Pursuant to the provisions of the Zoning Ordinance of the County of Butte and the special
conditions set forth below: Mark Ryan is hereby granted a Use Permit to allow children
in an existing mobile home park on property zoned AR -MH -3 (Agricultural Residential -
Mobile Home - 3 acre parcels) located on the east side of Clark Road (State Highway
191), approximately 1,200 feet south of Clear Creek Cemetery Road, Oroville, CA.
I. Failure to comply with the conditions specified herein as the basis for
approval of application and issuance of Permit, constitutes cause for the
revocation of said permit in accordance with the procedures set forth in the
f Butte County Zoning Ordinance, including Butte County Code Sec. 24-62.
2. Unless otherwise provided for in a special condition to this use permit, all
conditions must be completed by the Permittee within 12 months of the
delivery of the countersigned permit to the Permittee.
3. If any use for which a use permit has been granted is not established within
one year of the date of receipt of the countersigned permit by the Permittee,
the permit shall become null and void and reapplication and a new permit
shall be required to establish the use.
4. The terms and conditions of this permit shall run with the land and shall be binding
upon and be to the benefit of the heirs, legal representatives, successors, and
assigns of the Permittee.
SPECIAL CONDITIONS:
1. Provide permanent solutions for drainage. Submit plans to Department of Public
Works for approval.
2. Meet Water Quality Control Board requirements for waste water discharge and
sewage disposal facility modifications.
3. Connect to e)asbng water system.
4. Meet the Department of Housing and Community Development requirements for
mobile home parks.
5. Meet the requirements of the Butte County Fire Department and to facilitate
response by emergency vehicles, the applicant will cause to be installed and
maintained:
a. At the end of each street, a street sign meeting County standards.
b. At each occupied residence, house numbers at least 12 inches high and
easily visible from the street.
C. Near. the park entrance, a directory map of the park, lit at night and
readable from incoming vehicles.
6. Meet the requirements of the State Department of Fish & Game regarding stream
bed alteration permits.
7. Meet the requirements of CalTrans, including:
a. Construct a right turn deceleration lane for northbound vehicles.
b. Accomplish shoulder widening on the west side of State Highway 191 (Clark
Road) to allow southbound vehicles to drive around vehicles waiting to
make a left turn.
8. Construct and maintain a wall or fence six feet in height along each side and rear
boundary of the mobile home park and Phase 1, except along the portions that
abut State Highway 191 (Clark Road). The wall or fence may be of solid wood,
concrete, brick, or any masonry construction, or of chain link construction with an
evergreen hedge planted and maintained at a height of six feet.
9. Construct a solid wall or fence six feet in height along State Highway 191 (Clark
Road) to act as both a security fence and noise attenuation device.
10. Plant and maintain in living condition two trees per space on those spaces
adjacent to Clark Road.
11. Provide security fencing around the R.V. storage area.
12. Provide security fencing around the waste water disposal ponds.
13. On site area lighting to consist of four foot high lamp stands reflecting downward.
14. Should cultural resources be encountered during construction activities, the
Northeast Information of the California Archaeological Inventory at California State
University, Chico shall be notified immediately. Notice shall also be provided to the
Butte County Planning Department. All work in the area of the cultural resources
shall be halted until determination of its status has been made and clearance
granted by the appropriate agencies.
15. The action does not contain approval for any commercial facilities on-site.
16. Construct an office, laundry and recreation building as shown on that exhibit map
dated 3/8/88 and submitted to the Commission 3/10/88.
17. School fees shall be paid in accordance to the regulations of the State Division of
Housing for each mobile.
18. Prior to any issuance of permits or occupancy of Phase 1, Lots 1 through 60, as
identified on Map (Exhibit A), conditions 1-17 must be met and constructed.
19. This use permit is limited to Phase 1, construction and occupancy, any further
expansion of the park will require a new use permit application and approval.
20. The mobile home park land use permit approved on December 22, 1970 for 253
spaces is automatically superseded and becomes void upon exercising any of the
conditions of approval and by any issuance of permits or occupancy of Phase 1.
21. Applicant must comply with all applicable State and local statutes, ordinances and
regulations.
22. Minor changes may be approved administratively by the Director of Development
Services, or designee, upon receipt of a substantiated written request by the
applicant. Prior to such approval, verification shall be made by each Department
or Division that the modification is consistent with the application, fees paid, and
environmental determination as conditionally approved. Changes deemed to be
major or significant in nature shall require a formal application for amendment.
I hereby declare under penalty of perjury that I have read the foregoing conditions,
that they are in fact the conditions which were imposed upon the granting of this use
permit, and that I agree to abide fully by said conditions.
