Mr,, Vanllart stated the proposal appears to meet State Nater Quality Control
Standards. Mr. Cook, the engineer, stated that the project would have approx.
5,000 to 10,000 gals. of waste water per day. Mr. Knudsen, 'the applicant,
stated there:: would be approx. 3 truck trips per clay to the site. The soils
of the area were discussed. Mr. McKeeman suggested that the applicant re-
quest agricultural zoning on the property to protect his use. Dr. Hazeltine
suggested a waste water disposal system be developed which will not contri-
bute to pest control problea;is. Disposal of bulla waste was discussed. Mr.
Knudsen said they planned to compost -the bulk waste, then distribute it
across the property. Ile stated they hoped in the future to install, gas
dryers on the site for drying the bulk waste, thenbag it for sale: as live-
stock feed. Mr. McKeeman stated the General. Flan designates this area for
Ntultiple-Use Open. Space. I•le requested the Checklist be reviewed and a YES
was marked un Nos, 1, 6 with note that the construction will be a pipeline
only, 10, No. 12 was undecided, 22, 26, F 31: The Butte Co. Mosquito Abate-
ment Dist. has indicated. that the processing water lagoons and the related
activities with these l:agoonz could possibly produce mosquito habitats.
Also, the disposal and/or storage of pulp waste could create a :Cly habitat
rroducti.on area. These problems can be alleviated through design & pesticides,
however, the pesticide use should be strictly regulated. Mr. MclCeeman made
a motion to require an t -IR on this project finding that the proposal could
substantially effect ground water quality, that the proposal could create a
fly Cr mosquito brooding habitat, and the only method of mitigating these poten-
tial protUems is through an Lllt. Motion died for lack of a second. Mr.
Planery then made a motion to filo a Negative Declaration on this proposal
finding that this particular° project on this parcel in this area will pose
no substantial adverse environmental, effects, and the "YES"s marked on the
Checklist can be controlled through governing agencies. Mr. Tanliart seconded
this motion.

Pentz-14agalia Hwy., approximately 1 mile north of Pentz Road, containing
209.28 acres, more or less, south of Paradise was held as advertised.
The Planning commission vote was 6 ayes - I No - 2 Absent to deny the use
pormitj Mr. Lawson set out the background of the area.
Hearing open to the public: Appearing!
1, Bill Spruance, attorney representing Mrs Knudsen. 14r# Spruance
stated this is a small family operation. Mr. Sproance set out the area
involved. Mr. Spruance stated that this use is permitted in the A-2 zone.
2, mr. Btowno Cook and Associate8y set out the water supply and
the conditions of the percolation tests.
Discussion of the evaporation ponds had at this time.
Mt,, Sptupace staked that this J,, -Ind wood be under the Mosquito
Abatement Dirt-riet control and that there would be three buildings in the

function to any other body and require that Board Itself conduct
the review required by statute. Kleist v. CitV of Glendale, 56
Cal. App- 3d 770, ?87 (1976). The results of such a review must
be expressed in written findings, either in the form of a negative
declaration or an 2nvironmental Impact Report. Meyers v. Board
of Supervisors of the County of Santa Clara, 58 Cal. App- 3d
413,� 430 0 976) ; No Oil Inc. v. Cit. -Yr of Los Angeles, 13 Cal. 3d
68, 81 (1975).
Although Boardis failure to comply with Public Resources
Code Section. 21152(a) requires that its decision be set aside,
additional procedural error is established in that the petition
and exhibits thereto disclose substantial evidence upon which it
can be fairly argued that the use permit may have a significant

A major purpose of an environmental impact report is to
inPorm other governmental agencies, and the public generally, of
the eriviporimental impact of a proposed PPojeotj and to demonstrate
to the citizenry that Doeird has in fact analyzed and considered
the ecological implications of its action. A simple negative
declaration statitig that the project will have no significant
