Chase to be located on the north side of Myvalli Drive at 4378 Myvalli Drive, approximately 1,250 feet east of Cassandra Drive, at 4378 Myvalli Drive, Butte Valley. The nearest main intersection is Cassandra Drive and Durham -Peutz Road. PERMIT REQUIREMENTS: Approval for this Small Winery is subject to the following requirements: 1. Requirements: a. The parcel shall be'licensed by State of California Department of Alcohol Beverage Control, License Type 02 "Winegrower." b. The premises shall have a minimum parcel size of 3 acres. a If the winery.is accessed only via a private road, the applicant is required to pay their fair share of the road maintenance. costs. b. Landowner shall provide the Department of Development Services with copies of its wine production reports submitted to the Bureau of Alcohol, Tobacco and Firearms or other similar agency. C. The applicant shall obtain all necessary Building and Environmental Health Permits. f. Onsite Domestic Wastewater Wastewater from toilets and sinks will be regulated under Butte County Code Chapter 19 Onsite Wastewater Systems. The existing system installed in 2002 includes a 1,000 gallon concrete tank and 450' of leach line permitted only to serve a two bedroom dwelling and one bedroom in the garage/shop. g. Production Wastewater The proposed production wastewater will be minimal and there shall be no discharge of production wastewater to the soil. Best Management Practices describing how production wastes will be handled were submitted to this office, and subsequently approved by the Central Valley Regional Water Quality Control Board (Regional Board). As requested by the Regional Board, the applicant shall document production and waste volumes throughout the year and submit a report of these totals at the end of the first year of operation. Documentation of site conditions for cleanliness and proper disposal must be obtained by an independent third -party approved by the Division of Environmental Health, and then reported back to this office in addition to the yearly production volumes. The preference is for this site monitoring to occur quarterly throughout the first year, but ata minimum, during the crush of the first year. All documentation must demonstrate that no wastewater is entering the ground. For small wineries that will generate production wastewater for discharge to the soil, the Regional Board will require a Report of Waste Discharge and then most likely provide a Conditional Waiver of Waste Discharge as stipulated in "Small Food Processors and Small Wineries Within the Central Valley." (Order No. R5-2009-0097). The Division of Environmental Health will work with the applicant to assist them with completion of the Report of Waste Discharge and provide information so that the proposed operation will meet the requirements for attaining a Conditional Waiver from the Regional Board. h. Food Service Small wineries that only display a minor amount of commercially pre-packaged food will not be required to have a Permit to Operate. If necessary, applicant shall obtain a Permit to Operate from the Division of Environmental Health prior to exceeding permit thresholds. i. Water System Applicant shall cause to be performed an initial bacteriological test of the water system serving the winery and annual testing thereafter to assure potable water. 2. Allowed Uses: a. Growing and harvesting grapes and other products suitable for wine processing and bottling of grapes and grape products produced on the premises up to 7,500 cases per year. b. Processing and bottling of grapes and grape products produced off the winery premises up to 7,500 cases per year. C. Sale of wine for consumption off premises whether grown or produced on premises or off. d. Sale of merchandise related to wine or the winery. e. Wine tasting involving serving wine to the public for the purpose of sampling the wine, subject to the following restrictions: i. Wine tasting shall be limited to three days per week. ii. No buses or tour vans shall be allowed. iii. Notwithstanding Section 24-240 Parking Regulations, a minimum of four and a maximum of 10 paved or unpaved parking areas shall be provided in addition to any required for the handicapped, pursuant to Section 11-29B of the California Building Code. Covered and garage parking shall not count towards the total maximum parking. No on -street parking shall be allowed. iv. Use of outdoor amplified music shall be prohibited. V. Sanitary facilities and domestic water shall be provided pursuant to the requirements of Environmental Health Department. 3. Signage: a. Signage in conjunction with the operation of any winery allowed in this Section shall be subject to review and approval as part of the permit review procedure required for such winery. b.
