Notice of said hearing has been given as required by law. 2. All acts and transactions of petitioner, RUTH CHURCH GUPTA, during the period of administration are truly shown and should be approved, and all allegations of the petition for its settlement and for final distribution are true. 3. LEWIS OREM PECK, aka LOUIS 0. PECK, aka LOU PECK died testate on June 28, 1993, in the City and County of San Francisco and was a resident of that county. 4. On October 14, 1993 Letters Testamentary were issued to RUTH IICHURCH GUPTA and at all times since that date she has been and is now 1 I the duly qualified personal representative of the estate. 2 5. Petitioner has performed all duties required of her as 3 Executor of the Will of the Decedent. All costs of administration 4 have been paid with the exception of attorneys' fees. The estate was 5 administered under the Independent Administration of Estates Act, with 6 full authority. 7 6. Notice to creditors was published for the period and in the 8 manner prescribed by law. Within 30 days after the completion of 9 publication of Notice to Creditors, there was filed with the Clerk of, 10 the Court an affidavit showing publication of Notice to Creditors in 11 the manner and form required by law. More than four months have 12 elapsed since the issuance of Letters Testamentary in this estate and 13 since the first publication of Notice to Creditors. All known and 14 reasonably ascertainable creditors of the estate described in Probate 15 Code §9050 received the notice described in Probate Code §9052 or are 16 within the class of creditors described in Probate Code §9054. The 17 time for filing claims has expired. No creditors' claims have been 18 filed. To the best of Petitioner's knowledge, there are no additional 19 debts or creditors of the decedent. 20 7. The whole of the Estate consists of separate property of the 21 decedent except for a small community property interest in the 22 property in Butte County, all of which is being distributed to the 23 surviving spouse. 24 8. No personal property taxes are due or payable by the estate. 25 9. No final income tax return was required, and all taxes have 26 been paid by the estate.
