21 allowed both the Respondent and myself to subit such 'additional

LACK OF BUILDING PERMITS
18. When the Respondent and I1decided to do construction work
on the Table Mountain property, we contacted a builder, Warren Rolls.
5 The Respondent was securing the proper permits for the work. At the time
6 of the construction work, I personally saw what I believed to be County
7 permits tacked to the wall in the garage. I had no reason to doubt the
8 presence of proper permits, especially in light of the fact that the
9 Respondent's father, Lloyd "Smitty" Smith was at that time employed as
10 a supervisor at the office of Butte County Building Inspection.
11 Respondent thought we could get preferential treatment in getting
12 permits at a lower cost because of his father's position. At all times
13 during the construction work, I believed the Respondent had obtained the
14 proper permits necessary for the work being done. The first indication
15 I had that permits were not obtained for the construction work was the
16 Respondent's Supplemental Declaration dated October 28, 1992.
17 CHANGES TO MARITAL SETTLEMENT AGREEMENT'
18 19. Contrary to the representations made to this Court by_the
19 Respondent, I was not the.only party making changes to the first draft
20 of the proposed Marital Settlement Agreement, Exhibit "B" to
21 Respondent's Declaration.in response to my Declaration. I had not seen
22 some of the modifications and handwritten notes until being served with
23 that Declaration. For example, Exhibit "B", page 10 indicates "should
24 read 76 acres"'. There are also deletions on paragraph 1 -of the listing
25 of community and jointly owned property.. -Respondent, or someone at
26- Respondent's request, made those changes. As these changes were not made
27 at the time the Respondent and I were negotiating the'Agreement, I can
