First off, the pool cost was $ 28,120.00, including $ 400.00 for a SAM light, and $ 600.00 for an additional 120 sq. ft. of decking. On July 16, 2004 I made a progress payment of $ 16,512.00 by check # 1068. On August 12, I made a 2nd progress payment of $ 8,256.00 this left a balance due of $ 3,352.00. Please adjust your accounts and verify in writing this account balance. No payment until this is acknowledged The next matter involves the permit requirement of putting in a dry hydrant for use in the event of a fire. You will recall that I was quite upset that you did not disclose this requirement prior to your asking me to sign a contract for the pool on. July 12, 2004. Please recall that the pool excavation was more than half completed before you presented the contract for my signature. Also, recall that you had been issued the permit on May 27, 2004. In other words you had the permit for a little over 6 weeks before you chose to disclose to me the requirement. As soon as possible after my meeting with you on - September -77°d_, T conta^-ted both the Building department and the Fire Captain, Darren Read. A copy of my email to Captain Read and his reply directly to Michael Vierra of the Planning Department is enclosed. Please follow up and get something in writing from the Planning Department indicating the waiver of the hydrant requirement. As soon as I receive both of these things from you, I will put together an agreement for your signature and mine concerning the color correction we discussed. Your complete and clear response will expedite the re -check and approval of this project. NON-STRUCTURAL COMMENTS: 1. Per your Parcel Map, and due to expansive soil, please provide a soils analysis and an engineered foundation design for the building. Please have your architect provide a letter stating that he has analyzed and addressed the soil conditions on the site. 2. Your house must be elevated 1.9 feet above the lowest adjacent grade. Your plans do not indicate how this will be accomplished. Your plans show a slab -on -grade. Please provide plans that show how the house will be elevated, flow-through vents in the garage, pressure -treated lumber below flood elevation, etc. The plans must depict the actual construction. OR, if you are building on a compacted elevated pad, please provide a compaction report for the pad. S-TRUCTURAL COMMENTS: UProvide adequate header over the 8' living room window. The 4x10 typical header appears to be over spanned for this opening. This verification must be compkterd -and returned to our office before we are permitted to issue the permit OVER OWNER BUILDER INFOPUNIATION Dear Property Owr:er' An application for a building permit has been submitted in your name listing yourself as the builder of property improvements specified. For your protection, you should be aware that as "owner -builder" you are the responsible parry of record on such a permit. Building permits are not required to be signed by property owners unless they are personally performing their own work. If your work is being performed by someone other than yourself, you may protect yourself from possible liability if that person applies for the proper permit in his or her name. Contractors are required by law to be licensed and bonded by the State of California and to have a business license from the city or county. They are also required by law to put their license number on all permits for which they apply. If you plan to do your own work, with the exception of various trades that you pian to subcontract, you should be aware of the following information for your benefit and protection: ' ♦ If you employ or otherwise engage any persons other than your immediate family. and the work (including materials and other costs) is 5300 or more for the entire project, and such persons are not licensed as contractors or subcontractors. then you may be an employer. ♦ If you are an employer, you must register with the State and Federal Governments as an employer and you are subject to several obligations including'state and federal income tax withholding, federal social security taxes, workers compensation insurance, disability insurance costs, and unemployment compensation contributions. ♦ There may be financial risks for you if you do not carry out these obligations, and these risks are especially serious with respect to worker's compensation insurance. ♦ For more specific information about your obligations under Federal Law, contract the Internal Revenue Service (and, if you wish, the U.S. Small Business Administration). For more specific information about your obligations under Scale Law, contact the Department of Benefit Payments and the Division of Industrial Accidents. If the strucn:re is intended for sale, property owners who are not licensed contractors are allowed to perform their work personally or through their own employees, without a licensed contractor or subcontractor, only under limited conditions. A frequent practice of unlicensedpersons professing to be contractors is to secure an "owner builder" building permit, erroneously implying that the property owner is providing his or her own labor and material personally. Building permits are not required to be signed by property owners unless they are performing their own work personally. Information about licensed contractors may be obtained by contracting the Contractors State License Board in your community or at 1030 N Street, Sacramento, CA. 95814. Please complete the "Owner Builder Verification" on the reverse side of this form so that we can confirm that you are aware of these matters. The building permit will not be issued until the verification is returned. I rely, 1 ' Mic el C.
