more business facilities which are substantially identical may prepare a single generic RMPP applicable to all those facilities if the handling of the acutely hazardous materials is substantias l�imilar at all of those facilities. 0) The RMPP. and any revisions required by subdivision (h), shall be certified as complete by a qualified person and the facility operator. (k) Except as specified in subdivision (d) of Section 25535• the handler shall implement all activities and programs specified in the RMPP within one year following the certification made pursuant to subdivision (j). Implementation of the RMPP shall include carrying out all operating, maintenance, monitoring, inventory control, equipment inspection, auditing, re.cordkeeping, and training programs as required by the RMPP.. The administering agency may grant an extension of this deadline upon a showing of good cause. (l ) The Office of Emergency Services shall adopt, and publish for distribution, guidelines for the preparation and submission of an RMPP. In preparing the guidelines for hazard and operability studies, the office shall• at a minimum, base its procedural recommendations on those set forth in the 1985 Guidelines for Chemical Hazard Evaluation Procedures, prepared by the Center for Chemical Process Safety of the American Institute of Chemical Engineers. R -- �� REALTY CIDJAPA L Y realtors January 24, 1990 Department of Public Works Building Inspection Division 7 County Center Drive Oroville, California 95965 Re: Proposed remodel, 701 Entler Ave., Chico, A.P.#40-40-17 Gentlemen: Under the terms of a lease agreement between ourselves as Lessor and Terminix International, L.P. as Lessee, Terminix is allowed to make alterations to the premises provided certain conditions are complied with. One of the conditions is that they obtain a building permit for the work, and that the plans be submitted for our approval. Work on the remodelling was earlier commenced by Terminix's own employees without a permit and without our approval. We informed Terminix that we expected them to comply with the terms of the lease, and we are now informed that they have engaged the services of Larbro Construction Co, to do the work. We will authorize Larbro to make application for the building permit with the understanding that all work to be performed will comply with all applicable statutes, ordinances, rules, regulations and orders of any and all governmental agencies regulating such work. One item of work performed by Terminix was the installation of a concrete curb in what they call the."poison room" on the south side of the building. A concrete curb was installed to act as a containment curb in the event spillage of any of the toxic materials stored in the room ocurred. This curb was placed directly against the existing wallboard on three sides and against the stucco on what was originally the exterior wall of the building before the "poison room" was appended. Mr. Bronson of Larbro has written a letter dated January 18, 1990 addressed "To whom it may concern" expressing the opinion that "the curb is a good piece of work". We are not qualified to.make a judgment as to the integrity of the curb as a means of containment for toxic materials. The writer is, however, qualified (B-1 License # 191911) to express his opinion with respect to the wisdom of placing concrete directly against gypsum wall board or stucco to an elevation higher than the bottom of the existing sill and bottom of the studs, all of which are of untreated lumber. 660 MANZANITA COURT, SUITE 3 . It appears to us that if such a condition existed in a building for which Terminix was asked to provide a structural pest control report, it would be listed in the report as an unsatisfactory grade condition. We ask that you inspect the condition with respect to this curb, and if it complies with all provisions of the Uniform Building Code and any other applicable law, that you so note on the final, approved plan.
