ANALYSIS:
The applicant originally requested approval of a Use Permit to allow a permanent third
dwelag 'unit on a 49 +/- acre parcel, T`wo mobile homes presently exist on the property.
A 2,500 square foot single-family home is proposed to 'be the third residence, The first
mobile home was placed on the property in 1981. In 1985, the second mobile home. was
A
installedi A replacement mobile home for the "1985" unit was put on the property in 1991.
At the October 14, 1993, Planning Commission hearing, the applicants agreed to modify their
request by designating one of the mobile hornes as a temporary living unit, This change was
primarily the result of staffs recommendation for denial of three permanent units, and the
applicant's desire to provide housinglor their parents. Staff originally recommended this
course of action be taken because of ihe concerns with the density and integrity issues of the
General Plan and zorning. The appholol has indicated that the 12 ft. x 60 ft. mobile home
would be de6griated as the temporary living urflit.
Butte County Code Section, 24-304 provides for removal of them,obile hoone within. 12'0 days
of the time that it is no longer being occupied pursuant to the code section. The Code also
makes provision for the County requiring a bond or deposit tit the time of application of
sufficient size to cover the removal expense of the mobile home, This is to insure that the
taxpayers at large (via the General Fund) are not charged those expenses should the County
be forced to remove the mobile home pursuant to the code. Of course, if the applicant
removes this mobile home voluntarily, then, the loond or deposit would be returned. Similarly,
it * the County removes the mobile home, then only charges actually incurred would be
reirritursed from the bond or deposit with the remainder being returned to the applicant. A
survey of several mobilehome dealerships.in Butte County has indicated a rather wide range
of estimated costs of removal. Cost� of course, would vary due to installation of landscdping,
decksi awnings, and physical site characteristics. Taking the median figures and adding a small
amount for administrative costs and storage costs, it appears that a reagona L ble deposit would
be $1,500 per, single -wide and $2,000 for a double -wide mobile home. These amounts seem
reasonable to ensure that the mobile home is removed at no cost to the County or the
taxpayers, The tipplicant proposes to place a single -wide mobile home on the property.

Health Department and no environmental constraints are located on the Proposed building site,

The applicant requested soils evaluation for a potential lot split in May 1993. Soil exploration
was done and it was determined that the, proposed lot split did not meet minimum net usable
leachfield area requirements -found in Appendix VII f of Subdivision Ordinance. Thereis an
acceptable location, however, for the additional residence.
This Use Permit project is notrequired to meet Appendix VII standards. Since the soil is veey
limited oft subject property, the following conditions are recommended:

dwelling units. This request has to be considered as one single-family home and a
duplexi This is because duplex dwellings have been interpreted As two units,
regardless of whet.ier they are attached. The IlUll zone does not allow parcel sizes
of less than 20 acres unless a rezone, consistent with the General pl,,!,, iV approved.
The AgriculturalResidential land use designation allows parcel sizes ranging from
I to 40 acres. This designation also specifically states that only one (1) single-
taMilY dwelling unit is allowed per parcel. Any zoning designation that allows lot
sizes of less than 20 acres, is 'considered to be conditionally consistent with the
Agricultural - Residential General Plan designationi This requires that. additional
criteria be considered to determine consistency. As stated earlier, the minimum
parcel size for a land division request in the "till zone is 20 acres. This corresponds
with the consistent zones of the Agricultural-Rebldential General Plan 6.0signationi
The purpose of hhe previous discussion, of lot sizes is necessary to review the
residential density issue and to determine the integrity if the requeot ao It relates
to County zoning and General Plan, As far as the density issue is concerned, the two
dwellings on the property are presently consistent. with both the General Lan and the

The applicant requested soils evaluation for a potential lot split in May 1993. Soil exploration
was done and It was determined that the proposed lot split did not meet minimum net usable
leAdIffleld area requirements found in Appendix VII f of Subdivision Ordinance. There is an
acceptable location, however, for the ad , ditional residence.
This Use Permit project isnot required to meet Appendix VII standards. Since the Soil is very
Ilimited on subject property, the following conditions are recommended -
