The conclusion is as follows: . The application is complete and has been acted on by the Commission. . The project has been constructed and is operational. . The Commission cannot undo the action on the application. . Publication at this point in time would accomplish nothing to alter the status of the application. Based on those facts, Felix and I have concluded that no further publishing is needed for this application. Therefore it should be declared complete and any excess funds refunded to the applicant. The Department was unaware that the Notice had not been printed. Therefore, the application went before the Planning Commission and was approved. It would appear to be an inadvertent violation.of thew6rown Act. Since this happened nearly 3 months ago, the application was approved at that time, and the applicant has probably moved forward with their"approved" project, do we need to do anything further? The Department was unaware that the Notice had not been printed. Therefore, the application went before the Planning Commission and was approved. It would appear to be an inadvertent violation of the Brown Act. Since this happened nearly 3 months ago, the application was approved at that time, and the applicant has probably moved forward with their "approved" project, do we need to do anything further? A radio-frequency analysis, signed by a radio-frequency engineer, states that the total radio emissions from the existing and proposed antennas will not exceed FCC standards. 3. The proposed antennas will not create a significant visual impact. B. The project is consistent with the Unclassified zone; which allows a wireless communication facility with a.Use Permit, and is consistent with the Grazing and Open Land General Plan land use designation, which allows public uses as a Secondary Use. C. Wireless telephone services are regulated by the California Public Utilities Commission and are considered to be a public use. D. The proposed use will comply with each of the applicable provisions of Chapter 24, Section 262, of the Butte County Code. E. The project is consistent with the California Land Conservation Act agreement that encumbers the parcel the project site is located on. The agreement allows public uses. F. The project will not have an impact on agricultural operations because the proposed antennas will be mounted on the existing lattice tower and the proposed equipment cabinets will be contained within the existing tower lease area. No farmland will be converted to a non-agricultural use. The proposed antennas would not extend above the existing tower, and would not have an impact on agricultural aerial operations. Conditions of Approval: Planning Division: The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment C" and date-stamped April 29, 2003, and is incorporated herein by this reference. 2. The installation of the Facility shall comply with all applicable building and electrical codes. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit ■ BUTTE COUNTY PLANNING COMMISSION ■ MINUTES ■ JUNE 26, 2003 ■ PAGE 18 ■ revocation hearing, which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life'of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, Metro PCS Inc. is hereby granted a Use Permit to add six 1.8 sq. ft.' panel antennas at the 102 -foot level on an existing 150 -foot tall lattice tower and to install ground mounted equipment cabinets, subject to the following conditions: Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the .Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request for a one-year extension is submitted to the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or State regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously, made a part of any condition to a Use Permit. 5. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 1 6. Neither the applicant, nor any agent nor representative of the applicant shall intentionally omit or misrepresent any material fact in connection with the application. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1, The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment C;" and date-stamped April .29, 2003, and is incorporated herein 'by this reference. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all-weather access to a publicly maintained. road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes. 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 2 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. . 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. The owner/operator of the Facility shall annually submit a written verification, attested to under penalty of perjury, signed by both the owner/operator and an FCC licensee in the employ of or retained by the owner/operator, that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. The reports prepared for the Facility shall conform to reporting requirements set by the FCC and the County. The reports shall be submitted to the Planning Division no later than January 31 of each year. 17. The Facility shall be secured at all times to prevent access by the public. 3 18. Prior to use of this project, the applicant shall contact the Planning Division for a field inspection to verify all conditions of approval and ordinance requirements have been met. Countv Counsel 19. If this entire matter or any finding, action or condition of this matter is appealed to the Board of Supervisors, the applicant or any other developer/operator other than the applicant agrees to indemnify the County of Butte from liability or loss related to the approval of this project and agrees to sign an indemnification agreement in a form approved by County Counsel before the Board's appeal hearing. If the application is not appealed, this condition is deemed satisfied. Building Division 20. Building and electrical permits required. Structural calculations prepared by an engineer licensed to practice in the State of California shall be provided verifying adequacy of existing monopole to support added loads. PROJECT DESCRIPTION: The applicant, Metro PCS Inc., is requesting a Use Permit to add six 1.8 sq. ft. panel antennas that would be centered at the 101 -foot level on an existing 150 -foot tall lattice tower. The applicant also proposes to install three ground mounted equipment cabinets within the existing tower lease area and install a new cable up the tower. The proposed panel antennas will provide digital wireless communications service for the Highways 99/149 -corridors. The site would be unmanned, and does not require a water source or a sewage disposal system. One to two visits to the site would be made per month by company technicians to perform preventive maintenance. 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 1 0 • 0 SITE CHARACTERISTICS: The project site is zoned Unclassified and has a General Plan Land Use designation of Grazing and Open Land. The project site is 331 acres in size and land uses on the property consist of the livestock grazing, fish ponds, and the 150 -foot tall tower. The property is encumbered with a California Land Conservation Agreement ("Williamson Act"). Surrounding parcels range in size from 4.25 to 635 acres. Land uses on the project site and the surrounding parcels include the Chico Game Fish Farm, livestock grazing, rice fields, orchards, high voltage power lines, and Highways 99 and 149. The existing 3,600 -square foot lease area is developed with the 150 -foot tall tower and equipment shelters and cabinets, all of which are surrounded by a six-foot high chain link fence topped with barbed wire. A locked gate provides access into the lease area. The 150 -foot tower was permitted with Use Permit 96-19. Use Permit 01-03 was approved in 2001 to collocate six 3 square foot panel antennas at the 127 -foot level. A short paved driveway extends from Schlaf Drive to the lease area. The lease area is paved and does not contain any vegetation. The existing tower currently supports two vertical antennas at the top of the tower (which results in an overall height of 161.8 feet above ground level), a 6 -foot diameter microwave dish at the 119 -foot level, panel antennas at the 112 -foot level, and cable runs up the tower. The top 50 feet of the tower is painted with alternating red and white stripes. ANALYSIS: General Plan and Zoning: The General Plan land use designation of the project site is Grazing and Open Land, which lists public uses as Secondary Uses (note: wireless phone facilities are considered to be a public utility). The proposed project is located in an area zoned Unclassified. The proposal would allow the collocation of antennas on an existing wireless communications facility, which is permitted by issuance of a Use Permit in the Unclassified zone. For the approval of the Use Permit, the applicant is required to present information, including plans or other information that is sufficient to allow the Planning Commission to make an informed decision. The Planning Commission may grant a Use Permit if: "The proposed uses of property will not impair the integrity and character of the zone in which the land lies, and that the use would not impair the integrity and character of the zone in which the land lies, and that the use would not be unreasonably incompatible with, or injurious to, surrounding properties or detrimental to the health and general welfare of the persons residing or working in the neighborhood or the general health, welfare, and safety of the residents of the county" (Butte County Code, Section 24- 45.10). In order to ensure that the proposed project complies with all applicable provisions of the County's Wireless Communication Facilities Ordinance (Butte County Code Section 24-262), the following conditions have been incorporated: 0 BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 2 ■ • Submittal of bonds to cover the costs of a one-time radio-frequency analysis. • Radio-frequency emissions in excess of FCC standards are not allowed. • Facilities that are not in continual use for a period of six months shall be considered abandoned. • Verification submitted annually attesting that the radio frequency radiation/electromagnetic frequency (RF/EMF) emitted by the facility conforms to safety standards set forth in FCC OET 65. • Access to the site must be at least 12 feet wide and capable of supporting a 40,000 -pound fire apparatus. Visual Impacts The existing lattice tower can be seen from a wide area due to the height of the tower, the mostly level topography in the project area, and the lack of trees in the area. There are very few dwellings in the project area that the tower effects, but the tower is seen by a large number of people because it is located close to Highways 99 and 149. The existing tower is located approximately 1,135 feet from Highway 99 and 1,780 feet from Highway 149. The addition of six 1.8 -square foot panel antennas at the 102 -foot level would increase the visual profile of the tower slightly. However, this is not expected to significantly impact the visual aesthetics of the area. The proposed antennas would not increase the height of the tower. Radio -Frequency Emissions The applicant submitted an analysis of the radio-frequency emissions that would be generated by all of the antennas mounted on the tower. According to the analysis, the combined radio- frequency emissions at the base of the tower from the existing and proposed antennas would be less than 3% of the FCC public exposure standards. Therefore, the radio-frequency emissions from the tower would be in compliance with federal standards for public exposure to radio- frequency radiation. Agricultural Impacts Livestock grazing occurs on the project site and throughout the project area. Commercial orchards are also located in the project area. No impacts to agricultural operations are expected due to the project because the proposed antennas would be placed on the existing tower. The proposed equipment cabinets would be placed within the existing tower lease area, and no grazing land would be converted to a non-agricultural use. The proposed .antennas would not extend above the existing tower and therefore.would not have an impact on agricultural aerial operations. ENVIRONMENTAL REVIEW: This application for a Use Permit to allow the collocation of antennas on an existing communications tower is determined to be Categorically Exempt from the provisions of the California Environmental Quality Act under Section 15311. Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special conditions set forth below, Metro PCS Inc. is hereby granted a Use Permit to add six 1.8 sq. ft. panel antennas at the 102 -foot level on an existing 150 -foot tall lattice tower and to install ground mounted equipment cabinets, subject to the following conditions: 1. Failure to comply with the conditions specified herein as the basis for approval of application and issuance of Permit constitutes cause for the revocation of said permit in accordance with the procedures set forth in the Butte County Zoning Ordinance, including Butte County Code Sec. 24-45.65. 2. Unless otherwise provided for in a special condition to this Use Permit, all conditions must be completed prior to or concurrently with the establishment of the granted use. The use granted by this permit must be established within two years of the date of approval. 3. Minor changes may be approved administratively by the Directors of Development Services, Environmental Health, or Public Works upon receipt of a substantiated written request by the applicant, or their respective designee. Prior to such approval, verification shall be made by each Department or Division that the modification is consistent with the application, fees paid, and environmental determination as conditionally approved. Changes deemed to be major or significant in nature shall require a formal application for amendment. 4. If any use for which a Use Permit has been granted is not established within two years of the receipt of the Permit by the Permittee, the Permit shall become null and void and reapplication pursuant to Section 24-45 (of the Zoning Code) shall be required to establish the use previously granted under the expired Permit unless, 30 days prior to the expiration date, a request fora one-year extension is submitted to ' the Planning Commission together with sufficient evidence that the time limits for processing development permits under federal or State regulations require time limits which exceed one year. Upon application, and for good cause by the Permittee, at a public hearing pursuant to Section 24-45.25 above, the Planning Commission may extend any time limitation previously made a part of any condition to a Use Permit. The terms and conditions of this Permit shall run with the land and shall be binding upon and be to the benefit of the heirs, legal representatives, successors, and assigns of the Permittee. 6. Any alleged material misrepresentation shall constitute grounds for the Director of Development Services to commence a revocation hearing, and, if proven to exist, shall constitute sufficient grounds to revoke a Permit. Conditions of Approval: Planning Division: 1. The project site shall be developed in accordance with the approved project site plan and the conditions contained herein. Said site plan is on file in the Planning Division, is identified as "Attachment C" and date-stamped April 29, 2003, and is incorporated herein by this reference. 2. The Facility must meet or fall within current standards and regulations of the FAA, the FCC, the County, and any other agency of the Federal or State government with the authority to regulate such Facilities. 3. The installation of the Facility shall comply with all applicable building and electrical codes. The Facility operator shall submit certification from a registered structural engineer to the Building Division, that all associated monopoles and towers in excess of thirty (30) feet in height will withstand sustained winds as required by the Uniform Building Code. 4. No advertising or display shall be permitted on the Facility. 5. The placement of any antenna or structure shall not adversely affect any on-site sewage disposal system or its repair area without written approval from the Division of Environmental Health. 6. The installation of the Facility shall not violate any existing deed restrictions. 7. The Facility shall have a twelve (12) foot wide all' -weather access to a publicly maintained road capable of supporting a forty thousand (40,000) pound fire apparatus with fifteen (15) feet of vertical clearance. 8. There shall be no outdoor vehicle or equipment storage except for emergency purposes 9. The Facility shall fall within current standards and regulations of the FAA, the FCC, and any other State and/or Federal agency with the authority to regulate such Facility. If such standards and regulations are changed, the property owner or responsible party shall ■ BUTTE COUNTY PLANNING COMMISSION 0 AGENDA REPORT 0 PAGE 7 0 bring the Facility into compliance with such revised standards and regulations within ninety (90) days of the effective date of such standards and regulations, unless a more stringent compliance schedule is mandated by the controlling agency. 10. The Facility or combination of the Facilities on the site shall not generate, at any time, electromagnetic frequency radiation (EMF) or radio frequency radiation (RF) in excess of the FCC adopted standards for human exposure, as amended over time. 11. If it is found that the Facility is or will be detrimental to the health, safety, or welfare of persons working or residing near such facility, then the service provider(s) and property owner shall be jointly and solely responsible for the removal, adjustment, or replacement of the Facility. In no case shall the Facility remain in operation if it is found to create a hazard to health, safety, and welfare. The Facility shall not be found to create a hazard to health, safety, or welfare as a result of EMF or RF emissions from the Facility so long as it meets all current standards established by the FCC, pursuant to FCC OET 65. 12. Prior to issuance of the building permit for the installation of the Facility, the applicant shall post a performance security in an amount and form determined by the Director of Development Services that is sufficient to cover the cost of a one-time test by a radio frequency consultant selected by the County, sufficient. to determine whether the Facility's RF/EMF emissions comply with FCC standards. If the Facility's emissions are determined to exceed FCC standards, the applicant is required to pay for such other tests and other corrective measures as are necessary to establish compliance with FCC OET 65 and its successors and such noncompliance shall constitute sufficient grounds to commence a permit revocation hearing which may lead to permit revocation. The applicant shall cooperate in all respects with the County's consultant to assist the consultant to reach his/her conclusion. 13. All Facilities that are not in continual use for a period of six (6) months shall be considered abandoned. Abandoned Facilities are hereby designated as unlawful and as public nuisances, requiring no amortization period. 14. All ground level support Facilities shall be painted and/or screened from view with adequate landscaping appropriate to the surrounding environment. All aesthetic treatments, including landscaping shall be maintained as approved for the life of the Facility. 15. The Facility may not encroach into, under, over, above, or upon any public street in the unincorporated area of the County in the absence of a valid encroachment permit from the County. 16. APN 041-190-025 Proiect Justification Metro PCS is currently deploying it's wireless communications system in the northern Sacramento valley area. Metro PCS's system is similar to other wireless communications carriers in that it relies on the installation and operation of base station antenna sites in strategic areas to provide adequate coverage for it's customers. Metro PCS is somewhat unique in that it provides very affordable "flat rate" wireless services to it's customers with no long term contracts required. Metro PCS has installed a number of new wireless base station sites in and around the Chico and Oroville areas as required by the licensing requirements of the Federal Communications Commission and in response to it's customer requests for increased wireless capacity and coverage for Metro PCS's wireless communications network. This request is to allow an additional collocated antenna site to be installed on an existing communications tower located at 5 Schlaff Road, just south of the intersection of Highways 99 and 149. Requested Entitlement and Project Description Metro PCS is respectfully requesting that this Conditional Use Permit application be approved for the addition of up to 6 antenna panels which are to be located on an existing 150 ft. tall lattice communications tower . The tower is located a 5 Schlaff Road, Oroville, CA. Metro PCS proposes to install it's antennas at a centerline height of 102 ft on the tower, well below, the top of the existing tower. The electronic radio equipment will be installed in a 8 ft x 14 ft. sub -lease area located within the existing American Tower fenced compound area. Site Description The existing 150 ft. American Tower Corporations (ATC) tower is located within a 331 acre parcel owned by Irvin Schlaff. The Schlaff residence is located on the same parcel as the tower, but is located several hundred feet away from the tower. Metro PCS is proposing to simply add 6 panel antennas onto the tower at the 102 ft elevation, which should be essentially unnoticeable to any of the surrounding properties. The Schlaff parcel appears to be used for grazing purposes and the proposed addition of antennas to the tower should not effect the existing uses found on the Schlaff parcel in any way. 785 Orchard Drive, Suite 135 Folsom, CA 95639 Page 1 • Summary is The approval and installation of Metro PCS's proposed antennas on an existing communications tower located at 5 Schlaff Road is a "preferred" method of installing new antennas or providing service to currently unserved areas in Butte County. Further, the required findings for approval of the Use Permit can be easily be made in that the proposed Matro antenna installation will not be detrimental to the health, safety, and general welfare of the surrounding community area and also fully complies with the development standards of the County's zoning code regulating the placement of wireless telecommunications facilities. We assumed that each carrier would be transmitting a maximum ERP "(effective radiated power) of 1500W. We performed calculations for three PCS carriers (1900MHz). The radiation centers used were 150, 120, and 110 feet respectively. This placement of the carriers is based on the as -built drawings of the site with the existing carriers as well as the proposed height of the MetroPCS antennas at 110 feet. The ANSI standard ANSVIEEE C95.1-1992 sets the maximum exposure level for persons in the vicinity of a continuously radiating source. The standard is intended to insure exposure levels that are safe for all persons, based upon current scientific knowledge by groups of experts in a number of biological and engineering fields. This study is a worst-case scenario using guidelines recommended by ANSI to calculate the energy density at a given point away from the radiating antennas. We make several assumptions, which cause this study to be a worst-case scenario. First we assume . that the energies at the various frequencies combine, although this is untrue. We also assume a veryY. . high ERP for each carver. The third assumption is that the radios are all radiating at maximum power at all times. This will only occur a few seconds each day if at all. These assumptions add up to a calculated value that is hundreds of times higher than what would be seen in reality. The maximum power density for this site at various distances from the site is shown in the table on the following page. The ANSI standard for the cellular frequency band is 0.527 mW/cm^2, and for the PCS band the standard is 1.23 mW/cm^2. At the base of the tower the combination of all these carriers will be less than 3% of the lowest ANSI standard of .527mW/cm^2.
