This is a proposal to divide 320 acres to create four parcels,
99 + ages, 75 + acres, 74 + acres and 72 + acres. The present
zoning is �l-2 (General). TFi.e Land Use Map of the Butte County
General Plan designates this area as Agricultural -residential
and Timber Mountain and the Safety Element indicates that this
project is in a high to rxtrrme fire hazard area. There are
no specific or community plans Cor the area.
The proposal does not conflict with County zoning nor any
adopted or proposed element of the Butte County General Plan
nor any County, specific or community plan.
The project is within the tivintor deer herd area and portions
of Lots 3 and 4 are within a Bald Nagle habitat area.

In addition to those comments and mitigating measures stated in
'my letter to your office dated. Aug. 30, 1983, 1 hereby slibmitt.
the following comments concerning possible adverse impacts on
the Bucks Mt. Deer herd and habitat of the Bald Eagl(.
Comments by the Dept. of Fish and Game concerning residential
encroachment into the eastern Butte County foot'iills have
consistently reflected a concern for creation of parcels of 40
acres or less. In some specially sensitive areas, parcels of
80 arses or less cause concern. The smallest proposed parcel
on this Tentative Parcel Map is 72 acres. Due to the steepness
of the terrain, human use of this land is going to be limited
to areas along the road which services the building sites. While
there will be some impact, said impact will be minimal.
After consulting the map on file in the Butte County Planning
Dept., which shows the estimated range of the Bald Eagle around
Lake Oroville,, I find that only one proposed parcelhas an area
within the designated habitat area. This parcel is the most
westerly ;parcel and is designated Parcel 4. This parcel contains
+-72 acres. The westerly boundary of this parcel appears to run
contiguous with said designated area boundary for part of the
westerly line and does encroach slightly into the habitat at the
northwest corner and at the southwest coiner. This encroa-.hment
is about 400 feet. The area encroached upon is in extremely rough
terrain and human activity in this area is not anticipated. The
lands lying between the lake and the west boundary of this project
are owned by the U.S. Government and the State of California.
This in effect places a non -development corridor ranging in width
from about 1800 feet to 3200 feet between this project and the
proposed project,

In response to your Letter dtd. August 15, 1983, 1 hereby suggest
the following measures to mitigate any potential adverse impacts
to the environment.
Section Iv.,l.,g.: standard orrosi.on control measures during
and atter construction will reduce or eliminate downstream
.—rsedimeepjtation. Said control including but not limited to proper
grading of all road -s, ditches and building pads, limiting
construction to the dry season, rovegetation of disturbed suit
areas, etc.
Section Iv.,,l,,h.: onsite inspection of .this propertysnows that
it is not of the type normally susceptible of mudslides,
landslides, or ground failuvo. A maaor portion of the foothill
area lies within a zoite crossed by earthoueke faults. Standard
building permit requirements limit~ the human exposure risk with
relation to falling structures: No mitigatincl measure Ls suag;asted
for this item.
Section IV.,5,a:1b.,c.i The proposed parcels are very large. Steep
terrain will limit human activity to a very small portion of each
of the four proposed parrela. Vhile there will certainly be new
species i.nt-oduced to the area, i.e:, dock, cats, and even roan,
potential impact will be minimal. No mitigating measure, are
recommended for these items.
Section 1V ,9:,a:,ka,.: The depletion of natural resource or
non-renewable natural resources will be minimal or non-existant.
No consumption of onsite resources is anticipated othor than the

use of ground for roads and homesites. This ground is very poor
and produces oak trees, brush and grasses.. No harvestable timber
stand exists. No mitigating measures are recommended.
Sectio IV -,13.,a.: Additional vehicle movement will be, created
by this division. However, due to the distance .from local major
shopping areas, I feel that this impact will be minimal. No
mitigating measures are recommended.
Section IV.,18i: Some of this property can be seen from Lake
Oroville. However, the major poxtion that is seen from the lake
is located on the steep sidehill areas and not on the flats on
top of the ridges. It is anticipated that residential development
will take advantage of these building sites as they are the only
areas which will provide for septic disposal.. Some roof line
exposure to the scenic view is anticipated, but at a distance
of a half male or greater and at a steep angle, you would have
to look hard to see them. Earth 'tone colors usually used in rural
construction will also limit visibility of structures. No
mitigating Yr.easures are recommended.
Section IV. ,20.,a: There are no known archaeological sites on
this property. Due to the low density of anticipated development
and the type of dry, steep terrain not favored ,by native Indians,
I feel that the possibility of disturbance of such a sitewould
be very remote. I recommended a mitigating measure for this
section to read "It, at the time of development, an archaeological
significant site is discovered, a qualified archaeoligist shall
be retained to do a survey. If, in his opinion, the site should
be preserved, the owner shall grant an Archaeological Easement
for the preservation of said site or have said site excavated

Environmental Settin
This is a tentative parcel map to divide 320 acres into four parcels,
99, 75, 74 and 72 acres each, located 2000 feet Qwest of Encina Grande
Road, approximately 4000 feet south of Bloomer Hill Road in the Berry
Creek area, T24N, R4E, Section 25. The proposed density of the
development is one dwelling unit p.er parcel.. The nearest public road
is Encina Grande. The method of sewage disposal is septic. The
method of water supply is wells. Power lines will, have to be extended
approximately I mile to parcels. The potential for further land
divisions and development is great. Bloomer Mountain Investments,
Assessor's Parcel number 41-05-89, which is 103.7 acres, borders
the project's southern boundary, 'The project is Assessor's Parcel
number 41-05-37:
Phvsical Environment
The general topographic character is rolling terrain with the Bloomer
Ravine towards the east. Slopes range from 1.0-30%, Elevation is
1600-2200 feet. The limiting factors are the slopes r'' equal to or
greater than 30% "„^

The nearest County fire station is # 62 and #61. The project is
located in the Pioneer. School District.

and changes in absorption rates and surface runoff. The project
does include very large acreage. The size of the parcels will
mitigata any possible impacts on runoff and soil disruption.

development in the areas could impact on thOge animals by changing the
numbers in the area, their chances at mating and suitable habitat
sites, Both the Bald Bagle and Bucks Mountain deer cannot coexist'
with re-5WOn-ti�11 uses, so any development will physically Limit
their foraging range and will serve to further constrict these
animals into dwindling wilderness areas, The protection o_f these
animals and their habitat sites are of the highost priority to :Butte
County,

the rate and use of natural resources because of the distance to
employment centers and commercial services.

day.. Floor er Hill Road will take the bulk of this traffic heading
south to 't,ie Oroville urban area and onto Highway 162.

school district is'ri.oneer Union. Development in this area
Evill create a demand on public and governmental services increasing
the deed for police protection, road maintenance and other govern-
mental services.

distance of over 1 mile to the project site, Water will be provided
by individual. wells. Septir: tanks and leach lines will have to be
installed on each parcel.. Storm wator drainage will be provided for
on-site through the Bloomer Ravine and the natural drainage tray on
parcel 4.
18: The proposod project will be very visible .from Lake Oroville
recreation areas, particularly for persons in boats in the north-
northeast portion of the lake;
Tile most important impact as.oclated with this development are the
exposure of people and property to geologic hazal°ds including ea.rth--
nuakes, landslides and fire hazard and the significant negative
impact on BaldEagles and Buci:s Mountain Dcar Mgbitat areas. The
Bald Eagle bibit•at is primarily on. parcels 3 and 4. If the parcel
map were redesigned to concentrate proposed development towards
the vicilrity of Bloomer Mountain Road, tele impacts would be sub-
stantially reduced on the wildllif.c. Redesigning the parcel map
would help to maintain a wilderness -like sctti.ng towards the western
portion of t;lie site in order to al -.ow for fol{agi lg and 1tt►t'ing oi`
the Bald Nagle.
