AS THE BUTTE COUNTY ZONING ENABLING ORDINANCE
W116-1. VARIANCESfrom the term's of the zoning ordinance
shall be granted only when, because of special. circumstances
applicable to the property, including size, shape, topography,
location or surroundings, the strict application of the zoning
ordinance deprives such property of privileges enjoyed by other
property in, the vicinity and under identical zoning classification.
Any variance- granted shall be subject to sash conditioxis
as will assure that the adjustment thereby authora,zed shall not
constitute a grant of special privileges inconsistent with the

that this highly developed property with a laboratory building, school
and swimming pool, dial not, lend itself to division in any other manner
than was proposed.
In answer to a question fj,.,om Counsel, Mrs, Mann said that tho proposal
under consideration would result in the creation of 5 parcels.
Counsel Blackstock said 1;hat the Comanission could not legally grant
this variance and added th�%;-,c perhaps the best a

the applicant to convince the Board that this property shouldbnot be
zoned TM -5
It was suggested that another solution would be to redesign the pro-
posed split --noting that there are some 33,.15 acres in the parcel.
Counsel explained that any request for ret;orn of fees would have to
go to the Board.
Commissioner Watters, oat ad l se of cowxselo and being Unable to make
proper f7indings to approve, made a motion for denial' of this variance
request. His motion was Seconded by Commissioner Smith.
