ANALYSIS
The applicant is requesting approval of a Use Permit to allow a permanent second dwell"ng
in what is referred to as "Granny Housing" or a 62-1200. This propesed structure is a 1136
square foot modular home. The main house on site is 1200 square feet in size. There is also
an existing ba- on site.
Prior to the State changing the requirements for "Granny Housing", the County's standard for
second units consisted of no more than 640 square feet in size and a person at or above the
age of 60 had to reside in the second unit. The approval was considered ministerial and only
a building permit and a recorded affidavit was required. The amendments to Section 24-202.
approved by the Board of Supervisors on August 20, 1991, require applicants to obtain
approval of a Use Permit. The ,new regulations increased the second unit rnaXl4mum to 1200
square feet and changed the age limit to 62 years or older (hence 62-1200). In order to
ensure that the proposal is harmonious with the site and surrounding properties, the planning
Commission is required to review the following criteria when making a decision on a 62.1200
proposal•
1. Adequacy of water services.
2. Adequacy of sewer services and wastewater disposal capabilities.
3, Drainage impacts.
4. Disruptions of viewsheds.
5. Appropriateness of setbacks, site coverage, building heights, and vehicular and pedestrian
circulation and parking.

The following comments regarding disease vectors and
pests are offered as information to property owners and
future residents of the area.
This area has historically produced Aedes
slerrensis, commonly called the Treehdle mosquito. This
moaquito breeds in water holding cavities within Oak and
other trees and is the primary vector of the parasite which
causes (log heartworm. Land which is subdivided and thereby
encourages urbanization in this area will result in an
increased risk of this disease.
Tree cavities that hold water especially Oak, trees,
need to be drained by drilling or notching the cavity or
filled with sand, dirt or other water displacing material.
These comments are consistent with the District's
adopted policy called "Guidelines, Checklist and Standarda
for Vector Prevention in Proposed Developments".

At the regular meeting of the Butte County Planning Commission held January 9, 1992,

Recently enacted legislation (AB 315:5, Chapter 1706, Statutes of 1990, effective January,
11 1991) requires that the Department of Fish and Game impose and collect tiling fees
as specified to defray the cost of managing and protecting fish and wiNlife trust
resources. These filing; fees are collected during, the ervironmental review procv,s and
are to be paid at the time the County files a "Notice of Exemption" with the County
Clerk pursuant to Section 21152 of the Public T1esources Code,
To increase administrative efficiency, 6e statute delegated the collection. of filing fees
to the County Clerk and provided the County authority to collect a $25„00 documentary
handling fee.The fees due for your project are as indicated on the attached Declaration
of Fees Due, Checks made payable to the County should be subrrutted to the County
by January 22, 1992.
Project applicants should be aware Section 21059(b) of the Public Resourcos Code,
provides that any project zpproved under CBQA, is not operative, 'vested, or final until
the filing fees required under Sectio r 711.4 of the Fish and Game Code are paid.
