Licensee shall, at its expense and to the satisfaction of Licensor, keep and maintain ,the premises, the facility and any other improvements in good order and repair and in a neat and safe condition, and promptly make all repairs and replacements that may become necessary to the premises or the;facility or other improvement or appurtenances thereto, whether structural or nonstructural, ordinary or extraordinary. Licensee or Licensor's agents, representatives or employees shall have the right, at reasonable times, to enter the premises for the purposes'of inspecting, posting of notices of nonresponsibility, determining whether agreements in this License are being complied with, maintaining, repairing or altering the land, or showing the premises to prospective lessees, licensees, purchasers, mortgagees -2- or beneficiaries under deeds of trust. C. Construction. Alteration� gnd Liens. " Licensee shall construct, reconstruct, maintain and operate the facility in a good, safe and workmanlike manner consistent with he use made of said premises. Licensor shall have the right to post notices of nonresponsibility upon the premises, and to otherwise notify, actually or constructively, any entity or persons supplying services or materials to the premises'that Licensor is not responsible of .the cost thereof. Licensee covenants and agrees to hold Licensor and the premises harmless from any mechanic's or materialmen's liens claimed by any person, firm or corporation employed by Licensee. In the event of the filing of any such lien. Licensee shall cause such lien to be released within 5 days after Licensor's written notice `to do so. Licensee shall indemnify and defend.Licensor against all liability, cost and expense (including attorney fees) incurred by Licensor as a result of any such lien. 6:. Utilities. Licensee agrees to pay all water service charges and water standby charges on, or assessed against, the premises during the term of this License. The proposed fire station will be a galvanized metal building and will hold one water tender vehicle and one fire engine. The building will not initially be connected to electrical service, and will not containa bathroom. These amenities, along with an office, will be added later when funding becomes available. The fire station will be located approximately 42 feet from the edge of Cherokee Road. The fire station use will not involve the storage of any hazardous materials or fuels. The station will normally be unmanned, with volunteer Firefighters only coming to the site to pick up the fire vehicles to respond to an emergency. Maintenance of vehicles will not occur on the site. The property is located.on the east side of Cherokee Road, approximately 800 feet north of Patterson Lane/Tippytop Road,. Cherokee. Commissioner Mooney said he did not think the applicant would get a building permit without a toilet, and he did not think they would get a toilet without a septic permit. Mr. Betts said that Environmental Health was aware that a bathroom would not be initially installed. The applicant did. do soil testing and Environmental Health did approve it. Commissioner Mooney said there does not look like sufficient area for the 100 % leachline replacement requirement. He_said the last fire station he did the County required two handicapped 'showers and a restroom. He said the Use Permit was the easy part. He said the well was not shown on the plot map. Mr. Betts said it is in the upper northwest corner of the property and is not shown on the map. Commissioner Mooney said this is a building with an occupancy requirement and will require handicapped restrooms. The hearing was opened to the public. There was a representative here to answer questions. The hearing was closed. It was moved by Commissioner Mooney, seconded by Commissioner Lambert, and unanimously carried to approve the Use Permit for the Butte County Fire Department, UP00-11, to allow a volunteer fire station subject to the -findings and conditions listed below. Adopt a Negative Declaration regarding environmental impacts as detailed in this agenda report with the following findings and authorize the Chair to sign. A. Find that an Initial Study was completed in compliance with the California Environmental Quality Act, that said study did not identify any potential significant environmental effects, and that a Negative Declaration is proposed.
