(Building # 2) Building # 1 is a two story barn or shop with a 2nd story converted to a living unit complete with kitchen, cabinets, bedroom, bath, woodstove etc. No permits. Building # 2 (See attached complaint and drawing on back) is indeed an ag. building and has an ag. exempt permit. Building # 3 is a two story barn or ag. building converted to a living unit. No permits. Apparently the septic tank is under the floor with the access opening in the middle of the floor. The travel trailer has no permits and remains hooked up to septic. Building Code Violation at A.P. # 041-400-016 3537 Clark Rd., Oroville, CA Dear Mr. Mullins, During our phone conversation on February 21 or 22, I stated that if there was an additional problem, I would contact you again. After your call, I pulled our records and discovered that there is a long code violation history behind the converted agricultural building on the property. While it is an adequate solution to remove the travel trailer from the property, it is not enough to simply vacate the converted ag. building. This building was built without permits in approximately 1982, and has remained in violation since that time. Your zoning does not permit a second dwelling unit on the property. Therefore, continued existence as a dwelling unit will require a use permit from the Butte County Planning Department, before building permits can be issued. In a letter dated March of 1983, you were given a list of options to remedy this situation, and this list remains much the same today. Your options are the following: 1) Convert the second unit back into an agricultural building. 2) Demolish the structure ( a demolition permit is required ). 3) Obtain a use permit from the Planning Department for a " second unit, " and comply with all applicable conditions. 1 The above violation ,(s) shall be corrected or abated by you by submitting three ( 3 ) complete sets of plans, applying for the required permits, and paying the appropriate fees, including penalties. After permit issuance and field authorization to proceed, the work must be completed and approved by this office within the specified time. This is your final warning. Section 26-1 of the Butte County Code states that the County has adopted the 1979 Edition of the Uniform Building Code. The Uniform Building Code requires that all persons constructing buildings within the County of Butte, except for agricultural buildings, are required to obtain a permit from the County Building Department. Section 26-6 of the Butte County Code states that: "It shall be unlawful for any person, firm, or.corporation to erect, construct, alter, repair, move, remove, improve, convert,. demolish or equip any building or structure in the unincorporated areas of the County or to cause the same to be done contrary to or in violation of any of the provisions of this chapter. "The use or occupancy of any building in violation of.any-of the provisions of this .chapter is hereby declared to be a public nuisance and may be abated in a manner ;provided by law." Section 1-7 of the Butte County Code provides that any violation of any provision o.f the Code constitutes a misdemeanor, or in the discretion of the District Attorney, be charged as an infraction. The penalty for a misdemeanor is punishment by a fine not exceeding $500.00 or imprisonment. The punishment for an infraction shall be a fine not to'exceed the sum -of $500.00.
