In addition, your plans are routed to other regulatory entities including but not limited to Planning, Public Works, Environmental Health, and the California Department of Forestry for their clearances and approvals. There are some things you can do to expedite your permit: 0 Make sure your application is complete. 0 Be responsive to requests from County departments for any additional materials or requirements. The Building Division places its highest priority on processing building permits as quickly as possible and each day that passes without a complete application adds to processing time. EXPIRATION OF PERMIT APPLICATION AND REFUND POLICY Application for which a permit has not been issued will expire one year after date of application. Refunds may only be made upon written request by the person who originally paid the fees. Refunds for permit applications (not yet issued) must be requested within two years from the date of fee payment. Fees paid at the time of application are for Plan Check and administration. The Plan Check portion of fees is refundable only if the permit is cancelled or withdrawn before. any plan checking is done. The court has reviewed all 5 the evidence and makes the following findings: 6 1) There is no deeded access which allows the owners of Parcel 21 to 7 use the easement which traverses the southern border of Parcel 30. 8 Although there were many land divisions and easements deeded out 9 and retained, there is a break in the chain of title from Campbell 10 to White (predeceasers in interest to parcels 21 and 3.0). The 11 subsequent deeds to parcel 21 (Williams to Davisson to Boss.) do not 12 included the right to use the easement across Parcel 30. 13 2) Despite the fact the Davvisons acquired an easement across parcel 14 30, this applied only to Davvison as the owner of Parcel 35 and the 15 right was not expanded to parcel 21 when Davvison became the owner 16 of parcel 21. Davisson (dominant tenement) did not have the right 17 to increase the burden on the servient tenement by adding Parcel 21 18 to the use of the easement he acquired as owner of parcel 35. 19 3) The owners of parcel 21 have not proved the right to an easement by 20 implication. 21 4) By a preponderance_of the evidence, the owners.of.parcel 21 have 22 established a prescriptive right to use of the road (Zonalea Lane) 23 which is located within the easement on the southern border of 24 parcel 30. Use of Zonalea Lane by Claudio and Fowler, predecessors 25 in interest to Boss,. were as tenants of parcel 21, not as employees INTENDED DECISION - 2 k 1 of Parcel- 35, thus the use was without permission and adverse and 2 openly hostile to Thurman and their predecessors. 3. The necessary elements to establish title by adverse possession are 4 that possession must be by actual occupation under such circumstances as to 5 constitute reasonable notice to the owner; that possession must be hostile to 6 the owner's title; that the holder must claim the property as his own, either 7 under color of title or claim of right; that possession must be continuous 8 and uninterrupted for five years; and that the possessor must pay all of the 9 taxes levied and assessed on the property during the period; and unless.each 10 element is established by the evidence, a plaintiff has not acquired title by 11 adverse possession. Newman v. Cornelius (1970, 5th Dist) 3 Cal App 3d 279, 83 12 Cal Rptr 435. 13 The elements necessary to establish a prescriptive easement are, 14 with the exception of the requirement that taxes be paid, identical with 15 those required to prove acquisition of title by adverse possession: open and 16 notorious use or possession that is continuous and uninterrupted, hostile to 17 the true owner, and under a claim of right. Such use for the five-year 18 statutory period of Code Civ Proc, § 321, confers a title by prescription. 19 Taormino v. Denny (1970) 1 Cal 3d 679, 83 Cal Rptr 359, 463 P2d 11. 20 Possession, when presumed; Occupation deemed under legal title, unless 21 adverse: In every action for the recovery of real property, or the 22 possession thereof, the person establishing a legal title to the property is 23 presumed to have been possessed thereof within the time required by law, and 24 the occupation of the property by any other person is deemed to have been 25 under and in subordination to the legal title, unless it appear that the INTENDED DECISION - 3 I 1 property has been held and possessed adversely to such legal title, for five 2 years before the commencement of the action. Cal Code Civ Proc § 321 3 In the case at bench, the court has found the establishment of a prescriptive 4 easement and not mere permissive use. The record is -replete with evidence of 5 usage of Zonalea Lane by the prior owners (or their tenants or guests) of the 6 dominant parcel (Parcel 21) for many more years than five. Circumstantial 7 evidence established that the road was used by the Flowers when they lived on 8 parcel 21 from about 1995 until 2001 (they lived on parcel 21, got their mail 9 there and there was no other road to the parcel except Zonalea Lane.) Miguel. 10 Claudio used the road form 2001 to 2003, Weistersens. used the road to get to 11 Parcel 21 until the new road became available in 2005. The easement which 12 included the road had been in existence since at least 1970. There is no 13 evidence of concealment or furtive conduct. There is strong and substantial 14 direct evidence of an open and notorious use of Zonalea Lane to get to the 15 parcel 21. If fact, prior to the Boss' acquiring title there were no other 16 roads to parcel 21. There has been a continuous and uninterrupted use of 17 the roadway extended by the specific acts of use. As,in Zimmer, "there has 18 been no break in the essential attitude of mind required for adverse use." 19 (Zimmer v. Dykstra, 39 Cal.App.3d at p. 432.) Here, whenever the possessors 20 of parcel 21 (and its predecessors) needed the roadway from time to time, it 21 made use of it; this is "a continuous use." Here, the claim of right was 22 from the inception of the use, as the servient owners knew. Thus, the 23 evidence shows open, notorious, continuous and uninterrupted use hostile to 24 the servient owner, under a claim of right for at least five years prior to 25 the time Boss's acquired title to parcel 21. "(When] one who claims an INTENDED DECISION - 4 1 easement by prescription offers satisfactory evidence that all the required 2 elements existed, the burden of showing that the use was merely permissive 3 shifts to the owner of the. -land." Chapman v. Sky L'Onda etc. Water Co. (1945) 4 69, Cal.App.2d 159 P.2d 988. This Thurmans have failed to do.. No permission 5 was ever asked for nor. was any given; no one ever questioned the right.of the 6 "users" to use the road until Thurmans told Boss in 2005 not to use the road. 7 Boss and its predecessors treated the roadway "as (its] own. The 8 prescriptive right to use the road was acquired. See Twin Peaks Land Co. v. 9 Briggs, 130 Cal. App. 3d 587, 593-594 (Cal. Ct. App. 1982) 10 5) •The court has taken judicial notice of the contents of the file in 11 Butte County Superior Court case #115266 which contains a legal 12 description of the easement which contains.Zonalea Lane, sufficient 13 for the.court to establish a legal description of the.easement 14 rights. The use will determine the location and extent of the 15 easement. The court finds the prescriptive easement to be for road 16 purposes as described in the Davisson/Thurman easement document 17 attached to the pleadings. 18 6) Plaintiffs Thurman are entitled to quiet title as.to Parcel 22 due 19 to the disclaimer by Boss to any and all interest in the Thurman. 20 parcel which would be a benefit of and appurtenant to parcel 22. 21 Parcel 22 does not have prescriptive or other rights to the Zonalea 22 Lane easement. 23 7) The court will deny the plaintiffs request for an injunction based 24 on the courts ruling of the prescriptive rights.set forth in this 25 ruling.
