Staff stated that the wording was directly from Environmental Health:
Commissioner Lynch stated that his concern was drain water from the runs being
washed down into the ground and he :felt it should go into a septic system
instead.

Mr.. Valentine was concerned with oversaturation from rain water runoff if it
went into the existing septic system.
Chairman Varcruse felt that they should leave this concern to the Health
Department.
Commissioner Lynch stated that washdown waste water unto the ground is a
concert.
Commissioner Walter stated that this was in compliance with the Health
Department requirements,
it was moved by Commissioner Peabody, seconded by Commissioner Lambert, and.
carried to approve the use permit for 100 dog runs as follows:
A. kind that the requirements of CEQA have been completed and adopt a Negative
'Declaration; and
B. Find that the proposed use complies with Butte County Code Section 24-47 and
that the proposed use of the property will not impair the integrity and
character of the zone• iii which the land lies and that the q-80 would not be
unreasonably incompatible with, or injurious to surrounding properties or
detrimental to the health and general welfare of persons residing or working
in the neighborhood or to the general health, welfare and safety of the
County, and

100 dog runs in the 5-14 and U zone, on AP 41-33-17 (Jerry Valentine) subject

At the regular meeting of the Butte 0oulity Planining Commission held
September 10, 1986, your request for a :Use Permit to allow a boarding
kennel on property zoned U and S -H located at the northerly oorner of
Highway 70 and Pentz Road, identified as AP 41-33-17, southeast of
Paradise, was approved subject to the following conditions;
1. Provide, proper handling and disposal of all animal feces and urine
so as to 'prevent odor and fly production on the premises., This may
be met by daily removal of animal wastes and confining material to
fly -tight leakproof containers and transport to an approved disposal
site) or by installation of concrete runs and a sewage disposal
system .for washdown wastewater disposal in compliance with Public
Health requirements.
2. Verify that the existing septic system and well are adequate to serve
the kennel facility with two travel trailers:
3. Obtain encroachment permit from the napartnent of Publ c Works and
upgrade the existing driveway, as necessary, to meet their requirements.
4. Kennel buildings to be constructed in a manriex to restrict noise
levels to a maximum of 60decibels (dB) at the property lines) pursuant

Kennel. The site was previously Used by Morris Knudsen as a
construction site for the Highway 1 70 construction, The applicant
breeds Rottweiler dogs; there are currently about 15 PUPPids kept In a
Penned area, The closest neighbor Is T/4 mile or more away to the
north, separated by 5 acres of a,30.-acreparcel.
The eventual plan is to have five buildings of twenty doe runsmplece.

initial Study (Pages 6 throUgh 9) is incorporated by reference.
The site is located in an area that is relatively uninhabited at
present. It is not anticipated that new residential uses would be
established immediately adjacent to the proposed kennel. The two
closest vesidences ar-a about 1/4 mile away to the north and northwest.
Two travel trailers are proposed for the site With one for .4 caretaker
and one for a kennel office. The existing penned area wou,.'d be used for
a shop once the kennel building is constructed. A Septic aystem Was
previously Installed for a 'large mobile home on the Property and would
.be used for the two travel trailers. A well I s located on the southeast
portion of the property 14 Water has been Pumped from the well up to 24
hours a day recently.
The at'..' !cant proposes to install eucalyptus or other fast-erdwing trees
to help reduce the nolse from barking dogs. The kennel building would
be enclosed v,11th heatlno and air conditioning for year-round use.

2. Butte County requires leach lines to, be placed ten
(101) feet apart center to center. Your design
specifies seven (7') feet center 'to ceriter. .
3. A replacement Area capable of handling an entire
replacement leach field must be proven and designated
on your plan. Entire septic system to be designed to.
work by gravity flow.
Information highlighting those points and a sewage disposal
permit application are enclosed.
A wager system for a tamp of this size will require a permit from
the county. An application to obtain this permit s also
enclosed.
