File # L03-4 Project Review RE: Ballou Equestrian Facility/ APNs: 041-130-016, 042-130-017, 041-130-065, 041-190-039 T21N, R3E, Sections 31, 32, 33 USGS Hamlin Canyon 7.5' and Oroville 15' quads Approximately 1600 acres (Butte County) Dear Mr. Sanders, Inresponse to.your request,--a-'project review for the above-cited project was conducted by examining.the official maps and records fofarchaeological sites in Butte County. RESULTS: Prehistoric Resources: According to our records, there are no previously recorded sites of this type known to be located within the project area. However, there are nine sites of this type within the project vicinity, consisting of bedrock mortars and rock shelters. TIurteen isolate pieces of lithic debris, projectile points, and metate lfragments were also located in the project vicinity. The project is located in a region that was heavily utilized by Konkow Maidu populations for food gathering/processing and for habitation locales. There may be unrecorded cultural resources of this type located within the project area. Historic Resources: According to our records, there are no previously recorded sites of this type known to be located within the project area. Sites in the project vicinity include a portion of the Old-Chico-Oroville Highway, two'rock-stacks, the remains of a concrete and steel bridge, two well shafts; and the remains of an old fenceline. The USGS Oroville 15' (1942) map indicates that the Sacramento Valley, transmission lines, Little Dry Creek, Clear Creek, Fallager Creek, and the Esquon Land Grant are within the project area, while Beauty Peak, Butte Community College, Durham-Pentz Road, 0 • Clark Road, and State Highway 99 are located in the project vicinity. The Esquon Land Grant, commonly known as Rancho Esquon, was granted to Samuel Neal and John A. Sutter in 1844. Raising the first beef cattle in the region on the 22,193 acre ranch, Neal established his homestead seven miles south of Chico on Butte Creek. Neal also forged the first road to Paradise, Neal Road, which was the main road until the construction of the Skyway. Previous Archaeological Investigations: According to our records, a small portion of the project area has been previously surveyed for cultural resources by a professional archaeologist. The report is listed below. Offerman, Janice K. and Robert I.Orlins 1980. An Archaeological Survey of the Cottonwood-Elverta #3 Transmission Line in Shasta, Tehama, and Butte Counties, California (I.C. File # 407). No sites were located in the project area as a result of this report. Literature Search: Reviewed were the official records and maps for archaeological sites and surveys in Butte County. Also reviewed were the National Register of Historic Places - Listed properties and Determined Eligible Properties (1988, Computer Listings 1966 through 7-00 by National Park Service), the California Register of Historical Resources (2002), the California Points of Historical Interest (1992), the California Historical Landmarks (1996), the Gold Districts of California (1970), the Historic Spots in California (1966), the Handbook of North American Indians, Volume 8, California (1978), and the Directory of Properties in the Historic Property Data File for Butte County (2002). RECOMMENDATIONS: Based upon the above information and the local topography, it appears that the project is located in an area considered to be highly sensitive for prehistoric, protohistoric, and historic cultural resources. Therefore, we recommend that a professional archaeologist be contacted to conduct a cultural resources survey. The project archaeologist will be able to offer recommendations for protection or mitigation of any new cultural resources that may be encountered as a result of the cultural resource survey. The project archaeologist. should also contact the appropriate local Native American representatives for information regarding traditional cultural properties that'may be located within project boundaries for which we have no records. From the description of your project provided, since you apparently are not intending to have any permanent fixed structures as part of the project, your requirements would appear to be fairly minimal. Portable toilets could be used for sewage disposal. The number required would be determined on a number of participants per event basis. Potable drinking water can be provided by bottled water. Individual properly licensed food vendor units can provide all your food. Solid waste removal has been adequately provided for in your plan, as has ambulance service. Given the number of horses anticipated at some events the removal and control.of horse manure may be an additional unaddressed concern. It appears that permanent facilities may be anticipated in the future. If this is the case you are advised that you should plan now to meet the requirements for both a regulated on- site potable water supply and approved sewage disposal system as part of the requirements with permanent facilities. I do not plan to build the entire facility at the outset but envision it evolving over a number of years, perhaps even 10 years or more. Initially I want to be able to have a limited number of riding events and horse shows on the property each year. Typically, these events are two or three days in duration with participants arriving either Thursday or Friday evening and leaving Sunday afternoon. During the first year or two the arena events will most likely be held in an outdoor arena until I can gauge the demand for constructing a covered arena as called for in my application. Much of the riding competitions will be held on outdoor courses that will be set up with non -fixed jumping features at' the outset. These courses can be a mile or more in length. Course preparation is as simple as pulling a disc and then a grader behind a tractor to form an approximate 8 - foot wide trail. The initial structures on the property will be a hay barn and equipment shed which I intend to use for the agricultural purpose of raising hay on site. I understand that I do not need a Use Permit to construct these structures or raise and sell hay. The horse barn would probably be the next structure. It would be developed to board up to 50 horses. Again, demand will play an integral part of when this is constructed. It would be my intent, at least initially, to have riding events on the property with minimal improvements. I have been to numerous events across the state and all are conducted using temporary facilities (sometimes even when permanent facilities are available). A large riding event could attract up to 300 people which would include participants and spectators. An outdoor arena would be used with some standard bleachers. Bottled drinking water, refreshments and food would be sold by licensed mobile food wagons and vendors that would be there just for the event. Sanitary facilities would be provided with porta-potties. Water for dust control, animals and fire suppression would be provided by a many rental water trucks as the County deems necessary. We will contract with an ambulance service to be on site during each days events in case of a medical emergency. Overnight camping would be a part of these events. Almost all participants have some type of recreational vehicle though some do bring tents. A formal campground will not be constructed. Gravel roads would be developed to access the camping area and porta- potties would be located in and around the camping site. We will have a crew to pick up any stray trash and clean up the site after each event. With over 1,600 acres to work with the impact of these events will be minimal. When either the covered area or the horse barn is constructed, whichever comes first, a pressurized water system with a hydrant or hydrants will be installed that meets County standards. A graveled parking lot will be utilized for event parking. Power will initially be provided by an on-site generator but will evolve into a tie to the local power grid. I would also like to have a number of mountain bike riding events each year. These events usually generate about 100 participants and spectators. And would either be a single day event or a two day event. Single -day events would obviously not involve overnight camping. All necessary facilities will We provided commensurate with the size of the event. All events require a pre -registration so we will be able to properly plan for the necessary facilities. Anticipated traffic for the events would be approximately 150 vehicles with trailers for riding events and 60 vehicles for bicycle events. These vehicles would arrive over a time period of 2 to 6 hours and would not result in a high concentration of vehicles on the adjoining roadways. For this Use Permit I am asking that a combination of up to 12 equestrian and bicycle events be allowed each calendar year. At this time I can't provide and an exact mix of how many of each event will occur. No residence is planned at this time but one will eventually be placed on the site. I understand that a residence is� an,allowed use and does not require Use Permit approval. The home will most likely be to cated,southerly of the proposed arena location but may be located in a different area depending -upon the suitability of the soil for septic/leachfield use. UP 01-08 PERMIT NO. APN 041-110-072 ASSESSOR'S PARCEL NO. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below: Norman Witt is hereby granted a Use Permit to allow a horse boarding facility for approximately 60 horses. The facility will also provide arena riding, trail riding, competitive events, performance riding, training clinics, and private lessons. Hours of operation will be 8:00 a.m. to 9:00 p.m. Monday through Friday, and 8:00 a.m. to 6:00 p.m. Saturday and Sunday. The horses will be kept in three 14,400 square foot horse stables. The project also includes a 25,000 square foot covered riding arena with bleachers for 50 people, a 45,000 square foot lighted outdoor riding arena with bleachers for 100 people, two 50 foot diameter riding pens, 40 paved parking spaces and a gravel overflow parking area, an office, caretakers residence, and hay/equipment storage building. Sewage disposal will be handled by port -a -potties. Water will be obtained from an on-site well. Access to the site will be from Messilla Valley Road on an existing driveway in accordance with application filed October 10, 2000. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit, constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this use permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within 24 months of the delivery of the countersigned permit to the Permittee. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee, prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a use permit has been granted is not established within two years of the date of receipt of the countersigned permit by the Permittee, the permit shall become null and void and reapplication and a new permit shall be required to establish the use. 5. The terms and conditions of this permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. Conditions of Approval: 1. Horse trailers belonging to people boarding their horses on the site may be kept on the site. All horse trailers belonging to boarders shall be kept in the area between the designated parking area and Messilla Valley Road. Prior to issuance of the Use Permit, vegetation shall be planted along the fence on Messilla Valley Road to help shield the horse trailers stored on the site from public view. Prior to issuance of the Use Permit, a landscaping plan showing the types and location of the vegetation to be planted and method of irrigation shall be submitted for review and approval by the Planning Division. The vegetation shall be maintained in a healthy condition and replaced as necessary. Additional vegetation shall be installed by the equestrian facility operator at the discretion of the Director of Development Services if the vegetation does not adequately shield the trailers from public view. (Mitigation Measure) 2. All outdoor lights on the project site shall be shielded and/or situated so as to prevent glare and excess light on adjacent parcels. The number of lights shall be limited and the minimum amount of light needed shall be used. The use of motion detection lights is encouraged. Prior to issuance of the Use Permit, the applicant shall submit a plan showing all outdoor lighting on the site, including building mounted and lights mounted on poles, to the Planning Division for review and approval. The plan shall indicate the type of light fixture to be used and shall include a picture or illustration of each type of light fixture to be used. The equestrian facility operator shall modify or remove lights at the direction of the Director of Development Services if complaints of excess light are received by the County. (Mitigation Measure) 3. Lights for the outside area shall be turned off no later than 10:00 p.m. The lights in the parking lot shall be turned off no later than 11:00 p.m. each night. (Mitigation Measure) 4. Measures shall be taken to control fugitive dust emissions from all development activity on the site. Measures shall also be taken to prevent fugitive dust emissions generated by vehicles on the dirt/gravel roads on the site during and after construction and from dust generated by activity on the indoor and outdoor riding arenas. No significant fugitive dust emissions shall be allowed to occur off-site. Specific measures to be taken shall include, but not limited to: a. All active construction areas shall be watered at least twice daily. Frequency should be based on the type of operation, soil, and wind exposure. b. Chemical soil stabilizers shall be applied on inactive construction areas (disturbed lands within construction projects that are unused for at least four consecutive days). C. Land clearing, grading, earth moving or excavation activities shall be suspended when winds exceed 20 miles per hour. d. Non-toxic binders (e.g. latex acrylic copolymer) shall be applied to all exposed areas after cut and fill operation and hydro -seeded area. C. Vegetative ground cover shall be planted in disturbed areas as soon as possible. f. Inactive storage piles shall be covered. g. Paved streets adjacent to the development site shall be swept or washed at the end of each day as necessary to remove excessive accumulations of silt and/or mud which may have accumulated as a result of activities on the development site. E h. The applicant shall ensure that all ground surfaces are covered or treated sufficiently to minimize fugitive dust emissions. (Mitigation Measure) 5. Disposal of horse manure on the site shall not create any objectionable odors that are a nuisance to nearby residents. If complaints of objectionable odors are received by the County, the Director of Development Services may require the operator of the equestrian center to modify the disposal method(s) of horse manure to prevent objectionable odors. (Mitigation Measure) 6. Only the existing at -grade crossing on Dry Creek shall be used by horse riders. No additional at -grade crossings across Dry Creek shall be allowed. (Mitigation Measure) 7. Site drainage shall be configured to avoid all precipitation- and operational -runoff onto the bank, into the channel of Dry Creek, or into the small ephemeral drainage feature located near the eastern boundary. (Mitigation Measure) 8. The streamside setback distances shall be at least 70 feet from edge of the -creek for the proposed caretakers residence, and at least 150 feet from edge of the creek for horse barns, stables, arenas, and parking areas. (Mitigation Measure) 9. Applicant shall use appropriate sediment and debris control during grading and construction, to avoid placement of fill or debris onto the banks, into the channel of Dry Creek, or the small ephemeral drainage feature located near the eastern boundary. (Mitigation Measure) 10. Orange barrier fences shall be placed at the edge of the riparian vegetation and during the operation of heavy construction machinery to prevent inadvertent destruction of riparian vegetation. The applicant shall inform machinery operators and construction crews about the sensitivity of the riparian resource and the need to avoid it. (Mitigation Measure) 11. Prior to any disturbances to the riparian woodland habitat along Dry Creek the California Department of Fish and Game shall be contacted and surveys conducted for blue elderberry bushes and other potential riparian woodland -dependant resources. Streambed Alteration Agreement(s) may be required to be obtained prior to any clearing, grading, and/or construction in a streambed as per Department of Fish and Game requirements_. (Mitigation Measure) 12. The use of herbicides, pesticides, or fertilizers near the banks of Dry Creek or its associated riparian vegetation shall not be allowed without the written approval of the California Department of Fish and Game. (Mitigation Measure) 13. Fencing placed along or within the margins of the riparian vegetation along Dry Creek shall be constructed so as to not obstruct wildlife movements. (Mitigation Measure) 14. Should Bald Eagles be present, maintain appropriate seasonal buffer area around the potential roosting and nesting habitat associated with the upper slopes of Sausage Mountain. Horse riders are recommended to stay outside of buffer area if eagles are present. (Mitigation Measure) 3 15. The equestrian center operator shall inform horse boarders of the presence and general location of the Butte County Checkerbloom plants occurring on the property. Horse boarders shall be instructed that in the case they choose to ride horses to the spring site in the northwest- most orthwestmost corner of the property, they should stay on existing livestock access routes once they reach the topographical saddle on the southwest flank of Sausage Mountain. Once on the western flank of the Mountain, they should be instructed to avoid riding close, or tethering horses to the trunks of blue oaks. The notification shall be included in the boarding agreement. The applicant shall create and erect an interpretive sign that will be located near the crest of the topographical saddle. This sign should show what the checkerbloom looks like, should describe its habitat and ecological significance, and should provide guidelines for compatible riding activities. Boarders should also be instructed to not pick the flowers. No trails or other improvements shall occur within areas that may contain Butte County Checkerbloom plants. (Mitigation Measure) 16. No vehicles or equipment shall be allowed within a twenty-five (25) foot radius from the trunk of the large oak tree west of the outdoor arena. Prior to issuance of the Use Permit a fence or other type of barrier shall be installed around this oak tree that prevents vehicles from entering the 25 -foot area. Wood chips or bark shall be placed within the 25 -foot area to help prevent soil compaction caused by people walking in this area. (Mitigation Measure) 17. During any soil disturbance activities, including trail construction, should any archaeological artifacts be discovered, the Planning Division shall be notified immediately, and all work shall cease until a qualified archaeologist has examined the artifacts and the site, submitted his or her findings to the Planning Division, and recommended clearance to continue. Recommencement of construction shall be upon the approval of the Planning Division. (Mitigation Measure) 18. The equestrian facility operator shall include in the boarding agreement signed by people boarding their horses on the site a statement that all archaeological sites on the site shall not be disturbed and that the willful injury, disfigurement, defacement, or destruction of any object or thing of archeological or historical interest or value is a violation of the California State Penal Code. Prior to issuance of the Use Permit, the wording of the statement shall be submitted to the Planning Division for review and approval. (Mitigation Measure) 19. The equestrian facility operator shall create, install, and maintain an information sign at each of the two recorded prehistoric sites on Sausage Mountain. The signs shall briefly explain what each site is and a request not to disturb the site. The signs shall be installed prior to issuance of the Use Permit. (Mitigation Measure) 20. The equestrian center operator shall maintain all horse riding trails or paths so as to prevent any significant soil erosion into Dry Creek. Measures shall be taken immediately to prevent further soil erosion. (Mitigation Measure) 21. Provide a minimum of 15,000 gallons of water storage to be available for fire protection purposes. Provide a drafting connection, with no more than 15 -foot elevation increase between the water storage and the drafting connection. The exact location and type of drafting connection shall be approved by the Butte County Fire Department/CDF. The water storage 4 0 and drafting connection shall be installed prior to commencement of boarding operations. (Mitigation Measure) 22. No smoking shall be allowed west of Dry Creek from May 1 to November 1. Prior to issuance of the Use Permit the applicant shall post a sign on the east side of the Dry Creek horse crossing stating such prohibition. (Mitigation Measure) 23. Prior to issuance of the Use Permit a plan for a permanent solution for drainage shall be submitted for review and approval by the Department of Public Works. The drainage plan shall be prepared by a registered civil engineer. The drainage plans shall specify how drainage waters shall be detained on site and or conveyed to the nearest natural or publicly maintained drainage channel or facility and shall provide that there shall be no increase in the peak runoff flow to said channel or facility. The applicant shall submit a copy of the approved plan to the Planning, Environmental Health, and Building Divisions prior to issuance of the Use Permit. (Mitigation Measure) 24. Prior to issuance of the Use Permit, an animal waste management plan shall be submitted for review and approval by the Regional Water Quality Control Board and the Butte County Environmental Health Division. The requirements of the approved plan shall be strictly adhered to. A copy of the approved plan shall be submitted to the Planning Division prior to issuance of the Use Permit. (Mitigation Measure) 25. No structures shall be placed within the "A" flood cone as designated on the latest adopted version of the Federal Emergency Management Agency's Flood Insurance Rate Map for the project site. (Mitigation Measure) 26. The equestrian center operator shall take all necessary measures to prevent insects generated by the equestrian center from creating a nuisance off the site. The Director of Development Services shall require the equestrian center operator to take additional measures to control insects if complaints of insects are received and verified by the County. (Mitigation Measure) 27. Only two (2) public address systems shall be allowed. The amplifiers of the public address systems shall not exceed 75 watts each. Speakers for the open arena shall not be mounted higher than eight (8) feet above ground level and facing in to the center of the arena. Speakers installed in the covered arena shall be mounted under the eaves facing the center of the arena. The use of the public address systems, or any type of amplified sound, shall not occur after 9:00 p.m. The Director of Development Services may require modifications to the public address systems if substantiated complaints of excess noise are received by the County. (Mitigation Measure) 28. No classes or clinics shall begin before 9:00 a.m., Monday through Friday. (Mitigation Measure) 29. All parking must be contained on the project site. Any area used for overflow parking must be mowed or otherwise cleared of vegetation greater than 3" in height. The proposed parking area shall be landscaped per the requirements of the Butte County Zoning Ordinance. Handicapped parking spaces must be provided pursuant to federal handicapped access regulations. (Mitigation Measure) E 30. Install any septic tank and leachlield system under permit from the Butte County Environmental Health Division and, if required, the California Regional Water Quality Control Board. 31. Prior to construction, comply with Butte County Environmental Health Division requirements for the provision of domestic water to the public. 32. Obtain an encroachment permit and construct a public road approach at the access to Mesilla Valley Road to County standards, as specified in the County Improvement Standards. 33. Prior to issuance of building permits, provide elevations certificates as required by FEMA and Butte County Code, Chapter 26 Article IV, for property within a 100 -year floodplain. 34. Deed to Butte County, in fee simple, 30 feet of right-of-way from the centerline of Mesilla Valley Road. The night -of -way shall be sufficient for the installation of standard No. S-5 at all intersections. 35. Building permits required for all stable buildings, covered arena, office, bleachers, equipment shed, and caretaker's dwelling. Building plans for these structures shall be prepared by a licensed architect or registered civil engineer authorized to practice in the State of California, as required by the building code. 36. Applicant must comply with all other applicable State and local statutes, ordinances, and regulations. 37. Not more than two 1 -day competitive or performance riding events shall be held in any calendar month. 38. Provide portable sanitation facilities for competitive and performance riding events in accordance with Butte County Environmental Health Division requirements. I do not plan to build the entire facility at the outset but envision it evolving over a number of years, perhaps even 10 years or more. Initially I want to be able to have a limited number of riding events and horse shows on the property each year. Typically, these events are two or three days in duration with participants arriving either Thursday or Friday evening and leaving Sunday afternoon. During the first year or two the arena events will most likely be held in an outdoor arena until I can gauge the demand for constructing a covered arena as called for in my application. Much of the riding competitions will be held on outdoor courses that will be set up with non -fixed jumping features at the outset. These courses can be a mile or more in length. Course preparation is as simple as pulling a disc and then a grader behind a tractor to form an approximate 8 - foot wide trail. The initial structures on the property will be a hay barn and equipment shed which I intend to use for the agricultural purpose of raising hay on site. I understand that I do not need a Use Permit to construct these structures or raise and sell hay. The horse barn would probably be the next structure. It would be developed to board up to 50 horses. Again, demand will play an integral part of when this is constructed. It would be my intent, at least initially, to have riding events on the property with minimal improvements. I have been to numerous events across the state and all are conducted using temporary facilities (sometimes even when permanent facilities are available). A large riding event could attract up to 300 people which would include participants and spectators. An outdoor arena would be used with some standard bleachers. Bottled drinking water, refreshments and food would be sold by licensed mobile food wagons and vendors that would be there just for the event. Sanitary facilities would be provided with porta-potties. Water for dust control, animals and fire suppression would be provided by a many rental water trucks as the County deems necessary. We will contract with an ambulance service to be on.site during each days events in case of a medical emergency. Overnight camping would be a part of these events. Almost all participants have some type of recreational vehicle though some do bririg tents. A formal campground will not be constructed. Gravel roads would be developed to access the camping area and porta- potties would be located in and around the camping site. We will have a crew to pick up any stray trash and clean up the site after each event. With over 1,600 acres to work with the impact of these events will beminimal.• When either the covered area or the horse barn is constructed, whichever comes first, a pressurized water system with a hydrant or hydrants will be installed that meets` County standards. A graveled parking lot will be utilized for event parking. Power will initially be provided by an on-site generator but will evolve into a tie to the local power grid. I would also like to have a number of mountain bike riding events each year. These events usually generate about 100 participants and spectators. And would either be a single day event or a two day event. Single -day events would obviously not involve overnight camping. All necessary facilities will be provided commensurate with the size of the event. All events require a pre -registration so we will be able to properly plan for the necessary facilities. Anticipated traffic for the events would be approximately 150 vehicles with trailers for riding events and 60 vehicles for bicycle events. WHAT WILL IT PROVIDE? When fully built, the Horse Park will be able to host breed shows and local, national and international competition in all seven FEI disciplines (dressage, driving, endurance, eventing, reining, show jumping and vaulting) as well as cutting, polo, ride and tie, pony club and other equestrian events. The plan includes a 6500 -meter cross -county course and a separate steeplechase course for use in 3 -day events. The Horse Park is working in conjunction with the SPCA of Monterey County, which plans to build its horse rescue/adoption facility at the park. In addition, the California State University Monterey Bay (CSUMB) plans to make the Horse Park the home of its future equestrian team. The site, located in Parker Flats, is adjacent to a beautiful oak woodland and maritime chaparral habitat reserve protected by the U.S. Fish & Wildlife Service, and it opens on to thousands of acres of additional habitat reserve in the National Resource Management Area (NRMA) with numerous riding trails maintained by the Bureau of Land Management. Consistent with its lovely natural setting in gently rolling terrain with views of the Pacific Ocean reaching down to Big Sur, the Monterey Horse Park is committed to meeting or exceeding the highest environmental standards. We are not able to provide many meaningful comments about the proposal as submitted because we do not have the following information: • How large of a commercial center is proposed? • How large are the events planned at the facility? • How long will events last? • How frequent are events planned to be held? • Are camping facilities or other accommodations planned to be provided on the site? • Is food planned to be provided? • Will there be additional offices or a caretaker's dwelling as part of the project? The only indication I could find in the application of the potential size of the project is a note that 1000 parking spaces are available on the site. There are several types of soils on this parcel. Only one of them, the Corning Gravelly Sandy Loam, is suitable for sewage disposal. The size of the facility may require that this project have an engineered designed sewage disposal system with a Waste Discharge Permit from the Regional Water Quality Control Board. Dependent upon the size of the events and their frequency a permit for a public water supply system may be required. The provision of food would of course require a food premise permit from our department. Large events will also require solid waste control. Provision of power to operate remote facilities or equipment may also require permitting of fuel storage tanks.
